Routes have been established and priorities assigned which will ensure that the minimum road network required for operation of emergency vehicles will be maintained at all times. Under certain emergencies, the Weld County Sheriffs Department will be notified. Flexibility remains the comerstone of the plan. To be effective, priorities must be reassessed periodically and routes altered to keep pace with changing population centers and traffic volumes. Consequently, the routes, staffing, and priorities found in the plan in Appendix "A" should be considered only as initial considerations subject to change at the discretion of the Public Works Department. Established within the context of this Snow and Ice Policy are sections which pertain to a "Snow Emergency". These sections will supersede any other conflicting sections. 1.2 SNOW WATCH ORIGINATION PLAN During normal working hours, sanding and/or plowing operations may be initiated by the Public Works Director, Project Coordinator for Public Works, or the road maintenance supervisors. Snow plowing will generally begin in non-urban areas or on roadways having shoulder and ditch sections when snow depth has reached between three and four inches. At times other than normal working hours, the assistance and cooperation of the Weld County Sheriffs Department and Colorado State Patrol will be necessary to ensure that sanding/plowing operations are initiated in a timely manner. When snow begins to fall, the County Sheriffs Department or Colorado State Patrol will notify the Weld County Communications Center which will then notify the Public Works Director, Project Coordinator for Public Works, or the road maintenance supervisors. The Director will then notify the Project Coordinator and the road maintenance supervisors and a strategy will be formulated to begin sanding and plowing operations on the primary routes first, followed by secondary routes and then residential side roads. 1.3 SNOW REMOVAL PLAN A 1.3.1 ASSUMPTION: Accumulation of snow can be cleared in a timely manner with available equipment and personnel. 1.3.2 OBJECTIVES: To clear snow and maintain, clear and safe for the traveling public, all Weld County roads as a result of snow storms. 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 5 OF 46 ORDINANCE NO. 180 PAGE 6 1.3.3 PRIORITIES: Roads will be cleared in the following order of priority: 1.3.3.1 Emergencies involving human life and safety 1.3.3.2 National Defense (Air Force Missile Site access roads) 1.3.3.3 Essential dairy-livestock access roads 1.3.3.4 Main arterial roads 1.3.3.5 School bus routes 1.3.3.6 Mail delivery routes 1.3.3.7 Remaining collector roads (including subdivisions and unincorporated towns) 1.3.4 PERSONNEL- EQUIPMENT: The following personnel and equipment resources are available to be employed in Weld County Snow Removal Operations: (SEE APPENDIX "A".) 1.3.5 COMMAND AND CONTROL 1.3.5.1 Will be exercised through the following chain of authority: (1) Board of Weld County Commissioners (2) Public Works Director (3) Project Coordinator for Public Works (4) Motor Grader Supervisors 1.3.5.2 Control of operations will be exercised at the operations office and radio room (snow desk) at the Weld County Public Works Office, 933 N. 11th Avenue, Greeley, Colorado. Communications with regional supervisors and operators will be primarily by high band radio. The Director of Public Works will be in charge of all snow removal operations and will staff the operations office as necessary to carry out operations efficiently. 1.3.5.3 Any emergency calls for the sheriff's office, ambulance, or helicopter services that are taken at the snow desk will be forwarded to the appropriate department. 1.3.5.4 All incoming calls regarding snow removal or emergencies will be routed to the snow desk, 356-4000, Ext. 3750, from the communications switchboard, unless a specific person is requested. 1.3.6 OPERATIONS 1.3.6.1 Individual grader operators in zones 2 through 31 are responsible for knowing the priority of clearing the roads within their zones, as assigned by their supervisors. When snow accumulations warrant, according to 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 6 OF 46 ORDINANCE NO. 180 PAGE 7 priority, individual operators will take independent action to start clearing within their zones as early as practicable. 1.3.6.2 The snow desk will be manned as soon as determined necessary by the Director of Public Works or higher authority. The first supervisor to reach the snow desk will assume charge immediately by making radio contact with all possible units in the field and determining their status, and will direct operations in accordance with the priorities established herein. As additional equipment and personnel are needed, they will be called into service at the discretion of the Director of Public Works or higher authority. 1.3.6.3 If weather information is available or operations are otherwise anticipated the day before, the Director of Public Works will direct specific operators to be at work and ready to commence plowing as soon as practicable on the following day. If more than two (2) days of continuous operations are anticipated, no operator will work more than twelve (12) hours in a day without approval of the Director of Public Works. 1.3.6.4 Status of all snow removal operations will be maintained at the snow desk. Reports to higher authority will be made as directed by the Director of Public Works. Motorgrader supervisors will deploy to the field as directed and remain in the area of their units, unless otherwise directed. 1.3.6.5 Plow operators are directed that the first priority is to get the roads cleared as fast as possible, emergencies excepted. Operators are authorized to stop and assist disabled or stuck vehicles only if it is necessary to clear the road or if life or health is in danger. Requests for assistance from stranded vehicles not involving an emergency will be radioed into the snow desk dispatcher who will attempt to obtain assistance for the stranded party. 1.3.6.6 If an abandoned vehicle blocking the roadway is encountered, the operator coming upon it will radio in the location, license plate number, and description of the vehicle to office personnel. The office personnel, in turn, will attempt to establish the owner of the vehicle through the Clerk and Recorder's Office, and will attempt to contact the owner to advise him or her that the vehicle is a hazard and will be moved off the County right-of-way. If the owner cannot be contacted, the operator will attempt to move the vehicle as carefully as possible. If the vehicle cannot be moved without damaging it, the operator will request instructions from his supervisor. 1.3.6.7 No school routes, private roads or driveways off the County rights-of-way will be cleared by County equipment. 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 7 OF 46 ORDINANCE NO. 180 PAGE 8 (1) EXCEPTION: If requested in writing in advance by a school district, the County will clear the driveway. (2) EXCEPTION: If a citizen needs a private road or driveway opened for a medical or other emergency, the citizen should call the Public Works office. The office personnel will fill out an emergency card and contact the appropriate emergency service. Office personnel will then contact the grader operator in the area and the grader operator will meet the emergency vehicle at the site and open the road or driveway for the emergency vehicle. 1.3.6.8 Plow trucks will be used only on paved roads and will be assigned routes or zones as dictated by the distribution of snow in the County. 1.3.6.9 Cinder trucks will be dispatched as necessary by the motor grader supervisors or the maintenance support supervisors to predetermined locations. 1.3.6.10 Backup support will be furnished as necessary by the Weld County Motor Pool and all Public Works divisions to maintain and repair snow removal equipment. Personnel from these divisions will be on standby or on duty, as directed by the Director of Public Works and the Weld County Motor Pool. First priority will be the maintenance and repair of snow removal equipment. 1.3.6.11 Nothing in this plan is intended to preclude an employee from acting and using his best judgement in the absence of directions from higher authority. 1.3.7 PLANNING AND PREPARATION 1.3.7.1 All supervisors of units providing snow removal are responsible for ensuring that equipment is ready and personnel are briefed on their duties. Prior to the first snow, each piece of equipment will be checked out, with its plow, to ensure readiness. All other equipment, such as tire and tow chains, flares, priority route maps, vehicle lights, flashlights, etc., will also be checked out at this time. 1.3.7.2 Fuel stocks at grader sheds will be monitored by the individual zone operators and status reported as directed to the motorgrader supervisors. If a fuel delivery from a supplier is necessary, the maintenance supervisors may direct the delivery route to be cleared on a priority basis. 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 8 OF 46 ORDINANCE NO. 180 PAGE 9 1.4 SNOW REMOVAL PLAN B 1.4.1 ASSUMPTION: Accumulation of snow is too heavy to clear in a timely manner with available County equipment and personnel. 1.4.2 OBJECTIVES: To clear snow and maintain, clear and safe for the traveling public, all Weld County roads as a result of snowstorms. 1.4.3 PRIORITIES: See PLAN A, Section 1.3.3 1.4.4 PERSONNEL-EQUIPMENT 1.4.4.1 In addition to County resources referred to in Plan A, Section 1.3.4, the County will utilize, as funds are available, the resources of local contractors. 1.4.4.2 These and any other contractors will work wherever assigned, but will be primarily on high-priority roads. Equipment supplied by a contractor will be with an operator and its own fuel support, if available. The type of equipment will be specified by the Director of Public Works, but will normally be motorgraders or front-end loaders. 1.4.5 AUTHORIZATION FOR CONTRACT 1.4.5.1 Upon recommendation of the Director of Public Works and approval by the Board of County Commissioners, the Director of Public Works will contact available contractors in the area of need and obtain the necessary contractor equipment and personnel to augment the County workforce. When the Board of County Commissioners cannot be reached for a decision, the Director of Public Works will obtain whatever contract support he deems necessary and will notify the Chairman of the Board and other Commissioners as soon as possible of the action he has taken. 1.4.5.2 The Director of Public Works will negotiate a fair and equitable equipment rate with the contractors, but in no case will it exceed the maximum rates set by the most recent edition of the Colorado Department of Highways, Equipment Rental Rate Schedule. At the time a contractor is hired, the Weld County Public Works Department will furnish the contractor with a copy of the Weld County snow policy. 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 9 OF 46 ORDINANCE NO. 180 PAGE 10 1.4.6 COMMAND AND CONTROL Control of contractor equipment will be exercised through the snow desk as in Plan A, Section 1.3.5. The Director of Public Works will coordinate and control the efforts of all contractor equipment. 1.4.7 OPERATIONS 1.4.7.1 County and contracted workforces will be employed so as to maximize the efficiency of the snow removal operation. Contracted equipment will be paired off wherever possible to compliment County equipment and to take advantage of County radio control. 1.4.7.2 As soon as it is apparent that County forces can handle the remaining snow removal on a timely basis, the Director of Public Works will terminate the contractor operations. 1.4.7.3 The Director of Public Works will ensure that careful records are kept on all contractor time and equipment on the job in order to validate later invoices submitted for payment. If a contractor requires fuel from County supplies, the Director of Public Works will ensure that the issue ticket is signed by the contractor's operator. 1.4.7.4 Contractors will submit invoices to the Department of Public Works for validation of time and charges. 1.4.8 SUBDIVISIONS 1.4.8.1 If funds are available, the Board of Weld County Commissioners may contract out snow removal in certain subdivisions in the County. If this is done, all personnel concerned will be notified as to which subdivisions to clear, and which will be done by contract. 1.4.8.2 Subdivision clearing will be done by County equipment unless it is determined that subdivision streets cannot be cleared in a timely manner, at which time clearing by contract may be deemed necessary. 1.4.9 PLANNING AND PREPARATION The Director of Public Works will maintain lists of available contractors and their equipment for use in emergency snow removal. Insofar as possible, the listing will contain the contractors rates of labor, equipment and overhead. 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 10 OF 46 ORDINANCE NO. 180 PAGE 11 1.5 SNOW ROUTES The priorities established in this section are based on the following criteria: 1.5.1 Emergencies involving human life and safety 1.5.2 National Defense (Air Force Missile Site access roads) 1.5.3 Essential dairy-livestock access roads 1.5.4 Main arterial roads 1.5.5 School bus routes 1.5.6 Mail delivery routes 1.5.7 Remaining collector roads (including subdivisions and unincorporated towns) 1.6 EMERGENCY PRIORITY 1.6.1 Emergency and priority#1 -Air Force Roads 1.6.2 Priority#1 - Asphalt Roads 1.6.3 Priority#2 - Gravel Roads 1.6.4 Priority#3 - School Bus Routes SECTION 2.0: GRAVEL PITS Gravel obtained from County gravel easements and sites shall not be sold or used for other than governmental purposes, except by specific authorization of the Board of County Commissioners. SECTION 3.0: ROAD ACCESS POLICY 3.1 POLICY Direct access from a public road will be limited to one per legal parcel, except as further limited or restricted by zoning or subdivision regulations. Additional accesses may be approved by the Weld County Public Works Department or the Board of County 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 11 OF 46 ORDINANCE NO. 180 PAGE 12 Commissioners. This policy shall apply to all new and existing accesses within the unincorporated areas of Weld County. Properties within municipalities or other counties which access Weld County roads are subject to this policy. 3.2 PURPOSE Land use and development in recent years have impacted County roads. This policy recognizes that the efficiency and safety of County roads depends, to a large extent, upon minimizing roadside interference and its detrimental effect upon the movement of traffic. This policy provides minimum requirements for the design, construction, and maintenance of accesses. This policy is established for the safe and efficient movement of traffic while allowing reasonable access to properties. If a new access is requested to a legal parcel where an existing access already exists, it should be interpreted that the second access would not be provided unless the denial of the access creates some undue hardship on the property owner. Whenever multiple accesses to a single legal parcel exist prior to the date of adoption of this policy and additional accesses are requested, one or more existing access should be removed, minimizing new accesses and utilizing existing accesses. A Weld County Road Access Information Sheet in substantially the form shown in Appendix "B", will be required for all new roads, driveways or other means of providing ingress or egress to lands adjoining County rights-of-way. The information sheet shall be completed by the owner of the property to be accessed from a County road or his duly authorized agent as evidenced by written documentation. 3.3 MATERIALS AND METHODS Construction practices and placement of materials on County road rights-of-way shall conform to the Colorado Department of Transportation Standard Specifications for Road and Bridge Construction, Current Edition, a copy of which is available for public review at the Weld County Department of Public Works. 3.4 ROAD ACCESS DESIGN STANDARDS All road accesses shall be constructed in accordance with the detail drawings included herein as part of Appendix"B" and incorporated by this reference. 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 12 OF 46 ORDINANCE NO. 180 PAGE 13 No access approach shall have an effective turning radius of less than 20 feet. A minimum effective tuming radius of 40 feet shall be used for accesses intended to accommodate truck traffic. 3.5 TEMPORARY ROAD ACCESSES Any road access which is not for use by the general public and which will be closed after being used for only a limited time may be considered a temporary road access. The time shall not exceed 60 days. The technical requirements for temporary road accesses will be the same as for permanent road accesses. Temporary road accesses shall not block existing drainage features. When the temporary road access is closed, all materials shall be removed and the site restored to its original condition by the permittee. 3.6 RETROFITTING A ROAD ACCESS The owner(s), at their expense, may be required to modify road accesses when the Department of Public Works has determined that it is necessary in order to protect the safety of the traveling public, improve drainage conditions or provide for public roadway improvements. SECTION 4.0: ROAD ACCESS CULVERTS 4.1 The owner of the property shall pay for materials and the cost of installation for new road access culverts whenever the installation of a culvert is made necessary by the creation of a new access from private property to a county road, by any alteration of the natural flow of water across private property by the owner, or for any other reason created by any owner of private property. The culvert shall be installed according to the specifications of the Department of Public Works as to size and location in the County rights-of-way or other County property in which such culverts may be installed. The culvert size will be determined in accordance with standard engineering practices. The property owner shall be responsible for cleaning the borrow ditch to the extent required to accommodate the road access culvert and insuring proper drainage. 4.2 ROAD ACCESS AND/OR CULVERT MAINTENANCE After installation, such owner or occupier shall be responsible for the maintenance and repair of the road access and/or any related culvert. If, after installation, such owner or occupier is notified of the need for maintenance or repair of the culvert, the owner or occupier shall have 15 days to make such repair or perform the needed maintenance. In the event of the property owner's failure to perform such maintenance, Weld County shall perform such repair and/or maintenance as may be required for the protection of the County roads and 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 13 OF 46 ORDINANCE NO. 180 PAGE 14 related appurtenances within the right-of-way. The responsible property owner will be billed if the property owner fails to perform the required maintenance or repair on the road access or culvert within the timeframe specified above. In the event of an emergency or a hazardous situation is observed or detected, the property owner shall be notified and requested to provide an immediate remedy to the situation. If the property owner fails to react, Weld County shall correct the hazardous situation and bill the property owner for all incurred expenses. 4.3 GENERAL CONDITIONS 4.3.1. ENFORCEMENT: Without limiiting the availability of any other remedies,the provisions of this section may be enforced by means of an action brought at the direction of the Board of County Commisioners for damages,injunctive relief or in nuisance. 4.3.2. STATE LAWS: No portion of this policy is intended to authorize any person to alter the flow of water in a manner contrary to the laws of the State of Colorado regarding water rights or drainage. SECTION 5.0: MAINTENANCE OF CULVERTS, BRIDGES, OR SIMILAR STRUCTURES USED FOR IRRIGATION PURPOSE The County's duty to maintain culverts, bridges, or similar structures used for irrigation purposes shall be in accordance with the following statutory requirements. 5.1 Section 43-5-305(1), C.R.S. "Any person or corporation owning or constructing any ditch, race, drain, or flume in, upon, or across any highway shall keep the highway open for safe and convenient travel by constructing culverts, bridges, or similar structures over such ditch, race, drain, or flume. When any ditch is constructed across, in, or upon any highway, the person owning or constructing such ditch shall construct a culvert, bridge, or similar structure long enough to conduct the water from shoulder to shoulder from such road or highway or of such greater length as the Board of County Commissioners having jurisdiction thereover may require, plans for the culvert, bridge, or similar structure having been approved in advance by the Board of County Commissioners. The Board of County Commissioners shall maintain the culvert, bridge, or similar structure after construction, in accordance with the provisions of Section 37-84-106, C.R.S." 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 14 OF 46 ORDINANCE NO. 180 PAGE 15 5.2 Section 37-84-106, C.R.S "All bridges constructed over any ditch, race, drain, or flume, crossing any public highway, street, or alley, after construction, shall be maintained by and at the expense of the county or municipality in which the ditch, race, drain, or flume may be situated." SECTION 6.0 USE OF COUNTY BORROW DITCHES ALONG WELD COUNTY RIGHTS-OF-WAY FOR IRRIGATION RUNOFF AND OTHER USES 6.1 DUTY OF USERS Persons in Weld County who are currently using borrow ditches along Weld County rights-of- way for irrigation runoff and other uses, whether the consent to such uses was originally given expressly or implied, may continue such uses if the following conditions are met: 6.1.1 Owner and user are responsible for preventing irrigation water or other uses from causing silt, other sediment, or weeds to accumulate in the borrow ditches so that proper drainage is not inhibited. 6.1.2 Owner and user are responsible for preventing the blockage of the borrow ditches and must not alter the direction or rate of flow in any manner in the borrow ditches. 6.1.3 Owner and user are responsible for preventing the irrigation water and other uses from causing damage to Weld County rights-of-way. 6.1.4 Tail water shall be controlled to prevent erosion and sedimentation of the borrow ditches. 6.2 VIOLATIONS If the Board of County Commissioners of Weld County, Colorado, determines users are violating the above-stated conditions, the Board may consider the revocation of its prior consent, whether express or implied. The revocation of consent may be entered by resolution of the Board of County Commissioners, following notice to the owner and user (if the user can be determined,) and a hearing held pursuant to the Procedures for Adjudicatory Type Hearings. The Director of Public Works or his designee shall have the burden of showing, by a preponderance of evidence, that the owner and user have failed to comply with Section 6.1 herein. 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 15 OF 46 ORDINANCE NO. 180 PAGE 16 SECTION 7.0: POLICY FOR CATTLE GUARDS ON WELD COUNTY ROADS 7.1 DEFINITIONS Person includes any individual, business or corporation. A person, who is not a landowner, must demonstrate authority to act on behalf of the landowner prior to entering into any agreement or receiving any services from Weld County. 7.2 NEW INSTALLATIONS Any person in Weld County, Colorado, who wishes to install a cattle guard on any Weld County road may do so only upon the following conditions: 7.2.1 The entire cost of installation of a cattle guard is paid by the person making the request. 7.2.2 The Weld County Department of Public Works shall be notified prior to installation of a cattle guard. A written agreement, in substantially the form attached in Appendix "C", must be received by the Weld County Department of Public Works at least fifteen (15) days prior to the date of the installation. 7.2.3 The Agreement between the Weld County Department of Public Works and the person making the request, detailing the rights and obligations concerning the maintenance and repair of the cattle guards shall be signed by the person making the application. 7.2.4 Any cattle guard which is installed upon a Weld County road must comply with any and all standards required by the Weld County Department of Public Works, including but not limited to, Weld County's "Specifications for Cattle Guard Installation". 7.3 CLEANING Any person who benefits from any cattle guard located upon any Weld County road has the responsibility to periodically clean the space within the cement box and below the grate of the cattle guard. The word "clean" includes the removal of all sand, dirt, silt, and other solid debris which renders the cattle guard ineffective. 7.3.1 The person may request Weld County to clean the cattle guard; however, the person will pay the cost of the cleaning prior to the work being done. The person requesting the cleaning will provide written acknowledgement that they will conform to the provisions of the Weld County policy for cattle guards on Weld County roads. 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 16 OF 46 ORDINANCE NO. 180 PAGE 17 7.3.2 Cleaning of the cattle guard must be completed within one (1) working day. The person shall notify the Weld County Department of Public Works of his/her intention to perform the cleaning prior to commencing the work. If the person believes that such cleaning is likely to extend into the next working day, the person shall replace the grate of the cattle guard prior to one-half hour before sunset. 7.3.3 The road on which the grate is located shall be closed during the cleaning. The person has the duty to place all signs necessary to order to warn oncoming motorists of the road closure, using signs in accordance with the "Manual on Uniform Traffic Devices". The person may use signs provided by Weld County for such purposes. 7.3.4 The repair of any cattle guard on any Weld County road shall be the joint responsibility of Weld County and the person who benefits from the cattle guard. Weld County will provide the labor for the repair and pay for materials to repair the metal grate provided the person benefiting from the cattle guard pays for all other materials used in the repair. 7.4 REPLACEMENT 7.4.1 In the event any cattle guard located upon any Weld County road is deemed by Weld County to be beyond repair, the cattle guard shall be replaced. Weld County will provide the labor for the replacement and pay for the new metal grate provided the person benefitting from the cattle guard pays for all other materials used in the replacement. 7.4.2 Any person requesting the replacement of a cattle guard will provide written acknowledgement that they will conform to the provisions of the Weld County policy for cattle guards on Weld County roads. Installation shall be done in accordance with Weld County's specifications for cattle guard installations. 7.5 NOTIFICATION OF THE NEED FOR REPAIR It is the responsibility of any person who benefits from any cattle guard located upon a Weld County road to notify the County of the need for repair to the cattle guard. The person must notify the County within the same five working days in which the person obtains the knowledge of the need for repair. 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 17 OF 46 ORDINANCE NO. 180 PAGE 18 7.6 AGREEMENT WITH WELD COUNTY Any person who performs work on a cattle guard in the County right-of-way without an agreement with the County, or fails to provide notification for need for repair, or fails to provide for periodic cleaning or assist in the repair and replacement of the cattle guard may be subject to the cattle guard being removed by Weld County following ten day's notification and the opportunity to apply to the Board of County Commissioners within that ten day period for a hearing pursuant to Weld County policies for adjudicatory hearings. Notice shall be by registered mail, return receipt requested, or by personal service in accordance with the Colorado Rules of Civil Procedure. 7.7 VESTED No portion of these policies shall be considered to have vested any person with the right to a particular size of cattle guard. Weld County, upon a determination that road improvement or widening is necessary, may require replacement of existing cattle guards. The cost will be shared in accordance with Section 7.4 of this policy. SECTION 8.0: ACQUISITION OF REQUIRED PERMITS FOR ROAD AND BRIDGE OPERATIONS Weld County shall obtain all required State and Federal permits for Public Works operations. Weld County will acquire, in its name, all gravel mining permits for gravel mining on County-owned property. When the property is not owned by the County, the issue of the obligation to obtain, maintain and pay the costs of permits shall be addressed contractually. SECTION 9.0: ROAD MAINTENANCE POLICY (SUBDIVISIONS) Weld County may accept roads within the boundaries of a subdivision for maintenance under the following conditions: 9.1 All roads within subdivisions shall comply with the construction standards established within the subdivision regulations in effect upon the date of consideration for acceptance. 9.2 Property owners may utilize any legal means of funding the necessary improvements. 9.3 Acceptance of roads for maintenance by Weld County requires approval, by Resolution of the Board of County Commissioners, before acceptance is effective. 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 18 OF 46 ORDINANCE NO. 180 PAGE 19 SECTION 10.0: USE OF ROAD RIGHTS-OF-WAY BY PIPELINE COMPANIES The use of road rights-of-way by pipeline companies is governed by Ordinance No. 143 and by Section 38-5-101, C.R.S., which states: "Any domestic or foreign telegraph, telephone, electric light power, gas, or pipeline company authorized to do business under the laws of this state or any city or town owning electric power producing or distribution facilities shall have the right to construct, maintain, and operate lines of telegraph, telephone, electric light, wire or power or pipeline along, across, upon, and under any public highway in this state, subject to the provisions of this article. Such lines of telegraph, telephone electric light, wire or power or pipeline shall be so constructed and maintained as not to obstruct or hinder the usual travel on such highway." The statute requires that Weld County must allow a pipeline company, private or public, to use County Road rights-of-way for installing pipeline, so long as their use does not interfere with the normal use of the roadway. There may be some variance to this general principle depending upon whether or not the County has a right-of-way or a fee interest in the road. A fee interest may require the company to obtain an easement; a right-of way may not. If the company is engaged in interstate commerce, it would also be regulated by the federal government. If it is engaged in intrastate commerce, it may be regulated by state government through the P.U.C. SECTION 11.0: SIGN POLICY The County sign shop shall produce signs only for roads maintained by Weld County, including County maintained-roads in subdivisions, unincorporated areas and unincorporated towns, or where the signs are produced pursuant to a separate Intergovernmental Agreement with a governmental agency. All signs placed in the County rights-of-way must conform to the Manual on Uniform Traffic Control Devices. No signs, except those installed by the County, shall be located within County rights-of-way and all signs adjacent to rights-of-way must meet applicable building and zoning codes. 941002 2419818 8-1472 P-559 12/21/94 02:34P PG 19 OF 46 ORDINANCE NO. 180 PAGE 20 SECTION 12.0: PERSONAL USE OF GRADER SHEDS Grader operators living adjacent to County grader sheds may use grader sheds in accordance with the agreement entered into by the County and operator. Grader operators may park personal vehicles in grader sheds while performing road maintenance work for the County, if the personal vehicle is not parked in the grader shed in lieu of a County-owned grader. Any personal use of grader sheds by County employees or any other individual except as specified above, is prohibited by the Board of County Commissioners. SECTION 13.0: UTILITIES AND RENTS FOR GRADER SHEDS Effective January 1, 1983, the Board of County Commissioners adopted the policy whereby when the County owns the grader shed and a trailer pad, that item associated with the grader shed will be provided at no cost. Electricity will be provided for the dwelling located at the Kiowa grader shed while the current employee utilizes and operates out of the grader shed. Effective with this policy, utilities of gas and electricity are no longer to be provided to any grader operator in Weld County. Each operator will be responsible for his or her own gas and electricity. SECTION 14.0: EXPENDITURE OF COUNTY FUNDS FOR THE CONSTRUCTION, UPGRADE, PAVING, AND/OR MAINTENANCE OF STREETS, ROADWAYS, AND/OR HIGHWAYS LOCATED WITHIN INCORPORATED MUNICIPAL BOUNDARIES No Weld County funds shall be spent on the construction, upgrade, paving, and/or maintenance of streets, roadways, and/or highways located within incorporated municipal boundaries, with the exception of funds which are reimbursed to Weld County, Colorado, on a dollar-for-dollar basis, and with the exception of funds provided (or services in lieu thereof) to municipalities by Weld County pursuant to Section 43-2-202, C.R.S. This policy shall not preclude the County from performing work within a municipality pursuant to an Intergovernmental Agreement providing for reimbursement for the County's costs. SECTION 15.0: FUGITIVE DUST CONTROL POLICY It shall be the policy of the Board of Weld County Commissioners to address fugitive dust on Weld County roads as follows: 15.1 PRIVATE APPLICATION Weld County has no objection to individuals applying dust control chemicals to County roads at their own expense providing they agree to the following conditions: 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 20 OF 46 ORDINANCE NO. 180 PAGE 21 15.1.1 Chemicals used for dust control may not contain any hazardous substances as defined in Colorado Revised Statutes, Section 29-22-101. Individuals are advised that petroleum products, whether commercially processed or not, may contain hazardous substances. 15.1.2 Petroleum products that contain naphtha or other combustible material may not be used. 15.1.3 Dust control chemicals must be applied in such a manner that will not contaminate any waters of the State. Therefore, any materials which may wash from the roadbed will not be suitable. 15.1.4 Weld County will make every effort not to disturb the section of road which has been treated with dust control chemicals. IT WILL BE THE COUNTY'S DECISION AT WHAT POINT THE ROADWAY MUST BE GRADED TO RESTORE A REASONABLE TRAVEL SURFACE. WELD COUNTY WILL NOT BE RESPONSIBLE FOR REAPPLYING DUST CONTROL CHEMICALS. 15.1.5 All dust control agents used on county roads shall be approved for use by the Weld County Health Department and the Department of Public Works. Currently, the materials listed in Appendix"D" are approved for use. The County reserves the right to add or delete materials from the approved list at any time without prior notice. The application of any substance to a County road for purposes of dust control, not specifically identified in the approved list of materials, shall be approved for use in writing from the Weld County Health Department and Public Works Department prior to its application. 15.2 GRADING Weld County will grade the roadbed prior to the application of dust control chemicals at no cost to the individual. 941002 2419818 8-1472 P-559 12/21/94 02:34P PG 21 OF 46 ORDINANCE NO. 180 PAGE 22 SECTION 16.0: PROCEDURES REGARDING SURVEY MONUMENTS The destruction of monuments can be a criminal offense and can lead to substantial costs for the County or adjacent landowners when the need arises to replace those monuments. The following procedure is to ensure that the monuments can be documented and replaced or relocated as road work is performed. In order to avoid having surveyors dig holes in the road intersections to locate the monuments, the monument should be enclosed in a box which is kept flush with the roadway surface. 16.1 The County will supply the monument boxes to the survey companies, and the companies will continue to handle the physical labor of installation. 16.2 The boxes will be issued through the Public Works Department. Prior arrangements should be made to pick the boxes up, as the Public Works Department will not supply the labor or equipment. 16.3 Efforts will be made by Public Works employees to protect existing markers during paving, overlay, and patching projects with spacers. 16.4 Sites of new construction projects will be checked and marked by the Public Works Department before work begins. The County Surveyor will be consulted and will inspect the area when the work is complete. 16.5 Spacers will be put in to elevate the existing box on overlay projects. If a marker is damaged, the County Surveyor will be notified. The Public Works Department will place a new box over existing pins before construction begins. SECTION 17.0: WEEDS ALONG COUNTY ROADS, COUNTY RIGHTS-OF-WAY AND OTHER COUNTY PROPERTY The County has an obligation to control noxious weeds on County property as established by the Pest Control Districts Act (C.R.S. 35-5-101, et. seq.) and the Colorado Weed Management Act (C.R.S. 35-5.5-101, et. seq.). The Weld County Undesirable Plant Management Plan, adopted as Ordinance No. 169, will be followed in controlling noxious weeds on County property. The County also has an obligation to control weeds bordering County roads and at intersections and traffic control signs in order to ensure safe traffic flow and motorist visibility. In addition, general vegetation control along designated County roads is necessary to reduce snow drifting onto the roads. 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 22 OF 46 ORDINANCE NO. 180 PAGE 23 The Board of County Commissioners of Weld County resolve that general weed control will be carried out only along designated roadsides to increase motorist visibility at intersections and traffic control signs, and prevent snow drifts along County roads. The methods of weed control used by Weld County shall be by mowing or spraying herbicides. Equipment in the Pest and Weed Division of the Public Works Department will be used. SECTION 18.0: TREES IN COUNTY RIGHTS-OF-WAY Weld County has a duty to protect motorists by ensuring that tree overgrowth from overhanging branches and dead trees does not create road hazards by obstructing visibility. It shall be the policy of Weld County that when trees on private property begin to obstruct visibility on County roads, the property owner shall be given notice to trim the trees within a reasonable time or the County will do so and bill the property owner. If a tree or branches from a tree on private property fall onto the County rights-of-way, the tree or tree branches will be pushed back onto the private property by the County work force. The County shall trim or remove all trees growing in County rights-of-way that obstruct visibility for the safety of motorists at the County's expense. SECTION 19.0: STRIPING OF COUNTY ROADS Weld County's roads require certain striping, per the Manual on Uniform Traffic Control Devices. Weld County has limited resources for Public Works operations and can only provide minimum services. Weld County may provide center or edge striping on arterial or collector roads when required to enhance safety. SECTION 20.0: ROAD ACCEPTANCE POLICY Weld County does not maintain private roads, lanes or driveways. Before a public road can be accepted by the Board of Weld County Commissioners for maintenance, the road must meet the following minimum conditions: 941002 2419818 B-1472 P-559 12/21/94 02:34P PG 23 OF 46 ORDINANCE NO. 180 PAGE 24 20.1 The road shall be surveyed to determine right-of-way lines. 20.2 The width of the right-of-way cannot be less than thirty (30) feet wide. The road shall serve a minimum of three legal lots, two of which must have taxable improvements. Properties abutting the intersection of the road under consideration for acceptance and an existing publicly-maintained road do not count toward the required three lots. 20.3 The minimum road width shall be 18 feet or meet the minimum design guidelines for the anticipated traffic. (See Appendix"E") 20.4 The road must be adequately graded and drained. 20.5 A minimum of two inches of crushed rock must be provided on the traveled surface, or if necessary, additional material may be required to support anticipated traffic loads. 20.6 The road cannot be fenced or gated, but if there are cattle in the area, a cattle guard can be installed in accordance with the County cattle guard policy. 20.7 The benefitting parties will be responsible for the cost of all aspects of the project. SECTION 21.0: VACATION OF COUNTY ROAD RIGHTS-OF-WAY 21.1 Owners of land adjacent to County road, street, or alley rights-of-way which are shown as part of an approved or recorded subdivision plat, map, or unincorporated community legally filed prior to any regulations controlling subdivisions, may seek vacation only by means of an application to re-subdivide pursuant to the Weld County Subdivision Ordinance which is administered by the Department of Planning Services. 21.2 Owners of land adjacent to County road rights-of-way, other than those described in section 20.1, may seek vacation by petition to the Board of County Commissioners through the Clerk to the Board, pursuant to C.R.S. 43-2-303. SECTION: 22.0 APPENDICES Attached hereto and incorporated by this reference, in substantially the form attached to this Ordinance, are appendices "A-E" consisting of plans, forms, and diagrams. Changes to the appendices which are procedural, clerical or grammatical in nature shall not require amendment to this Ordinance. BE IT FURTHER ORDAINED by the Board that, if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. Where possible, supporting information was included as Appendicies to permit modification without requiring an amendment of the Ordinance. Paragraph 1.3.6.8 of the present policy made reference to plow truck and cinder truck operations. This paragraph was divided into two sections addressing each operation separately. While the plow trucks and cinder trucks do coordinate their activity, situations regarding icy conditions may arise where different priorities will have to be assigned to each operation. Updated information regarding operating personnel and location was removed to the Appendix. The provisions of the section on Road Access Policy represents the most significant change. Coordination between the Planning Department and the Public Works Department will be needed to insure that the appropriate permits are secured. Provisions to permit temporary road access will apply to oil/gas well construction activity. Although there is no change in the policy regarding access road culverts, readoption of the policy will reinforce the Department's discontinuance of the "practice" of providing free labor and equipment for the installations of culverts. If a property owner fails to properly maintain the culvert, provisions are included to permit the Department to correct any situation which is necessary for the protection of the County roads. The cost of any corrective action will be billed to the property owner. The road maintenance policy pertaining to subdivisions has been amended to allow property owners to utilize any legal means of funding road improvements. The Fugitive Dust Control Policy was amended to identify the specific products that are acceptable for use. The specific list is included in the Appendicies. The provisions addressing noxious weeds was amended to reflect the inclusion of the Pest and Weed Division into the Public Works Department.
