RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1541 - GRANER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1541, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1541 was submitted by Jesse B. and Mary Jane Graner for property which is located in part of the Si NE! and part of the Ni SE! of Section 23, Township 2 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 50 acres and 33 acres. Morrison, Assistant Weld County Attorney COLORADO From RE-1541 Subject: I spoke with Burl Van Buskirk on September 29, 1993 and advised him that in my opinion the deed for the canal which fills Sand Lake Reservoir creates an interest which is not a mere easement. Although the document uses the term easement, it is described also as a "perpetual" easement and on the second page there is a grant of all reversionary interests to the holder of the way for the ditch. The result is that it appears to convey much more than an easement and in fact appears to convey fee title. The legal descriptions for the whole property in fact exclude the ditch descriptions . After I explained this to Mr. Van Buskirk he grudgingly accepted that interpretation and then asked if there was some way to simply tie that piece, one acre of one acre to the 79 acres which he had hoped to leave out of the recorded exemption. It appears the real problem with cutting that one acre off is the possible conflict with the contiguous ownership rule. This subdivision is partially occupied and presently the only subdivision located adjacent to the site. Staff has expressed concerns regarding this application. Recorded Exemption 816, dated December 18, 1985, was denied by the Board of County Commissioners due to inconsistency with the intent of the Agricultural zone district and an inability to demonstrate efficient and orderly development.
