RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1053 FOR SEED PRODUCTION, PROCESSING, AND STORAGE IN THE A (AGRICULTURAL) ZONE DISTRICT - ICI SEEDS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 31st day of August, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of ICI Seeds, 6945 Vista Drive, West Des Moines, Iowa 50265, for a Site Specific Development Plan and Special Review Permit #1053 for seed production, processing, and storage in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the NI of Section 12, Township 4 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Ray Rette, ICI Seeds, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Agricultural Goals and Policies because productive farmground will be utilized to help determine better seed varieties for farming in this region. This proposed land use is provided for as a Use by Special Review in the Weld County Zoning Ordinance. This proposal is also consistent with the Urban Growth Boundary Goals and Policies. 940813 PL0969 8_6 / 7-2 NG /e/ SPECIAL REVIEW PERMIT #1053 - ICI SEEDS PAGE 2 b. The uses which would be permitted will be compatible with the existing surrounding land uses which include irrigated crops, oil and gas production, rural residences, a feedlot, and U.S. Highway 85. The uses which would be permitted will be compatible with the future development of the surrounding area as permitted by the Agricultural Zone District. c. No overlay districts affect the site. d. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of ICI Seeds for a Site Specific Development Plan and Special Review Permit #1053 for seed production, processing, and storage in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the plat: a. The applicants shall submit an Air Pollution Emission Notice (A.P.E.N. ) and Emissions Permit application to the Air Pollution Control Division, Colorado Department of Health, for emissions of criteria, hazardous or odorous air pollutants. If the Colorado Department of Health determines an A.P.E.N. application is not required, the applicant shall submit information which indicates this. b. The existing septic system which is not currently permitted through the Weld County Health Department shall have an I.S.D.S. evaluation prior to the issuance of the required septic permit. The Site Specific Development Plan and Special Review Permit is for seed production, processing, and storage in the A (Agricultural) Zone District as submitted in the application materials on file and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. 5. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 6. Fugitive dust shall be controlled on this site. 7. All pesticides, fertilizer, and other potentially hazardous chemicals shall be stored, handled, and applied in a safe manner. (Reference 25-8-205.5 Colorado Water Quality Control Act and Rules and Regulations thereof. ) 8. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 9. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 10. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 11. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 940813 DEVELOPMENT STANDARDS - ICI SEEDS PAGE 2 12. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 13. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Lee Morrison, Assistant County Attorney, made this a matter of record. Keith Schuett, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. (Let the record reflect that Commissioner Hall is now present. ) Ray Rette represented the applicant and explained the facility is actually a research station with no intention of retail. He said the site is basically just a farm and the existing farmhouse will be remodeled for offices and research purposes. Mr. Rette confirmed for Commissioner Kirkmeyer that all Conditions of Approval and Development Standards are acceptable. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve the request of ICI Seeds for a Site Specific Development Plan and Special Review Permit for seed production, processing, and storage in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Harbert, and it carried unanimously. This Certification was approved on the 7th day of September, 1994. Site impact data which was provided in the submittal does not address the direction to/from which vehicle trips are anticipated to access SH 85; however, the volume of traffic generated by this development is low enough that it is doubtful that highway improvements will be necessary. Dear Mr. Robley: I spoke with you briefly last week concerning the application materials which were submitted by ICI Seeds. This correspondence requests clarification of several items which are part of the application. Until the enclosed items are addressed, the application will be considered incomplete. We will be unable to process the application until the following items are addressed. The numbers in this letter correspond to the numbers in the submitted application. I have enclosed a copy of the application for your reference. 1. The proposed use is identified as a "seed testing farm". What does this mean, where and how will they be tested? Will there be any sales associated with the site? 5. Who will use the seed? Will anyone visit the site? How will the seed be obtained? 6.A. During winter operations, what will the number of shifts and hours of operation be? B. During summer operations, what will the hours of operation be? 7. Please provide a letter from the Central Weld County Water District which indicates they can serve the site with water. 9. Besides the UPS delivery trucks, what type of vehicular traffic would be expected to and from the site? 13. Will any seeds be stored on-site? What will be located in the sheds? 14. Section 24.5. 1.5. 1 of the Weld County Zoning Ordinance indicates, "Storm water retention facilities shall be provided on-site which are designed to retain the storm water runoff from the fully developed site from a 100 year storm." What is the landscaping plan and erosion control measures which are currently existing? 19. Explain why the proposal is consistent with the Weld County Comprehensive Plan. 20. THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Department of Planning Services' staff that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: - This proposal is consistent with the Weld County Comprehensive Plan's Agricultural Goals and Policies because productive farmground will be utilized to help determine better seed varieties for farming in this region. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the plat: A. The applicants shall submit an Air Pollution Emission Notice (A.P.E.N. ) and Emissions Permit application to the Air Pollution Control Division, Colorado Department of Health for emissions of criteria, hazardous or odorous air pollutants. If the Colorado Department of Health determines an A.P.E.N. application is not required, the applicant shall submit information which indicates this. B. The existing septic system which is not currently permitted through the Weld County Health Department shall have an I.S.D.S. Evaluation prior to the issuance of the required septic permit. In the event the system is found to be inadequate, the system shall be brought into compliance with current I.S.D.S. regulations. 940813 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS ICI Seeds USA-1053 1. The Site Specific Development Plan and Special Review permit is for seed production, processing and storage in the A (Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. No permanent disposal of wastes shall be permitted at this site. 5. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 6. Fugitive dust shall be controlled on this site. 7. All pesticides, fertilizer, and other potentially hazardous chemicals shall be stored, handled, and applied in a safe manner. (Reference 25-8- 205.5 Colorado Water Quality Control Act and Rules and Regulations thereof. ) 8. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 9. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 10. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 11. Dear Greg: In response to your letter of May 16, 1994 requesting clarification of several items on our application for the referenced subject, we submit the following: 1. The remit of ICI Seeds' Colorado Research Center is to breed and test new hybrid varieties of corn. At the station, parent lines are crossed to produce hybrid seed and this seed is used to evaluate the potential of the new variety. Hybrids are evaluated by planting them at a number of sites(for example at the LaSalle farm, at the site at Johnstown, CO and the site at Wiggins, CO), and measuring traits such as yield and lodging. The field husbandry techniques used in these trials are identical to those used by local farmers, with the only exception being a research trial will have many different hybrids in a field rather than only one hybrid (which a farmer would plant). Quantities of seed produced at the Research Center for each new hybrid are very small, not more than 10 pounds,which is used strictly for evaluating the hybrid. When a new hybrid is identified that would be of commercial potential, production of quantities of seed required for pre-commercial and commercial status are produced at ICI Seeds production facilities in Iowa. There are no sales associated with the Research Farm. An annual field day is held at the farm, where customers come to see and hear about new hybrid varieties from the research department. 5. The seed produced is used strictly for research evaluation. As mentioned above in #1, no more than 10 pounds of seed of a given variety are produced at a Research Center. 940813 Mr. Greg Thompson Page 2 June 20, 1994 6A. During winter operations there will be one shift, consisting of four full-time people and two or three part-time people. 6B. During summer operations there also will only be one shift, here consisting of the four full- time people and 15 part-time summer crew members. 7. See attached letter from Central Weld County Water District. 9. Vehicular traffic is expected to and from the site will consist of staff members personal vehicles (daily), and UPS and Center's pickup and gooseneck trailer (an average of once a week). 13. Small quantities of seed (samples 10 pounds and less) will be stored in the cold room on the site. Sheds will contain farm equipment (tractor, planter, combine, etc. typical to area farmers) for managing the crop, and the Center's van, pickup and gooseneck trailer. 14. We do not propose to provide storm water retention. It would be nearly impossible to provide retention for a 100 year event for the entire farm. The proposed building addition to the existing farm house will cause a very slight increase in the rate of storm water runoff when considering the total surface area of the 90 acre farm. 16. The building site has lawn areas and trees as shown on the attached plot plan. Erosion control measures including silt fence etc. would be utilized during construction of the building addition to insure no damage to the crop land surrounding the building site. 19. ICI Seeds' Colorado Research Center has been established to breed and test new hybrid varieties of corn in order to improve and promote agriculture in Weld County. Agriculture is an important part of Weld County, and is a part of the Weld County Comprehensive Plan. 20. The activities carried out at the ICI Seeds' Colorado Research Center are normal farming practices that are consistent with the Agriculture zone district. See also responses to items 1, 21, and 27. 21. Field husbandry techniques at the Research Center will be no different than on area farms, the only difference being the number of varieties in a given field. In fact, the intention of the station is to evaluate hybrids in conditions as similar as possible to those used by area farmers. Grain produced on the farm is sold locally through normal channels. 22. Fertilizers and Pesticides used at the Research Center are the same as those used by local farmers and are purchased locally from Agricultural Suppliers.
