RE: ACTION OF BOARD CONCERNING REQUEST FROM ELMER GUSTAFSON,
PRESIDENT OF WINDSOR RESERVOIR & CANAL COMPANY, CONCERNING
THOMPSON DAM/WELD COUNTY ROAD 74
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board has received a request from Elmer
Gustafson, President of Windsor Reservoir & Canal Company,
concerning the Thompson Dam/Weld County Road 74 , and
WHEREAS , the Board deems it advisable to refer said request
to the Road and Bridge Department and the County Attorney' s staff
for recommendation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado , that the request of Elmer
Gustafson, President of Windsor Reservoir & Canal Company,
concerning Thompson Dam/Weld County Road 74 be, and hereby is ,
referred to the Road and Bridge Department and the County
Attorney' s staff for recommendation.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 8th day of
January, A.D. , 1990 .

Re : Thompson Dam/Weld County Road #74
Dear Commissioners :
This letter follows my previous conversation with various
commissioners, concerning the above-referenced matter . As you are
aware , Weld County Road #74 crosses the top of the Thompson Dam,
which is owned and operated by Windsor Reservoir and Canal Company.
The canal company has recently been notified by the State Engineer of
various problems and concerns with respect to the dam. This letter
is intended to provide that information to you, inasmuch as County
Road #74 may also be affected.
The canal company has recently been advised by the State
Engineer that there are several conditions that threaten the long
term safety of the dam. This report is a result of an inspection of
the dam, which took place on October 17 , 1989 . For your information,
I have enclosed a copy of the report from the Office of the State
Engineer , together with the inspection report of the Dam Safety
Branch. As you will note from the enclosed report, the State
Engineer ' s Office has recommended that we seek the assistance and
recommendations of an engineer to make certain repairs and
improvements to the dam.
Inasmuch as the stability of the dam or , in contrast , the
instability and potential failure of the dam definitely affects the
use and condition of Weld County Road #74 , we would request your
consideration of the county' s input and contribution for the repairs

and improvements of the dam, as set forth in the report of the State
Engineer . The canal company is willing to coordinate this project,
by retaining the appropriate engineer, overseeing the actual repairs
and improvements, and obtaining the necessary approval from the State
Engineer ' s Office . However , such an undertaking is a significant
financial burden, which should be shared by those who benefit from
the repairs and improvements ( i .e . : both the county and the canal
company) .
At your earliest convenience, would you please advise me of your
willingness to financially support this project? Since the State
Engineer has indicated that certain work must be completed by January
31 , your prompt response would be appreciated.
