RE: POLICY ON 45-DAY WAIVER PURSUANT TO THE COLORADO BEER CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Weld County Board of Commissioners is the local liquor
licensing authority with certain powers and duties pursuant to the Colorado Beer
Code, and
WHEREAS, Section 12-46-106(13) , CRS, requires the application for renewal
of an existing license to be made to the local licensing authority not less than
45 days prior to the date of expiration and further provides that the local
licensing authority, for good cause, may waive the time requirements of applying
45 days prior to expiration, and
WHEREAS, the Board of County Commissioners wishes to establish a policy for
determining what will be considered good cause for failure to file the
application for renewal in a timely manner, which good cause is intended to be
limited to conditions not within the control of the licensee and applicant for
renewal.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board will consider good cause for waiver of the 45-
day requirement for application of renewal prior to expiration of an existing
liquor license to be the following if they are demonstrated to have interfered
with the ability of the licensee to apply prior to the 45 days preceeding the
expiration date:
1. Medical Hardship for licensee;
2. Failure of the State Licensing Authority to properly notify the
licensee of the expiration date, unless such failure is occasioned
by the licensee's failure to advise the State Licensing Authority of
a change in address;
3. Acts of God;
4. Damages to the licensed premises not as a result of intentional or
willful misconduct by the licensee or the manager;
5. Declarations of war, imposition of martial law, or civil unrest.

RE : Board of County Commissioners of Weld County Policy on
45 Day Waiver
•
On July 7 , 1993 , the Board of County Commissioners of Weld County,
Colorado approved a policy regarding requests for waiver of the 45
day time requirement for requests for renewal of existing Beer and
Liquor Licenses . Enclosed is a copy of the Resolution, which .
describes the policy.
Please be advised that pursuant to Sections 12-46-106( 13) , C.R.S .
and Section 12-47-106 ( 1) (b) C.R.S . you must apply for the renewal
of your existing beer and/or liquor license not less than 45 days
prior to the date of expiration. It is my understanding that the
Department of Revenue, Liquor Licensing Division, mails the renewal
application forms at least four months prior to the dates of
expiration. Therefore, there should be no reason why applicants
should not be able to comply with the 45 day time requirements .
