HomeMy WebLinkAbout930299 RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1483 - BARKER, ET AL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1483, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1483 was submitted by Lawrence and Marie Barker, et al, for property which is located in part of the Wi of Section 13, Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicants and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 76 acres and 4 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. A Weld County septic permit is required for the proposed home, and the septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) Regulations. 2. An ISDS Permit must be finalized and approved by an Environmental Protection Specialist within one year of the application date. 3. The applicants shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11. 7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. Dear Commissioners: This request for a Recorded Exemption is submitted by Lawrence and Marie Barker, et al. The parcel of land is described as part of the W2 of Section 13, T4N, R68W of the 6th P.M. , Weld County, Colorado. The property is located approximately 1-1/2 miles southwest of Johnstown. The request is to divide the property into two parcels of 76 acres and 4 acres, more or less. This parcel is the total contiguous landholding of the applicant. Little Thompson Water District can provide domestic water service to the property. Sewage disposal is proposed as septic systems. The Town of Johnstown and the Weld County Health Department had no objections to this request. Our office has received no objections from any of the surrounding property owners or the mineral owners. The staff has concerns that the proposed division will be inconsistent with efficient and orderly development. As shown on the attached aerial photograph, the level of development in this area and the potential for continued divisions may evade the intent of the Weld County Subdivision Ordinance. This parcel was part of a 220+ acre parcel that was divided into three separate parcels in 1992. The approval of this application will create two potential building sites on the 80 acres parcel under consideration. Increased residential development in rural areas requires more urban-type services such as road maintenance, snow removal, utilities, police and fire protection and school busing. The service demands increase as the density is increased. The staff requests that the Board of County Commissioners consider this application and determine if the standards of Sections 11.5 and 11.8 of the Weld County Subdivision Ordinance have been met. The proposed exemption currently consists of 80 acres that is used solely as agricultural farm land . Approximately 75 acres is irrigated land and 5 acres dryland grass pasture. There is no livestock on the property currently . The property has no principal residence, no labor home, no mobile home, no barns , no outbuildings , or structures of any kind. A concrete irrigation ditch runs parallel with the north property line set off of county road 46 . Also, irrigation ditches run along the oil/gas well field road on the East property line approximately 948 ' then runs west to center of property and south/southeast again to the southern boundary. Oil and Gas Wells on the property consist of ( 2) Oil/Gas Wells , separators and storage tanks . First Oil/Gas Well site sits off East Boundary 10-15 ' +/- approximately 823 ' South of North property line. Second Oil/Gas Well site sits off West Boundary 25 ' +/- approximately 1658 ' South of North property line . 9 . The reason for the proposed exemption is to create a lot for the Barker ' s to build a house, barn & machine shed for our personal equipment . A separate lot is needed for financing purposes only as the Barker' s plan to farm the entire 80 acres in the near future for the Schlautman' s and Barker ' s . The land will be farmed all around the proposed buildings therefore minimizing the removal of prime farm land . Proposed LOT A: Will be that used for the house, barn and machine shed for our personal equipment that will sit approximately 300 ' south of the North property line , therefore , Lot A will be 4 acres . The location of the proposed Lot A is the Northeast corner of the present 80 acre lot . The Lot A will be 284 . 84 ' west from the Northeast tract corner . The West side property line of Lot A will run parallel with the West side property line of the existing 80 acre parcel . The proposed Lot A will be 4 acres of which 2 acres +/- will remain cropland minimizing the removal of farmland. The remaining 2 acres +/- will be used for the proposed buildings . The current use of the proposed lot is irrigated farmground. 11 . The proposed exemption is consistent with the Weld County Comprehensive Plan to enable the property owner to provide a residence for direct members of the farm family . Thus , allowing the family to continue the farming of the land. The land is currently leased to a local farmer but we plan to farm it in the near future. The exemption proposed also minimizes the removal of prime agricultural land from farming as we will farm around the proposed buildings . 12 . The uses of proposed new Lot A will be for a farmhouse , horse barn and machine shed for farming the land. The land will stay irrigated farmland consistent with the agricultural land surrounding the proposed Lot A. We want to create another productive agricultural farm in Weld County . 13 . The proposed exemption is consistent with the Agricultural Zone District it is located within by continuing the agricultural use of the land . Also, is in compliance with a residential allowance within the Agricultural District . 14 . The proposed exemption is consistent with efficient and orderly development . It is also compatible with future development of the area as farms so is believed to be not inconsistent . 15 . The proposed exemption is in compliance with: Adequate water supply for both lots per letter from Little Thompson Water District ; adequate septic system per Weld County Health Department requirments ; adequate legal access being road 46 fronts both parcels ; we understand and will comply with all Zoning ordiances ; minimum size is not less than 1 acre; understand and conforms with Comprehensive Plan; conforms with ownership; no exemption has been used with last 5 years ; will no be a subdivision; and only a very small portion of the southwest portion of Parcel B is in the flood zone and no buildings of any kind will be near this area. 16 . The proposed exemption makes application for the proper permits and follows proper procedures .
