The parcel of land on which this request is being made is described as Lot 2 of Amended RE-555, located in part of the SE% of Section 11, Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado. The property is located approximately one half mile north of Weld County Road 22, and east of and adjacent to Weld County Road 23. The parcel of land under consideration is the total contiguous land holdings of the applicant. This request is to divide the property into parcels of 40.5 and 17.5 acres more or less. Domestic wells are proposed to provide water service to both parcels with septic being proposed for sewage disposal. The applicant wishes to sell the 17 acre parcel with the residence because it is no longer needed for the farming operation. This residence was constructed in 1986. The applicant purchased the property in 1977 as a 78.564 acre parcel with one residence. In 1982 the property was divided by recorded exemption RE-555 into parcels of 74.891 acres and 3.673 acres more or less with the original house. Then in 1985 the property was further divided by amending RE-555 and approval of subdivision exemption SE-241 to create parcels of 57.988 acres, 16.049 acres, and 3.673 acres more or less (original lot A of RE-555). The 3.673 acre parcel and the 16.049 acre parcel are currently owned by other individuals. A residence was constructed on the 16.049 acre parcel and one on the 57.988 acre parcel in 1986. The Department of Planning Service's staff recommends denial of the present recorded exemption request. It is the opinion of the Department of Planning Service's staff that this application does not meet the intent of the A(Agricultural) zone district, does not comply with the Agricultural Goals and Policies of the Weld County Comprehensive plan, is not efficient and orderly development, and removes productive farm ground from production. 941122 # eat d1/zi/gq C�, s�,/ '4� 941160 RE - 1653 Richard Hein • Page 2 Conflicts between rural and urban activities are evident in this request. When an urban growth pattern is established without regard to long range comprehensive planning, the outcome lacks the essential elements of long term desirability. Higher costs are incurred by providing many public services to urban sprawl areas. As urban areas develop and expand they inadvertently influence surrounding areas. These areas are either converted to urban uses themselves or are in direct conflict and competition with agricultural areas. The applicant has failed to comply with the A (Agricultural) zone district intent. This parcel is located outside of an urban Growth Boundary Area. Continued division of this parcel emphatically opposes the intent of the A (Agricultural) zone district. The potential to interfere and encroach upon the agricultural activities of this area is evident. The A (Agricultural) zone district was established to promote and maintain agriculture as a vital support element for Weld County Citizens, and not be continually decreased for residential development. The size of the parcels are becoming to small to be economical to farm and to large and costly to mow and maintain. Agricultural policies discourage the conversion of agricultural land for residential uses in areas outside of an urban growth boundary area. The intent is to eliminate incompatibilities that exist and minimize costs to Weld County tax- payers. The proposed division is not consistent with Efficient and orderly development. Access to proposed lot B would be by a long narrow road of approximately 107 feet in length and the addition of a new lot to the previous lots divided off, is creating a lineal subdivision. This North Half of the South East Quarter of this section which was a.79.864 acre parcel has been inundated with piecemeal development. The staff is concerned about the level of development that has occurred in this area and the potential for continued divisions. The Board should consider whether it wants to allow this type of piecemeal development to continue. Continued divisions of this type evade the intent and purpose of the Weld County Subdivision Ordinance and the Weld Comprehensive Plan. The Staff Recommends the Board of County Commissioners deny this request.
