RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 441 - WINDSOR GAS PROCESSING, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has reviewed the request of
Windsor Gas Processing, Inc. , for an exemption from the definitions of
"subdivision" and "subdivided land" in Section 30-28-101(10) (d), CRS, as amended,
and Section 2-1 A. (3) of the Weld County Subdivision Regulations, and
WHEREAS, this Subdivision Exemption request from Windsor Gas Processing,
Inc. , is to remove a 0.285 compressor site from an area permitted by Amended USR
#581, and
WHEREAS, said land is located in part of the SE* of Section 11, Township
6 North, Range 67 West of the 6th P.M. , Weld County, Colorado.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the above described parcels be, and hereby are, declared
to be exempt from the definitions of "subdivision" and "subdivided land" as set
forth in Section 30-28-101(10) , CRS, as amended, and Section 2-1 A. (3) of the
Weld County Subdivision Regulations.
BE IT FURTHER RESOLVED by the Board that this approval is subject to the
following conditions:
1. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be drawn in accordance with the
requirements of Section 9-3C. (4) of the Weld County Subdivision
Regulations. The plat shall be submitted within sixty (60) days
from the date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.
2. A thirty (30) foot access easement shall be designated on the
Subdivision Exemption plat for access to the 0.285 acre new site.

Subject: Subdivision Exemption 441
Dear Commissioners:
This request for a subdivision exemption is submitted by Windsor Gas Processing, Inc.
The parcel of land on which this request is being made is described as part of the SE4
of Section 11, T6N, R67W of the 6th P.M. , Weld County, Colorado. The property is
located west of Weld County Road 23, and north of Weld County Road 70.
Amended USR-581 was approved by the Board of County Commissioners on January 29, 1992.
The USR permitted a single family dwelling unit on a lot under the minimum lot size,
a meter house, and a booster compressor. The application amended an old USR which
permitted natural gas facilities. This subdivision exemption application is to remove
the compressor site from the area permitted by the Special Review permit. The
Department of Planning Services' staff has determined that the removal of this 0.285
acre site is not a major change to the Special Review permit.
Section 2-1 A. (3) of the Weld County Subdivision Regulations allows the Board
of County Commissioners to exempt from the definition of the terms "subdivision" and
"subdivided land" , any division of land if the Board determines that such division of
land is not within the purposes of the subdivision regulations.
The Department of Planning Services' staff recommends the Board of County Commissioners
approve this request and determine that this division of land is not within the
purposes of the Weld County Subdivision Regulations. The staff' s recommendation for
approval is conditional upon the applicant submitting a mylar plat to the Department
of Planning Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the requirements of Section
9-3 C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted
within sixty (60) days from the date of approval by the Board of County Commissioners.
The applicant shall be responsible for paying the recording fees. The staff' s
recommendation is also conditional upon a thirty (30) foot access easement being
designated on the Subdivision Exemption plat for access to the 0.285 new site.

Re: Application for Subdivision Exemption
Dear Lanell:
Thank you for your help in submitting this Application for Subdivision Exemption.
As we have discussed, the reason for requesting the Exemption is to separate the proposed
compressor site from that portion of the 10 + acres on which we had our gas plant. By doing so,
Windsor can sell the balance of the tract without the purchaser of the balance being liable for
taxes which may accrue to Windsor's activities in placing a compressor on the retained site. In
a like manner, Windsor will also not be responsible for any increase in taxes due to the
activities of the new owner of the residential tract. We have surveyed the site and have attached
to the Application a plot plan showing the tract we desire to subdivide for the compressor site.
It is our understanding that a similar parcel of land was subdivided under like circumstances in
Case Number USR 581. We respectfully request the same consideration.
Enclosed with this letter is a completed application form, a copy of the deed vesting interest in
the property to Windsor Gas Processing, Inc. and a plot plan and legal description of the parcel
involved in this Application.
Please feel free to contact me if there is any additional information required. At this time, we
have a contract to sell the residential portion of the 10+ acres and are requesting that this
matter be submitted to the County Commissioners at your earliest convenience. Again, we wish
