RESOLUTION RE: GRANT CHANGE OF ZONE FROM A (AGRICULTURAL) TO E (ESTATE) - TRI-CITY VENTURES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 14th day of September, 1994, at 10:00 a.m. for the purpose of hearing the application of Tri-City Ventures, 6538 East U.S. Highway 34, Loveland, Colorado 80537, requesting a Change of Zone from A (Agricultural) to E (Estate) for a parcel of land located on the following described real estate, to-wit: Part of the NW! of Section 8, Township 5 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, the applicant was represented by Art Uhrich, Nelson Engineers, and Jeffrey Perryman, Tri-City Ventures, and WHEREAS, Section 21.6.2 of the Weld County Zoning Ordinance provides standards for review of such a Change of Zone, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, studied the request of the applicant and the recommendation of the Weld County Planning Commission and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The applicant has complied with all the application requirements listed in Section 21. 7 et seq. , of the Weld County Zoning Ordinance. 2. The request is in conformance with Section 21.6 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan Agricultural, Residential, and Urban Growth Boundary goals and policies. The goals and policies allow for the conversion of non-prime agricultural land to residential use within an urban growth boundary in accordance with the plans of affected municipalities. The Town of Windsor reviewed the request and found no conflicts with its interests. The City of Greeley Planning Commission reviewed the request and recommended approval. The uses which would be allowed on the subject property by granting the Change of Zone will be compatible with the surrounding land uses which include: irrigated crops, oil and gas production, rural residences, pasture, and a natural drainageway. c. Public water is available from the Little Thompson Water District, and the applicants have proposed utilizing septic systems. d. Access to the site is from Weld County Road 60, which is a gravel, local road at this location. e. The proposed rezoning property does not contain a commercial mineral deposit according to maps and information available to the Department of Planning Services' staff. f. No overlay districts affect the site. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Tri-City Ventures requesting a Change of Zone from A (Agricultural) to E (Estate) on the above referenced parcel of land be, and hereby is, granted subject to the following conditions: 1. The rezoning plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. Prior to recording the plat, the following notes shall be placed on the Change of Zone plat: a. Water service shall be provided by Little Thompson Water District in quantities adequate for the proposed uses and fire protection. All requirements outlined in the district water letter dated January 7, 1994, shall be met. b. Sewage disposal shall be provided by individual sewage disposal systems. c. The maximum number of lots associated with this Change of Zone shall be six, in accordance with the application materials. d. Access to the site shall be from Weld County Road 60. e. A preliminary study of soils and geologic conditions at the site, including percolation data, depth to groundwater, soil profile, and a demonstration that the sites can meet ground slope requirements from separate sites in this proposed development shall be submitted with the minor subdivision sketch plan. g. A fire hydrant, water main, and fire flow tests shall be in accordance with Windsor Fire Protection District requirements. h. The site shall be examined for wetlands pursuant to Section 404 of the Clean Water Act. Any wetland shall be delineated and mapped. The Army Corps of Engineers shall be contacted for proper permits prior to any work in any existing wetlands. i. The applicants shall demonstrate soils with moderate limitations can be overcome for local roads, dwellings with basements, and dwellings without basements. j . The applicants shall apply for a High Density Area designation from the Colorado Oil and Gas Conservation Commission. 2. Fifty feet from the centerline of Weld County Road 60 shall be reserved on the plat for future arterial use. H. Webster, Chairman Commissioner Dale K. Hall, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated August 17, 1994, and duly published August 25, 1994, in the Windsor Beacon, a public hearing was conducted to consider the request of Tri-City Ventures for a Change of Zone from A (Agricultural) to E (Estate) . Lee Morrison, Assistant County Attorney, made this a matter of record. Keith Schuett, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record as written. Art Uhrich, Nelson Engineers, represented the applicant and stated the proposal is on 20 acres and will contain six 3.3-acre tracts, with access on Weld County Road 60. He stated two accesses will be necessary, with one each on the east and west sides of the creek and wetlands area, and that a wetlands survey report is available. In response to questions from the Board, Mr. Uhrich confirmed six homes are proposed, and the access on Road 60 goes east to Weld County Road 17 and west to Weld County Road 15. He explained a culvert was recently washed out; therefore, the County replaced it and relocated the road somewhat, and the owners did some grading. He confirmed the wetlands are below the culvert and will remain. (Changed to Tape #94-37. ) Mr. Uhrich stated the land is rolling, with the creek being about ten feet lower than the rest of the area; therefore, natural drainage is toward the creek. He noted the majority of the land is nonproductive farmland. Mr. Schuett stated, pursuant to the application, there are six acres in wheat with a crop every two years; however, there are no crops on the other 14 acres due to the slopes. In response to further questions from the Board, Mr. Schuett stated Road 60 is considered a County local with minimal traffic and confirmed that Windsong Subdivision's traffic accesses Road 17, aka Windsor/Johnstown Road, which is paved. He explained a sketch plan and a final plan are required for the proposed minor subdivision, in which the water, sewer, and access are reviewed in detail. It was determined there are approximately 15 homes proposed in Windsong, which was approved prior to the minor subdivision regulations. Mr. Schuett confirmed the Town of Windsor had no concerns, and he referenced Exhibit 20. He noted there are two existing farm accesses to the site; however, there are no residential accesses, and only one is allowed by right. He reiterated the applicant has proposed two accesses on the plat. Mr. Schuett referred to Section 4.5. 16. ].1 of the Subdivision Ordinance which states a minor subdivision may access from only one access point; therefore, should the applicant proceed, he would need to show physical conditions for a variance to allow two accesses. He confirmed that each lot will be about three acres, and the adjacent land is agricultural. Commissioner Harbert requested Mrs. Hartshorn's concerns about drainage in the area be addressed. Mr. Uhrich stated the Little Thompson water line will be extended down Road 60. Commissioner Harbert noted that Mrs. Hartshorn indicated her basement fills with water every year and that Road 60 has been closed due to water. Jeffrey Perryman, owner and managing partner of Tri-City Ventures, stated Mrs. Hartshorn's property is at an elevation that such flooding could occur. He explained the water flow and natural drain of the area and stated the water flows north from the 45-foot elevation, with the homes to be at an 80- to 85- foot elevation. Mr. Perryman confirmed for Commissioner Harbert the development should not affect Mrs. Hartshorn and stated the dam will be fixed, with a detention pond at the 55-foot level. He further explained the drainage pattern and reiterated all drainage is to the north. He 940870 PLo97/ c Pt RE: HEARING CERTIFICATION - TRI-CITY VENTURES PAGE 2 addressed the two accesses on Road 60 and reiterated it would be physically impossible with one access, explaining a concrete bridge would have to be constructed in the wetlands, which is not feasible. He noted a 10-foot culvert was installed and the road is now safer and wider. In response to a question from Commissioner Kirkmeyer concerning a letter from Garry Weinmeister, surrounding property owner, about "spot development", Mr. Schuett stated "spot development" is a literal interpretation; however, the proposal is within the Urban Growth Boundary of Windsor and Greeley. Mr. Morrison noted that "spot development" is not a term in the Comprehensive Plan; however, the concept of the term is included. Heidi Aas, surrounding property owner, stated she is against the development. She explained she has owned the property since 1987 and recently built a new home, from which the view to the west will be blocked by the proposed homes. She also stated concerns about increased traffic on Road 60, since she rides horses and walks with her daughter on that road. In response to questions from the Board, Ms. Aas stated she owns a 26-acre parcel, which is in pasture, and noted the dam has not been in operation for over a year. Mr. Uhrich confirmed he had no problems with the Conditions of Approval. Commissioner Hall reiterated that Condition of Approval lile does not allow any new accesses. Mr. Schuett clarified there are two existing accesses; however, neither are residential. Mr. Uhrich stated one access is on the east side of the wetlands, and the one to the west is a farm access, as well as for a natural gas booster station. In response to a further question from Commissioner Hall in reference to compliance with Condition of Approval #le, Mr. Schuett clarified only one residential access is allowed. Mr. Morrison stated if the proposal is platted as a minor subdivision, only one access is allowed; therefore, the applicant could seek a variance if it is impossible to comply. He clarified, numberwise, there will not be a new access, and the provision does not preclude a variance. Mr. Schuett further clarified Condition of Approval #le. Commissioner Webster clarified there are two agricultural access which will be relocated, and it would be physically impossible to serve the subdivision with one access; therefore, the plot plan should show the necessary accesses. Commissioner Harbert reiterated the applicant would need to request a variance. Mr. Morrison suggested leaving Condition of Approval 41e, and Mr. Schuett suggested, as an alternative, removing it. Mr. Perryman explained that Vern Nelson, also of Nelson Engineers, had discussed this matter with the Engineering Department and Chuck Cunliffe, Planning Department Director, and there is due physical reason for a variance. He stated as long as Condition of Approval #le would not preclude the variance, it was acceptable. Commissioner Baxter moved to approve the request of Tri-City Ventures for a Change of Zone from A (Agricultural) to E (Estate) , based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. Judy Hartshorn, surrounding property owner, stated that there is a problem with water in this area, since her basement floods every year. Weld County Road 60 was closed when the water washed out the road this year. Mrs. Hartshorn asked the Planning Commission members to look closely at applications and to please save farmland. Water service shall be provided by Little Thompson Water District in quantities adequate for the proposed uses and fire protection. PROJECT OVERVIEW AND BACKGROUND: The request is to rezone a 20-acre site to allow a large-lot, rural residential subdivision with a proposed density of approximately one unit per three and one- third acre`s. The propetrty is located outside of the City's 1986 Comprehensive Plan )'tong-Range Expected Growth Area (LREGA) but within the three-mile area of influence of the City. Therefore, by virtue of Section 19-7 of the City Charter and the 1987 Weld County C mprehensive Plan policy of referring land-use proposals for review and comment to appropriate jurisdictions, the proposal is within the purview of the Greeley Comprehensive Plan. It is the practice of the City of Greeley Planning Commission to.review Weld County requests that are outside of the City's LREGA principally for conformance with the City's Comprehensive Plan policies. The proliferation of large-lot Weld County subdivisions will lead to densities which may be difficult to serve by special districts over a long period of tine. Further, the coordination and transaction between such areas may be difficult land result in service difficulties. Typically, the City of Greeley defers specific design review and land development standards outside urban areas to Weld County. The applicant should, however, dedicate 5p feet from the centerline of Weld County Road 60 for future arterial roadway use if this request is approved. ADMINISTRATIVE REVIEW TEAM COMMENTS: The Administrative Review Team had no comment on this proposal. The maximum number of lots associated with this change of zone shall be six, in accordance with the application materials. d. Access to the site shall be from Weld County Road 60. e. No new access shall be allowed to the site. f. A preliminary study of soils and geologic conditions at the site, including percolation data, depth to groundwater, soil profile, and a demonstration that the sites can meet ground slope requirements from separate sites in this proposed development shall be submitted with the minor subdivision sketch plan. B. A fire hydrant, water main and fire flow tests shall be in accordance with Windsor Fire Protection District requirements. h. The site shall be examined for wetlands pursuant to Section 404 of the Clean Water Act. Any wetland shall be delineated and mapped. The Army Corps of Engineers shall be contacted for proper permits prior to any work in an existing wetlands. i. Any actual construction of dwellings or roads must be preceded by extensive soil surveys and tests of the specific material which will result in development of exacting specifications for foundation and roadway designs. The Applicant, on the advice of his professional engineer, believes that he can develop a sound, feasible project using these soils. Should detailed testing reveal that such construction is positively infeasible, which is highly unlikely, the project plans would be altered accordingly. Generally, the soils are predicted to be adequate, with proper precautions and design for residential development since the soil loading for residents will be less than for industrial or commercial construction. The soil conditions in the area are generally acceptable for construction as evidenced by existing dwellings and other structures in the area. Roadway System Existing roadway is adequate to meet the needs of a minor subdivision of 6 large lots. Mineral Deposits Review of soils maps and county maps does not indicate the presence of underlying mineral deposits on the subject area. Hazard Areas The area is not in a flood plain, geological hazard and/or Weld County Airport overlay district. The land also complies with Section 50 as outlined in the Weld County Ordinance. 940870 Pioneer Estates Proposed Estate Rezoning Narrative The proposed Pioneer Estates development is within the urban growth boundary of the Town of Windsor and the City of Greeley. It is to be developed into a minor subdivision of 6 large lots that are compatible with rural living. The goals and policies within the urban growth boundaries are intended to address the development of land on the border of a municipality. They are also intended to promote harmonious and mutually beneficial uses of land among the various jurisdictions in and around Weld County. This proposed rezoning is compatible with those goals and policies. The land use considerations include provisions for population and economic growth. The Weld County Comprehensive Plan recognizes that future growth will require continued urban land area expansion within the municipal urban growth boundary areas. Much of the future expansion will, as it has in the past, require the conversion of land categorized as farmland. The _ history of the proposed development area shows that about 12 acres has been cropped into winter wheat with only one crop in every two years. About 8 acres of this land lies either in the drainage ravine or on the steep side slopes adjacent thereto and is not usable for pasture or farming. The proposed development area is compatible with the adjacent farmland by maintaining a rural environment on land that is not now, or ever has been, economical as a part of any farming unit. Its foreseeable highest and best use is to be developed as large lot residential and open space. Such use is compatible with the Weld County Comprehensive Plan. Surrounding Land Uses MI adjacent properties are zoned agricultural and are used as such. The proposed uses of the Pioneer Estates development are compatible with the residential-type development immediately to the east that includes a few scattered houses on large lots and the Windsong subdivision along WCR 17. The Pioneer Estates Development is in the urban growth boundary of both Windsor and Greeley. Public Water and Sewer Domestic water service will be provided by the Little Thompson Water District. The Little Thompson Water District has expressed their commitment to provide water to Pioneer Estates in a memo received in January 1994, see exhibit "B". Sanitary sewer service will be provided by a septic system. Excerpts from the "Soil Survey of Weld County, Colorado, Southern Part" (Exhibit "C") developed by the Soil Conservation Society, which is included in this application, show that there is only a slight degree of soil limitation concerning septic tank absorption fields. A slight degree of soil limitation indicates that the soils in the-area are generally favorable for septic tank and absorption fields and limitations are minor and easily overcome. Soils This application is being accompanied by guideline excerpts from the published "Soil Survey of Weld County, Colorado, Southern Part" (Exhibit "C") developed by the United States Department of Agriculture, Soil Conservation Service(SCS). The information from that report indicates that there may be some limitations on development by the soils in the area.
