Home My WebLink About920648.tiff RESOLUTION RE: APPROVE LETTER OF AGREEMENT WITH WESTERN AREA POWER ADMINISTRATION AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Letter of Agreement, concerning Bridge 60.5/29A, between Western Area Power Administration and the County of Weld, State of Colorado, with the further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Letter of Agreement, concerning Bridge 60.5/29A, between Western Area Power Administration and the County of Weld, State of Colorado be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said agreement. Box 758 Greeley, CO 80632 Dear Mr. Graham: Weld County is replacing a bridge on 4th Avenue, west of Greeley, Colorado (Project Number 60.5 29A) . The bridge is beneath a span between structures 1/1 and 1/2 on the Western Area Power Adminisstartion's (Western) Weld-Greeley 115-kV transmission line. The new bridge will be built higher than the existing bridge, reducing the electrical clearance of our line below the minimum requirements. Therefore, our line will have to be raised. In accordance with and subject to the provisions in this letter agreement between Western and Weld County (Contractor), it is agreed that Western will raise the transmission line spanning the bridge on 4th Avenue under the following terms and conditions: 1. Western. at the sole expense of the Contractor, shall : 1.1 Review and approve the Contractor's request to raise the transmission line spanning the bridge on 4th Avenue. 1.2 Replace structure 1/1 with an 80-foot HS structure, install 100- pound hold-down weights on structure 1/2, and plumb insulators on structures 0/8. 0/9, 0/10, 1/2, 1/3, and 1/4. 1.3 Prepare this letter agreement and any other required documents. 2. The Contractor, at its sole expense shall replace the bridge on 4th Avenue, west of Greeley, Colorado (Project Number 60.5 29A). 3. Payments: The Contractor shall pay Western for the costs it incurs as a result of performing the work described in Section 1 herein. The cost for the work described is $14,000.00, including all allocable expenses. The Contractor shall , upon signing this letter agreement, advance to Western a fixed fee sum of $14,000 to perform the work described. Authorization to proceed with the work provided for herein will be granted as soon as our Headquarters finance office notifies us that the funds have been received. Operation and Maintenance: The ownership, operation, maintenance, and replacement of all facilities and associated equipment installed pursuant to section 1 shall remain with Western. 5. License: The Contractor, under the terms and conditions specified herein, hereby grants a license to Western, its employees, agents, and contractors, to enter the Contractor's right-of-way in order to perform the work provided for herein; Provided, That proper advance arrangements are made with the Contractor. 6. Term: This letter agreement shall become effective on the date signed by the Contractor and shall terminate one (1) year after execution of this letter agreement or upon completion of the work described herein. 7.
