AR2299407 RESOLUTION RE: GRANT CHANGE OF ZONE TO REESTABLISH A (AGRICULTURAL) ZONING - WELD COUNTY BOARD OF COUNTY COMMISSIONERS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 24th day of June, 1992, at 10:00 a.m. for the purpose of hearing the application of the Weld County Board of County Commissioners for a Change of Zone to reestablish A (Agricultural) Zoning for Tract "A", Evans Industrial Park, for a parcel of land located on the following described real estate, to-wit: Mo UO Tract "A", Evans Industrial Park, part of the SE; of Section 30, Township 5 North, Range 65 West of the 6th ti p P.M. , Weld County, Colorado U o W WHEREAS, Section 21.6.2 of the Weld County Zoning Ordinance provides o standards for review of such a Change of Zone, and oa W 0 WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the request of the applicant and the o w recommendations of the Weld County Planning Commission and, having been fully no informed, finds that this request shall be approved for the following reasons: 0 N a 1. Adequate water and sewer service can be made available to the site to serve the uses permitted within the proposed zone district. The City of Evans will provide public water and sewer utilities in the future. Until public water and public sewer utilities are provided, the water and sewer for the proposed zoning area will be that which is allowed by right by the Colorado Division of Water Resources, and/or the Weld County and State Health Departments. d. Transportation facilities providing access to the area are adequate in size to meet the requirements of the proposed zone district. The area is currently served by an existing County maintained road. e. The proposed zoning would allow the recovery of sand and gravel with the approval of a special review permit. f. The proposed Agricultural Zone District is located within the Flood Hazard Overlay District. Conditions of approval address this concern. No other overlay district affect this site. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of the Weld County Board of County Commissioners for a Change of Zone to reestablish A (Agricultural) Zoning for Tract "A", Evans Industrial Park, on the above referenced parcel of land be, and hereby is, granted subject to the following conditions: 1. The following notes shall be placed on the plat, prior to recording: a. Uses on the property shall comply with the Flood Hazard Overlay District Requirements. b. Prior to any construction at this location, the property should be mapped for waters of the United States which includes wetlands pursuant to Section 404 of the Clean Water Act. 2. Lee Morrison, Assistant County Attorney, made this a matter of record. Lanell Swanson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record. Commissioner Lacy stated this concerns the changes in the road near Evans and the agreement with the City of Evans. Ms. Swanson said that is correct, and the resubdivision hearing is in conjunction with this Change of Zone. There was no public testimony offered concerning this matter. Commissioner Lacy moved to approve the Change of Zone to reestablish A (Agricultural) Zoning for Tract "A", Evans Industrial Park, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Harbert, and it carried unanimously. The complete application form is attached. 2. The tract of land was in the incorporated City of Evans until June 21, 1981. At that time the City of Evans de-annexed the area. No zoning was established. This application is to establish the zoning. The zoning which is contemplated at the present is A (Agricultural) . The proposed zoning is the same as the existing zoning of the surrounding unincorporated area. The proposed zoning is consistent with the policies of the Weld County Comprehensive Plan, because: a. The zoning of this property will not take farm ground out of production and allow agricultural uses by right. b. The zoning will not change the nature of the uses of the property which has existed since 1981 (pasture, farm production) . c. The land which surrounds this on three sides is currently zoned A (Agricultural) . The zoning in the city of Evans is M-2 (Medium Manufacturing Restricted) . The zoning will, in essence, correct the anomaly which is presented by this area not being zoned at present. 3.
