'Mvv ammo.10.11 g4074( RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #1626 - SEWALD WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1626, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1626 was submitted by Francis J. Sewald, 104 North Blueridge Court, Fort Collins, Colorado, 80524, for property which is located in part of the Ni NW'y of Section 8, Township 7 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 73.56 acres and 5 acres. Dear Commissioners: This request for a recorded exemption is submitted by Francis Sewald. The parcel of land on which this request is being made is described as part of the N2 NW4 of Section 8, T7N, R67W of the 6th P.M. , Weld County, Colorado. The property is located south of and adjacent to Weld County Road 84 and east of and adjacent to Weld County Road 15. This request is to divide a 78.56 acre parcel into two parcels of 73.56 acres, and 5 acres, more or less. There is a shack and outhouse on proposed Lot A and proposed Lot B is currently in alfalfa and corn. The applicant indicated within the application materials that he plans to sell proposed Lot A as a new residential building site and retain proposed Lot B to build a new residence for himself. Access to proposed Lot A is existing from Weld County Road 15 and an existing farm access to proposed Lot B is existing from Weld County Road 84. North Weld County Water District is the proposed water service along with septic systems proposed for sewage disposal on both Lot A and Lot B. The Weld County Health Department and Public Works Department have reviewed this request and both recommend conditional approval. The Department of Planning Services' staff has concerns that the proposed division is inconsistent with efficient and orderly development and the agricultural goals and policies as stated in the Weld County Comprehensive Plan. There have been five recorded exemptions approved within a 3/4 mile radius of the 78.56 acre parcel. The 78.56 acre parcel is predominantly identified as prime farm ground of National Importance by the Department of Agriculture Soil Conservation Service and Colorado State University Test Station. This request, if approved, would allow for a residence on both Lot A and Lot B, greatly intensifying the residential uses on the property thus reducing the area of prime agricultural farm ground. Explain the reason for the proposed recorded exemption and how each proposed lot will be used. I would like to sell five acres for the purpose of building a new home. The five acres will be used for small agriculture along with the remaining 73 acres. 2. Describe the location, size and present use of the area where each proposed new lot will be created. The proposed exemption is on the southwest corner of "The North of Northwest 1/4, Section 8, Township 7 North, Range 67 West of the 6th P.M."; which is south of an A T & T Tower. The present use is for alfalfa. The larger parcel is in corn. 3. Explain how the proposal is consistent with the Weld County Comprehensive Plan and any adopted municipal plan, if applicable. The proposed land will still be used for agriculture other than a plot for a home construction. These five acres are the hardest to irrigate due to the terrain and an existing shack on this corner. I plan to have the shack removed which will greatly enhance the landscape. 4. Explain how the uses permitted will be compatible with existing uses surrounding the proposed recorded exemption. All land will be left for agriculture. Presently in hay; after building new home, the remaining land will be planted with trees and used for small agriculture use. 5. Explain how the proposal is consistent with the intent of the zoning district it is located within. Zoned agriculture. Both five acres and the larger parcel will be left as agriculture; with the addition of trees and other landscaping. 6. Explain how the proposal is consistent with efficient and orderly development. Area has an existing access which will not be changed and the corner will be cleaned up with removal of existing shack and outhouse. 7. Explain how adequate provision for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and the County will be accomplished. Area inhabitants will be helped by the removal of the un-sightly shack and outhouse.
