AND WANDA MCNAMARA WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of November, 1990 , at the hour of 10 : 00 a.m. , in the Chambers of the Board for the purpose of hearing the application of John J. and Wanda McNamara, 1511 East 16th Street, Greeley, Colorado 80631 , for a Site Specific Development Plan and Special Review Permit for recreational vehicle storage in the Agricultural Zone District on the following described real estate, to-wit: Part of the NWI SW* , Section 10 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Don Hoff, Attorney, and WHEREAS, Section ?_4 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 . 7 of the Weld County Zoning Ordinance . 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 .2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan Urban Growth Boundary Goals and Policies . Urban uses are intended to concentrate in or adjacent to existing municipalities. In a letter dated September 26 , 1990 , a representative of the City of Greeley stated that the City of Greeley Planning Commission had no objection to this proposal if certain conditions are complied with. These conditions are addressed in the Conditions of Approval and Development Standards. b. The proposal is consistent with the intent of the Agricultural Zone District and is provided for as a Use by Special Review. c. The uses which would be permitted will be compatible with the existing surrounding land uses which include a cemetery, gravel mining, East 16th Street, pasture and rural residences , and will be compatible with the future development of the surrounding area as permitted by the City of Greeley Comprehensive Plan. Conditions of Approval and Development Standards will ensure compatibility. No objections have been received from surrounding property owners. d. The property is located in the Airport Overlay District. Development Standards address this concern. No other overlay districts affect the site. e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for recreational vehicle storage in the Agricultural Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions : 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder' s Office within 15 days of approval by the Board of County Commissioners. 901106 Page 3 RE: USR - MCNAMARA 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Within 30 days of approval by the Board of County Commissioners, an I.S.D.S. evaluation shall be performed on all existing septic systems. Septic permits shall be required on the existing systems following the evaluations. 4 . Prior to recording the Special Review Permit plat: a. The plat shall be amended to show a 50-foot reservation north of the centerline of East 16th Street. Kir County Attorney Gor ac 901106 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS JOHN J. AND WANDA MCNAMARA 1 . The Site Specific Development Plan and Special Review Permit is for recreational vehicle storage in the Agricultural Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval o£ this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3 . The property shall be maintained in compliance with the requirements of the Airport Overlay District. 4 . All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5 . No permanent disposal of wastes shall be permitted at this site. 6 . All waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris , and other potential nuisance conditions . 7 . Fugitive dust shall be controlled on this site. 8 . A 20-foot all-weather surface shall be provided on the access road to within 150 feet of the furthermost point of the storage buildings , as requested by the Greeley Fire Department. 9 . This Permit shall automatically be reviewed in 10 years after the date of approval by the Board of County Commissioners, and expire when there is a sale or lease of the property. The Permit will not expire if the property is willed or transferred to a family member. 10 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 11 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 . 5 of the Weld County Zoning Ordinance. 901106 Page 2 RE: DEVELOPMENT STANDARDS - MCNAMARA 12 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 . 6 of the Weld County Zoning Ordinance. 13 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 14 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 15 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Hoff REQUEST: A Site Specific Development Plan and Special Review permit for recreational vehicle storage in the A (Agricultural) zone district LEGAL DESCRIPTION: Part of the NW} SW} of Section 10, T5N, R65W of the 6th P.M. , Weld County, Colorado LOCATION: East of the City of Greeley on the north side of East 16th Street; 1511 East 16th Street APPEARANCE: Don Hoff, Attorney, represented the applicant. The owners of the property built agricultural storage sheds designed for storage of machinery and farm equipment. These sheds are open on the south end and enclosed on the north, east, and west sides. Three years ago, Mr. MCNamra reduced the scale of his farming operation and started renting out these spaces to other persons to store motorhomes. One shed contains enough space for 11 vehicles, the other shed has space for 6 vehicles, for a total of 16 vehicles. Three or four spaces are still used for storage of Mr. McNamaras agricultural machinery. C k ILL 6.(_ C Planning Commission Summary October 2, 1990 Page 2 The Chairman called for discussion from the audience. There was none. Don Hoff addressed the screening plan between the storage buildings and East 16th Street. This request is troublesome for John McNamara. The area between the sheds and the roadway is currently used for an alfalfa field. If screening is placed close to the sheds, it would interfere with parking the motorhomes in the sheds. If the screening is placed away from the shed, it would be placed in the alfalfa field. The other option would be to place the screening along East 16th Street, this would interfere with the future expansion of East 16th Street. Don Hoff stated that the City of Greeley's request for screening is not compatible . These buildings will exist whether or not this land use application is granted. Don Hoff requested that the seconded paragraph of the Conditions of Approval number 4 be deleted. Don Hoff addressed the City of Greeley's request to place a clause in the Development Standards that this permit would expire after 10 years. Don Hoff would like to have the Development Standard state that the application be reviewed in 10 years. Jean Hoffman asked if other sheds located on the property would be converted to store motor homes . Don Hoff replied that none of the other sheds and buildings would be converted or used for this purpose. MOTION: Ann Garrison proposed to delete Development Standard Number 9. Ann Garrison proposed that Development Standard Number 10 be amended to read: 10. This permit shall automatically be reviewed in 10 years after the date of approval by the Hoard of County Commissioners, and expire when there is a sale or lease of the property. The permit will not expire if the property is willed or transferred to a family member. All following Standards shall be renumbered consecutively. Ann Garrison proposed to delete the seconded paragraph of Condition Number 4. The motion was seconded by Leann Reid. Planning Commission Summary October 2, 1990 Page 3 The Chairman asked the secretary to pall the members of the Planning Commission for their decision. LEGAL DESCRIPTION: Part of the NE} SE} and SE} NE} of Section 31, T6N, R66W of the 6th P.M. , Weld County, Colorado LOCATION: Approximately 1/4 mile northeast of the City of Greeley; north of and adjacent to Weld County Road 62-1/4 and west of and adjacent to Weld County Road 27. APPEARANCE: Gary Tuttle, Attorney, represented the applicant. This proposal is to mine the sand and gravel which is in the property. The applicant is proposing to mine approximately 40 acres and will have a 27 acre lake. The lake will be connected to the groundwater so the level of the water and lake will stay fairly constant. Truck access will be from North 83rd Street. The County and the applicant have plans to pave North 83rd Avenue in the spring. Conditions of approval and development standards will ensure compatibility. No objections have been received from surrounding property owners. The property is located in the Airport Overlay District. Development Standards address this concern. No other overlay districts affect the site. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Planning Commission's recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2 . The Site Specific Development Plan and Special Review permit is for recreational vehicle storage in the Agricultural zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S., as amended. 3. The property shall be maintained in compliance with the requirements of the Airport Overlay District. 4. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. No permanent disposal of wastes shall be permitted at this site. 6. All waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust shall be controlled on this site. 8. A 20 foot all-weather surface shall be provided on the access road to within 150 feet of the furthermost point of the storage buildings, as requested by the Greeley Fire Department. 9. This permit shall automatically be reviewed in 10 years after the date of approval by the Board of County Commissioners, and expire when there is a sale or lease of the property. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 11. The proposed land use is located directly north of Linn Grove Cemetery and is within the City's Mid-Range Expected Service Area and the Long-Range Expected Growth Area. After conducting a detailed review of this request the City of Greeley Planning Commission found that the application does comply with the Greeley Comprehensive Plan with the following recommendations: 1. Dedicate 50 feet right-of-way from centerline for future expansion of 16th Street. 2 . Provide a 20-foot all-weather surface to within 150 feet of the furthermost point of the storage barns as requested by the Greeley Fire Department. 3 . Provide visual buffering of the open storage barns to enhance the visual appeal of the site and the East 16th Street corridor. 4 . Limit the time period of the permit to ten years so that flexibility is provided in the development of the 16th Street Corridor. The pole barns were constructed for the purpose of storing agricultural equipment . 2 . Since the applicant has reduced the amount of agricultural equipment he stores on the premises , the applicant desires to use the buildings for the purpose of storing motor homes . There is a need for indoor and covered storage of motor homes as such storage bays are rather limited in the Greeley area . Further , residents of Greeley are prevented by zoning laws and by covenants from storing motor homes at their place of residence . The existing uses on surrounding properties include the City of Greeley cemetery to the South , a mobile home repair shop some distance to the West , a gravel mine and related operation to the North , agricultural and residences to the immediate East and West . Numerous other commercial enterprises are located within one-half mile of the premises . The distance from the structures to be used for motor home storage to the applicant ' s residence is approximately 100 feet , the distance to the residence to the East is approximately 400 feet , the distance to the residence on the West is approximately 400 feet . The actual number of spaces available for rental is 16 . Therefore , no more than 16 persons will be using the facility at any one time . There will be no employees and no shift work . Patrons are allowed to bring their motor homes in for storage and take them out of storage any time during daylight hours . No water will be used . Access will be off of 16th Street on the farmyard driveway . Motor homes varying in size and weight from 18 to 40 feet and weighing from 8 , 000 to 28 , 000 lbs . will be stored in the facility . It is anticipated that one or two motor homes will move in and out of the facility each week depending on the season . No sewage facilities will be used . No fire protection measures are proposed . There will be no water retention or trash or ,junk accumulated or stored on the premises as a result of the use . r*,r 1 `, No special landscaping is planned and no erosion control measures or reclamation procedures will be necessary . 3 .
