Morrison, Assistant Weld County Attorney COLORADO From RE-1541 Subject: I spoke with Burl Van Buskirk on September 29, 1993 and advised him that in my opinion the deed for the canal which fills Sand Lake Reservoir creates an interest which is not a mere easement. Although the document uses the term easement, it is described also as a "perpetual" easement and on the second page there is a grant of all reversionary interests to the holder of the way for the ditch. The result is that it appears to convey much more than an easement and in fact appears to convey fee title. The legal descriptions for the whole property in fact exclude the ditch descriptions . After I explained this to Mr. Van Buskirk he grudgingly accepted that interpretation and then asked if there was some way to simply tie that piece, one acre of one acre to the 79 acres which he had hoped to leave out of the recorded exemption. It appears the real problem with cutting that one acre off is the possible conflict with the contiguous ownership rule. If the western portion of the property is excluded as one separate noncontiguous lot, his clients would have to have at least a 160 acres of which 80 would not be part of the recorded exemption. Mr. Van Buskirk showed me his plat and it is questionable whether, absent that one acre, there is 160 acres available. If it is available, then they could move the lot line down a few feet, add another acre to the most northerly lot which is excluded from the recorded exemption and then create two additional lots within the recorded exemption which would equal BO acres combined. ee'. Dear Commissioners: Jesse B. and Marry Jane Graner have requested a recorded exemption to occur on part of the S2 NE4 and part of the N2 SE4 of Section 23, T2N, R67W of the 6th P.M. , Weld County, Colorado. The 83 acre parcel is located within the Urban Growth Boundary of Ft. Lupton on Weld County Road 23. The request is to divide the parcel which is not the total contiguous land holding of the applicant into 50 acres, more or less and 33 acres, more or less. The site is currently undeveloped with the exception of an oil well located in the middle of the parcel. The site contains natural vegetation and supports several large trees . Currently one water well exists on the proposed 33 acre parcel and an application for an additional well has been applied for the remaining acres,. Individual septic systems are proposed for both lots. The Department of Planning Services' staff has concerns for this request based on the level of development and the potential conflict with the Comprehensive Plan. Three Recorded Exemptions RE-121 (May, 1972) , RE-563 (May, 1982) , and RE- 584 (Jan, 1983) , have occurred west of the site. Additionally, the eastern most portion of the site faces Lupton Meadows, an agricultural residential subdivision platted in the early 1900's. This subdivision is partially occupied and presently the only subdivision located adjacent to the site. Staff has expressed concerns regarding this application. It is questionable as to whether the applicant complies with Recorded Exemption Standards 11.8 .7 as stated in the Weld County Subdivision Ordinance. 931066 Board of County Commissioners , RE-1541 September 20, 1993 Page 2 "In the A (Agricultural) zone district when a contiguous ownership equals at least twice the minimum lot size, a portion of the lot equal to the minimum lot size (80 acres) may be used. " As applied in this situation, the property owners have a contiguous land ownership of 160 acres, 80 acres should be included in the recorded exemption, with a remaining 80 acre parcel to the north of the proposed recorded exemption (11.8.7 Weld County Subdivision Ordinance) . The applicant has failed to demonstrate that this proposal is consistent with the intent of the A (Agricultural) zone district, nor does it comply with efficient and orderly development. Recorded Exemption 816, dated December 18, 1985, was denied by the Board of County Commissioners due to inconsistency with the intent of the Agricultural zone district and an inability to demonstrate efficient and orderly development. Approval of this request will result in the creation of three additional lots, one of which may not be eligible for a building permit due to size (79 acres) . The nature of continued expansion and the diminishment of Agricultural land coupled with a lack of compliance with the Weld County Comprehensive Plan leads staff to have concerns regarding the application of a recorded exemption on this parcel. Dear Commissioners: Jesse B. and Mary Jane Graner have requested a recorded exemption to occur on part of the S2 NE4 and part of the N2 SE4 of Section 23, T2N, R67W of the 6th P.M. , Weld County, Colorado. The 83 acre parcel is located within the Urban Growth Boundary of Ft. Lupton on Weld County Road 23. The request is to divide the parcel which is not the total contiguous land holding of the applicant into 50 acres, more or less and 33 acres , more or less. The site is currently undeveloped with the exception of an oil well located in the middle of the parcel. The site contains natural vegetation and supports several large trees. Currently one water well exists on the proposed 33 acre parcel and an application for an additional well has been applied for the remaining acres. Individual septic systems are proposed for both lots. Staff recommends denial based on the level of development and the potential for continued division occurring in the area. Three Recorded Exemptions RE-121 (May, 1972) , RE-563 (May, 1982) , and RE-584 (Jan, 1983) , have occurred west of the site. Additionally, the eastern most portion of the site faces Lupton Meadows, an agricultural residential subdivision platted in the early 1900' s. The Platte Valley Irrigation Company Ditch creates a natural split within the east-half of Section 23 creating two parcels. The remaining acres in the east-half of Section 23 are owned by the Platte Valley Ditch Company. Approval will result in the creation of three additional lots, one of which would not be eligible for a building permit due to size (79 acres) . Recorded Exemption 816, dated December 18, 1985, was denied by the Board of County Commissioners due to inconsistency with the intent of the Agricultural zone district and an inability to demonstrate efficient and orderly development.
