RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1040 FOR AN AGRICULTURAL SERVICE ESTABLISHMENT TO PROCESS VEGETABLES IN THE A (AGRICULTURAL) ZONE DISTRICT - KENNETH MAYER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 30th day of March, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Kenneth Mayer, 14534 Weld County Road 19, Platteville, Colorado 80651, for a Site Specific Development Plan and Special Review Permit #1040 for an agricultural service establishment to process vegetables in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the NW,' SWy of Section 22, Township 3 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Fred Otis, Attorney, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary Area and Agricultural Goals and Policies. On January 18, 1994, the Platteville Planning Commission indicated the request complies with its Comprehensive Plan. The Town of Mead referral response also indicates the request complies with its Comprehensive Plan, and additionally, the town has no objections to this request. b. The proposal is consistent with the intent of the A (Agricultural) Zone District and is provided for as a Use by Special Review. c. The uses which would be permitted will be compatible with the existing surrounding land uses which include rural residences, cropland, high-tension power lines, a large agricultural building, silos, and oil and gas production. Conditions of Approval and Development Standards will ensure compatibility with the surrounding land uses. No objections have been received from surrounding property owners. d. No overlay districts affect the site. e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Kenneth Mayer for a Site Specific Development Plan and Special Review Permit #1040 for an agricultural service establishment to process vegetables in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 940299 SPECIAL REVIEW PERMIT 111040 - MAYER PAGE 3 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to planting the windbreak, the applicant shall contact the Brighton Soil Conservation Service for assistance in choosing species and creating a tree planting design to ensure survival and maximum wind break effectiveness. 4. Prior to recording the plat, any loading areas shall be designated on the plat. Kirkm er a I 940299 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS KENNETH MAYER USR #1040 1. The Site Specific Development Plan and Special Review Permit is for an agricultural service establishment to process vegetables in the A (Agricultural) Zone District as submitted in the application materials on file and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The parking lot shall be covered with gravel to help prevent wind erosion. 4. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. An Air Pollution Emission Notice (A.P.E.N. ) and Emissions Permit application shall be submitted to the Air Pollution Control Division, Colorado Department of Health, for emissions of criteria, hazardous or odorous air pollutants. 6. No permanent disposal of wastes shall be permitted at this site. 7. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 8. Fugitive dust shall be controlled on this site. 9. The maximum permissible noise level shall not exceed the industrial limit of 80 db(A) as measured according to 25-12-102, Colorado Revised Statutes. 10. Any existing septic system which is not currently permitted through the Weld County Health Department shall have an Individual Sewage Disposal System evaluation prior to the issuance of the required septic permit. 11. Adequate toilet facilities shall be provided for the public. 12. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 940299 DEVELOPMENT STANDARDS - MAYER PAGE 2 13. The septic system shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 14. Any existing septic system shall be reviewed by a Colorado Registered Professional Engineer and a copy of that review shall be submitted to the Weld County Health Department before the required Individual Sewage Disposal System Evaluation can be performed. 15. A Colorado Discharge Permit System (CDPS) Permit shall be obtained from the Water Quality Control Division of the Colorado Department of Health for any proposed discharge into State Waterways. 16. No on-site disposal of produce of any type shall be permitted at anytime. Produce shall be handled and stored at the facility in such a manner so that no nuisance is created by odor, blowing of debris, fugitive dust, or spoiled produce on or around the facility. 17. All pesticides, fertilizer, and other potentially hazardous chemicals shall be stored and handled in a safe manner. Reference 25-8-205.5, Colorado Water Quality Control Act and Rules and Regulations thereof. 18. This facility shall utilize Central Weld County Water District as the domestic water supply serving the site. 19. Individual Sewage Disposal System permits shall be finalized and approved by an Environmental Protection Specialist within one year of the application date. 20. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 21. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 22. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 23. Personnel from the Weld County Health Department, the Platteville Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 940299 DEVELOPMENT STANDARDS - MAYER PAGE 3 24. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 25. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 940299 HEARING CERTIFICATION DOCKET NO. 94-27 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN AGRICULTURAL SERVICE ESTABLISHMENT TO PROCESS VEGETABLES IN THE A (AGRICULTURAL) ZONE DISTRICT - KENNETH MAYER A public hearing was conducted on March 30, 1994, at 10:00 a.m. , with the following present: Commissioner W. H. Webster, Chairman Commissioner Dale K. Hall, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Greg Thompson The following business was transacted: I hereby certify that pursuant to a notice dated February 28, 1994, and duly published March 17, 1994, in the Windsor Beacon, a public hearing was conducted to consider the request of Kenneth Mayer for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment to process vegetables in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Greg Thompson, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written and indicated staff also recommended approval. Fred Otis, Attorney, represented the applicant and explained there are actually two applications to be considered together, one for the Special Review Permit and one for RE #1580. RE 1/1580 will split off the 1.5-acre parcel for the agricultural processing plant, which will enhance the agricultural community in Platteville. Mr. Otis confirmed that all Conditions of Approval and Development Standards are acceptable. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve the request of Kenneth Mayer for a Site Specific Development Plan and Special Review Permit for an agricultural service establishment to process vegetables in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Baxter, and it carried unanimously. Mr. Thompson indicated for the record that staff recommended approval of RE 1/1580, and Mr. Otis incorporated his previous comments into the record. No public testimony was offered concerning RE #1580. Commissioner Baxter moved to approve RE #1580 for Walter and Dorothy Mayer, with one Condition of Approval. Commissioner Harbert seconded the motion, which carried unanimously. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 13. No on-site disposal of produce of any type shall be permitted at anytime. Produce shall be handled and stored at the facility in such a manner so that no nuisance is created by odor, blowing of debris, fugitive dust, or spoiled produce on or around the facility. 17. All pesticides, fertilizer, and other potentially hazardous chemicals shall be stored and handled in a safe manner. This facility shall utilize Central Weld County Water District as the domestic water supply serving the site. 19. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 22. Personnel from the Weld County Health Department, the Platteville Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 24. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. An Air Pollution Emission Notice (A.P.E.N. ) and Emissions Permit application shall be submitted to the Air Pollution Control Division, Colorado Department of Health for emissions of criteria, hazardous or odorous air pollutants. 6. No permanent disposal of wastes shall be permitted at this site. 7. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 8. The ' report has been prepared using accepted engineering practices and procedures and should provide you and the reviewing agencies with adequate information to analyze the storm drainage conditions affecting the site, and review the outline of adequate drainage improvements and the proposed site grading and minimum building elevations. GENERAL: The site and drainage plan are shown on the Use By Special Review Plan. A pro- posed and a future building is shown. The major portion of the site will be gravelled for truck traffic areas for loading and unloading of produce, and a small parking area. Open areas of 15% for landscaping will be set aside along the West frontage and Easterly portion over the leach field area. The site is located at the Northwesterly corner of a cultivated field. All land not required for the operation will remain in field until needed. The site drains Northwesterly at a 0.3%, more or less , grade. Present drainage is minimal and runs as sheet flow to the North. The pond volume was calculated using the listed requirements to retain all storm water from a 100-Year Design Storm in excess of the historical runoff from a 5-Year Design Storm. A Rainfall Intensity-Frequency Table prepared by Hogan & Olhausen for the City of Greeley was used to determine the flow quanti- ties and hydrograph procedures used to determine the storage volumes required. The Modified Rational Method was used to determine the pond inflow, the allow- able release rate and, consequently, the pond volume. The determination of the formula input items are shown on calculation sheets. Discharge rate during a 100-Year Design Storm would be 2.50 cfs with a Tc of 31 .5 minutes. Maximum storage volume under the required criteria would be 4800 cubic feet. A detention pond is proposed to be constructed at the Northwest Corner of the site. A berm with a top elevation of 2.4 feet above the bottom will create a storage volume of 4800 CF and meet the storm drainage requirements. The berm will be placed along the Westerly and Northerly property line. Other than the pond area and berm, only a minimum amount of site grading will be required. Materials excavated from the low point will be used to construct the berm. As minimum landscaping is proposed, the berm can be constructed with a 1 .0 foot wide top and with 3:1 slopes on the inside and outside. The proposed building will be raised to provide drainage away from the buildings and site drainage. ACCESS My concerns are in regard to access for the commercial development . The site Lot A, is located approximately 1/2 mile north of SH 66 along Weld County Road 19 . The information provided in regard to impact as a result of this development indicates ten semi-trucks would be accessing this site per day. This would be equivalent to twenty trips per day by semi-trucks . Also, the narrative addresses employees and states that 15 would be employed there during the busiest part of the season. I am assuming that this would be 15 employees each with their own vehicle, which results in thirty trips per day. My concern in regard to the Weld County Road 19 connection to SH 66 is that if this added impact equals a 20% increase of the overall use of the county road, and if WCR 19 does not come up to normal standards then there would need to be some improvements to its connection at SH 66 . If these volumes result in what would be termed as change of use by the State Highway Access Code those improvements should be made. Some additional information about change of use regarding this site is as follows : An access is deemed to see a change of use if the use of the access is increased by a proposed vehicular volume of 20%, or if a particular direction of use increases by 2096, or in this regard as semi-trucks are to be using this county road to access Lot A the critical movement may be semi-trucks . The Code states that if the use of an access 910299 Mr. Greg Thompson January 25, 1994 Page 2 of 2 Mayer Site Specific Dev. Plan by vehicles exceeding 30, 000 lbs . GVW increases by 20% or 10 vehicles per day that condition would result in a change of use. Should this be the case and change of use be determined, the connection between WCR 19 and SH 66 should be reviewed. This would require a site visit with this office and include the County and perhaps the applicant . The State Highway Access Code addresses vehicular use and operation of public accesses in Section 2 . 10 .4 of the Code, as follows : "Vehicular use and operation of public accesses (county roads and municipal streets) to the state highway is the responsibility of the appropriate local authority. The local authority should maintain access conformance with the code to the extent feasible and practicable within statutory and public funding limitations . The local authority may fund any necessary improvements by requiring contributions from the primary users of the access or as off-site subdivision improvements necessary for the public safety pursuant to section 30-28-133 and 133 . 1, C.R.S . and section 31-23-201 to 227, C.R.S. , or other available public funds . " DRAINAGE As Lot B is to continue its agricultural use I would not anticipate any change of drainage patterns as a result of this development . It appears that access is my only concern. Explain the type of existing uses on surrounding property site. Applicants believe that their use of the Property will be compatible with surrounding uses since they are in an agricultural support business and located in a very agricultural community. The surrounding uses in all directions are agricultural and very compatible with Applicants' request. d. The distance of the proposed use to residential structures in each direction: (1) North. 800' to Applicants' residence. (2) South. One-quarter mile. (3) East. One-quarter mile. (4) West. More than two miles. e. The maximum number of users, patrons, members, and buyers. Applicants estimate that there will be ten trucks per day coming and going from the site to pick-up and deliver product. There will not be members of the public at the site. f. Number of employees, number of shifts, and hours of operation. Applicant estimates that there will be fifteen (15) employees during the busiest season, and only one shift during normal business hours. g. Type of water source for the proposed use. All water will be supplied by Central Weld County Water District, see attached letter from Central Weld County Water District. h. Explain the access route(s) to be utilized for the proposed use. Access will be via Weld County Road 66 to Weld County Road 19 to a 25 ft. access road as permitted by a right-of-way granted in Book 163 at Page 510 of the Weld County Clerk and Recorder's records. Applicants estimate there will be a maximum of ten semi-trucks per day picking up and delivering product. j. Type of sewage facilities for the proposed use. Septic. k. Types and maximum number of animals to be concentrated on the use by special review area at any one time. N/A m. The type and size of any waste, stockpile or storage areas associated with the proposed use. N/A n. The type of storm water retention facilities associated with the proposed use. None. o. The time schedule and method of removal and disposal of debris, junk and other wastes associated with the proposed use. Cull produce will be used as fertilizer on Applicants' farm or sold as cattle feed. Any unusable culls will be disposed of by a commercial solid waste carrier. p. Explain proposed landscaping plans and erosion control measures associated with the proposed use. Applicants plan to plant 40 to 50 trees from the Soil Conservation Service around the perimeter of their Property. q. Applicants plan to start construction as soon as this Application is approved, hopefully no later than March 1, 1994. Applicants plan to be in operation by June 1, 1994. 3. THE FOLLOWING WRITTEN MATERIALS AND SUPPORTING DOCUMENTS ARE SUBMIT TED AS A PART OF THE APPLICATION: a. A statement explaining how the proposal is consistent with the weld county comprehensive plan. The Weld County Comprehensive Plan indicates an intent to encourage agricultural and farm use. The proposal of Applicants is entirely consistent with the Comprehensive Plan since the proposed uses are agricultural in nature and will directly benefit the surrounding community and surrounding farm operations. In addition, the Applicants will employ up to fifteen (15) people in the Platteville community. b. A statement explaining how the proposal is consistent with the intent of the district in which the use is located. The Applicants' uses are agricultural in nature and therefore very compatible with the surrounding community. c. If applicable, a statement explaining what efforts have been made, in the location decision for the proposed use, to conserve productive agricultural land in the agricultural zone district. The one and one-half acre parcel devoted to the Use by Special Review area is located in a corner, allowing a center pivot sprinkler system to be located on the adjacent property. The soil in the one and one-half acre corner location is sandy and therefore poor soil for agricultural production. d. A statement explaining there is adequate provision for the protection of the health, safety and welfare of the inhabitants of the neighborhood and the county. Applicants intend to operate a clean, safe and wholesome farm-related vegetable processing operation. Applicant believes that there will be no detrimental impact on the health, safety and welfare of the inhabitants of the neighborhood or the county. • 940299 Weld County Planning Commission December 29, 1993 Page 5 e. A statement explaining the uses permitted will be compatible with the existing surrounding land uses (include a description of existing land uses of all properties adjacent to the property). Applicants will be operating a vegetable processing business in a predominately agricultural area approximately three to four miles West of Platteville, Colorado. Applicants believe that the vegetable processing operation will be very compatible with the surrounding farms which are adjacent to the subject property. f. Statement explaining the proposed use will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by the Comprehensive Plan of the county or the adopted master plans of affected municipalities. Applicants uses are agriculture in nature and they are surrounding by an agricultural zone. Platteville is a community largely associated with farming and its comprehensive plan fosters a further development of agriculture, much the same as the overall Weld County Comprehensive Plan. Therefore the Applicants' proposed uses are compatible and consistent with the Comprehensive Plans of both Platteville and Weld County. g. A statement explaining the Use by Special Review area is not located in a flood plain, geologic hazard, and Weld County Airport Overlay District area; or that the application complies with Section Fifty (50), Overlay District Regulations as outlined in the Weld County Zoning Ordinance. The Applicants' Property is not located in a flood plain, geologic hazard or Weld County Airport Overlay District. h. Proof that a water supply will be available which is adequate in terms of quantity, quality, and dependability (e.g., a well permit or letter from a water district). See attached letter from John W. Zadel, General Manager, Central Weld Water District, indicating that water service will be available to the subject Property. A copy of the deed or legal instrument identifying the applicant(s) interest in the property under consideration. If an authorized agent signs the application for the fee owner(s), a letter granting power of attorney to the agent from the property owner(s) shall be provided.
