GODBY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 19th day of August, 1992, a public hearing was held in the Chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of considering whether to transfer Amended USR #100 from L.E.A.D. , Inc. , to C. Don and Helen L. "Commissioner Kirby revi-ewed and commented on the Standards of approval. Commissioner Johnson commented on Standard 3L113789 August 7, 1992 Page 3 #16, which was suggested by Mr. Lind, saying that this Standard will limit the Use by Special Review's ability to be conveyed, transferred, or sold without prior approval of the Board of County Commissioners. Discussion followed concerning the intent of this Standard, and Chairman Lacy said if the facility is sold, a new USR need not be applied for, but the Board must approve the buyer's capability to run the facility. Mr. Morrison said, if in fact this is the intent of the Standard, it will have to explain the new operator's role. . . . . " (underlining supplied) Mr. and Mrs. Godby are now currently and have been residents of the State of Colorado since 19_66 and have resided in Weld County, Colorado for many years. Mr. Godby is 57 years of age (date of birth February 4 , 1935) and Mrs. Godby is 56 years of age (date of birth April 15, 1936) . They were married on September 1, 1956 at Lexington, Kentucky and have two children, both of whom are adults. Mr. Dodby is a graduate of the University of Kentucky in 1957 with a Bachelor of Science Degree in General Agriculture and a Minor in Animal Husbandry. Mrs. Godby is also a graduate of the University of Kentucky, having graduated in 1958 with a Bachelor of Science Degree in Home Economics. Following graduation, Mr. _Godby was employed from 1958 to 1966 by Rath Packing Company at Waterloo, Iowa as a lamb buyer and as a feedlot manager. From 1966 to 1976 Mr. Godby was employed by Wilson & Company (meat packers) at Denver, Colorado as a lamb buyer and eventually as the plant manager of the lamb slaughtering facilities of Wilson & Company in Denver, Colorado. During the period of 1976 to 19_90 1Kr. Godby was employed on his own behalf in various lamb packing operations and lamb feeding operations. During this time frame, Mr. Godby was involved as the chief corporate officer and owner of Texas Lamb Company, Inc. , d/b/a Colorado Lamb Co. with operations in both San Angelo, Texas and Denver, Colorado. In addition, he was also involved in lamb feeding operations and lamb slaughtering operations on behalf of Hi-Country Lamb Co. and with lamb feeding operations on behalf of Godby Sheep Co. , a Colorado corporation. -From 1990 to 920 8) August 7, 1992 Page 4 the present time in 1992, Mr. Godby has been employed by Monfort, Inc. here in Greeley, Colorado as the Vice President of their lamb operations. In addition, Mr. Godby engages independently of his employment with Monfort, Inc. in various lamb feeding operations as well. Mr. Godby is a member of the T-Bone Club here in Greeley and has been a member of the Board of Directors of the National Lamb Feeders Association for approximately 8 years of time. In 1987 Mr. Godby commenced his involvement in greyhound dog racing operations, and became involved with Mr. Cal Holland, whose family has been in the greyhound racing business for over 40 years. Initially, Mr. Godby was involved with Mr. Cal Holland as a partner in connection with a greyhound racing kennel. Since 1987 Mr. Godby has expanded his greyhound operations to the extent that he is now a breeder and buyer and seller of greyhounds through the National Greyhound Association and leases his dogs to Mr. Cal Holland. Mr. Holland, who currently resides in Thornton, Colorado, has been active in the greyhound racing business for a period of over 20 years. Mr. Godby has been a member of the National Greyhound Association since 1987 and during the year period of 1989-199D he was a member of the Board of Directors of the National Greyhound Association. As you are thus able to readily discern from the information submitted herewith, both by way of education and by way of job experience and by way of training and employment, Mr. Godby is well qualified in terms of animal husbandry background in his capabilities of dealing with livestock and with greyhounds. Mr. Godby has, as indicated, considerable knowledge, experience and training with reference to animal husbandry and the care, feeding, management and training of greyhounds and has excellent credentials in terms of his ability to perform in compliance with the Development Standards pertaining to Amended USR-10D. A public hearing was conducted on November 4, 1987, at 2:00 P.M., with the following present: Commissioner Gordon E. Lacy, Chairman Commissioner C.W. Kirby, Pro—Tem Commissioner Gene Branener Commissioner Jacqueline Johnson Commissioner Prank Yamaguchi Also present: Acting Clerks to the Board, Mary Reiff and Tommie Antuna Assistant County Attorney, Lee D. Morrison Planning Department representative, Brian Dingle The following business was transacted: I hereby certify that pursuant to a notice dated October 14, 1987, and duly published October 22, 1987, in the Johnstown Breeze, a public hearing was conducted to consider the request of L.E.A.D., Inc. to amend a Special Review permit to expand an existing dog kennel from 30 dogs to 200 dogs. Lee Morrison, Assistant County Attorney, made this matter of record. Brian Single, Planning Department representative, read the favorable recommendation of the Planning Commission, which is based upon two Conditions and ten Development Standards, dnto the record. John Birleffi came forward to represent the applicant. He stated that L.E.A.D., Inc. owns a successful operation in Lorimer County, and he explained this proposed operation. He said this cannot be an economically successful operation unless a larger number of greyhounds is allowed. Others who spoke for the applicant were Earl Anderson and Robert Anderson, both nearby neighbors; and Herb "Dutch" Koerner, Vice-President of the National Greyhound Association and owner of the property. Public comment against this proposal was offered by Kenneth Lind, Attorney, who introduced Phil Stewart, president of Natural Resource Development Association, who spoke concerning his inspection of the premises this morning (Tape Change 7187-113) ; Evelyn Schmidt-Schwisow; Mike Armstrong; and Doug Kershaw. Mr. Lind presented Exhibits K M. Also speaking in opposition to the request was Zane Pic, Attorney representing Doris Anderson, who introduced Ray Larson, realtor and appraiser. (Let the record reflect that a twenty-minute recess was held at this time.) Upon reconvening, Mr. Pic presented Doris Anderson, who lives within 600 feet of the site. Mr. Pic also requested that, if this proposal is approved, the following changes he made to the Development Standards proposed by the staff and the additional Standards presented by Mr. Lind as Exhibit "M": that "and puppies" be added after "dogs" in #I; that #4 be amended by adding "and runs" after "kennel areas" and requiring that waste he removed from the property on a daily basis; and that "the Humane Society" be added after "Weld County Health Department" in #8. Mr. Birleffi came forward to make rebuttal statements. He said that the request is for a total of 200 dogs, including those under six months of age. Mr. Birleffi also stated that the waste is picked up daily, and he commented that the worming and vaccinating of the animals begins at an early age. Mr. Koerner also made comments and answered questions of the Board. Mr. Birleffi and Mr. Kaerner made comments concerning the additional. conditions as recommended by Mr. Lind. She said she would also suggest that an on-site inspection be conducted by the Board. Commissioner Brantner stated that he is concerned about the training which will be conducted on Sundays on this property. Mr. Birleffi said no training will he conducted on Sundays at this site. Commissioner Kirby reviewed and commented on the Standards of Approval. Commissioner Johnson commented on Standard 016, which wan suggested by Mr. Lind, saying that this Standard will limit the Use by Special Review's ability to be conveyed, transferred, or sold without prior approval of the Board of County Commissioners. Lee Morrison, Assistant County Attorney, made this matter of record, stating that this hearing was continued from November 4, 1987, to allow the applicant to provide more evidence, and he reviewed the items which were to he submitted, Brian Bingle, representing the Planning Department, said the required information was submitted to the Planning staff and forwarded to the Board. Mr. Bangle also presented the Board with a proposed Development Standard regarding transfer of the Special Review. Bob Ray, Attorney representing the applicant, said this proposed Development Standard was agreeable to the applicant. John Birleffi came forward to explain the proposed wooden fence. Mr. Birleffi also said the number of dogs could be reduced to 150 if pups under six months of age are not to be counted. The Board had considerable discussion regarding the method to be used when counting the dogs on the property and the number to he allowed. When the hearing was opened to public comment Ken Lind, Attorney representing the neighbors, and Zane Pic, Attorney for Doris Anderson, made comments concerning the number of doge to be allowed and the proposed fencing. After further discussion concerning these matters, a recess was called to allow certain details to be resolved. Upon reconvening, Mr. Bingle read into the record a proposed Development Standard regarding the number of dogs to be allowed in various areas of the property. This Development Standard provides that the site shall never exceed a total of 200 dogs, including puppies. (Tape Change 1187-118) Chuck Cunliffe, Director of Planning Services, suggested that a Condition he added -requiring that the Special Review plat be amended to show the desired fencing. It was recommended that a new Development Standard providing that the dogs inside the kennel building shall not be turned out between 10:00 P.M. and 6:00 A.M. he added, along with the Development Standard introduced earlier concerning transfer of the Special Review permit. Commissioner Johnson stated that "and runs" should be added after "kennel areas" in Development Standard #4. Commissioner Johnson moved to approve this request for an amended Special Review permit, subject to the Conditions and Development Standards as amended. The motion was seconded by Commissioner Yamaguchi. Commissioner Kirby commented that he felt the problem areas have been mitigated and he will vote for the motion.
