RE: APPROVE RELEASE OF PORTION OF COLLATERAL IN THE AMOUNT OF $84,375.25 FOR
SHILOH, INC. (S #354)
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated May 25, 1994, the Board did approve an
Improvements Agreement According to Policy Regarding Collateral for Improvements
(Private Road Maintenance) with Shiloh, Inc. , concerning property described as
a tract of land situated in the SE* of Section 4, Township 6 North, Range 67 West
of the 6th P.M. , Weld County, Colorado, and
WHEREAS, pursuant to said agreement, Letter of Credit #744, drawn on the
First Interstate Bank of Fort Collins, N.A. , P.O. Box 578, Fort Collins, Colorado
80522-0578, in the amount of $292,370.00 was submitted to Weld County, and
WHEREAS, James Scott, of Shiloh, Inc. , has presented the Board with a
request for partial release of said collateral for the completion of the
subgrade, roadbase, culverts, ditch improvements, park improvements, grass swale,
and street paving as per Exhibit C of said agreement, in the amount of
$84,375.25, and
WHEREAS, after study and review, and based on the recommendations from the
Department of Planning Services and County Attorney staff, the Board deems it
advisable to approve said request to release said portion of collateral in the
amount of $84, 375.25 to Shiloh, Inc.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that a portion of collateral, in the amount of $84,375.25,
being held by Letter of Credit #744, drawn on the First Interstate Bank of Fort
Collins, N.A. , P.O. Box 578, Fort Collins, Colorado 80522-0578, in the total
amount of $292,370.00, be, and hereby is, released.

RE: Recommendation of Approval to Release Portion of Collateral
DATE: August 10, 1994
The Department of Planning Services has accumulated comments regarding completion
of the improvements in accordance with the Improvements Agreement according to
policy regarding collateral for improvements dated the 25th day of May, 1994,
regarding Shiloh, Inc. The Department of Planning Services recommends release
of a portion of the collateral held to secure the agreement as a result of the
inspections and approvals presented to us by Foundation and Soils Engineering,
Inc. , the Weld County Public Works Department, and the Weld County Attorney's
Office. The amount recommended to be released is $84,375.25.

We have conducted compaction tests for the roadway subgrade and
base course for Shiloh Estates . We also checked six ( 6 ) locations
for the roadbase thickness .
Based on our compaction tests and inspections , we feel that the
subgrade and roadbase were constructed in substantial accordance
with the Engineer ' s recommendations . If you have any questions ,

We have reviewed the work completed to date on Shiloh Estates PUD.
The second, third, and fourth items of work, as shown in Exhibit C of our Road Improvements
Agreement, has been completed. Those items are completion of culverts, ditch improvements,
park improvements, grass swail, street grading, street base, and street paving. These items of
work total $84,375.25.
Attached is a letter from Foundation and Soils Engineering, Inc. that is certified to by Kevin
Patterson, P.E., that the construction was performed in accordance with their recommendations.
I recommend a partial release of the collateral and letter of credit, number 744 by the First
Interstate Bank of Fort Collins, in the amount of$84,375.25.
