RE : APPROVE CONTINUANCE OF HEARING TO CONSIDER REQUEST OF C & M
COMPANIES FOR SITE SPECIFIC DEVELOPMENT PLAN AND USE BY
SPECIAL REVIEW PERMIT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public
hearing on the 28th day of February, 1990 , at the hour of 10 :00
a.m. in the Chambers of the Board for the purpose of considering
the request of C & M Companies for a Site Specific Development
Plan and Use by Special Review Permit for gravel mining and
concrete and asphalt batch plants, and
WHEREAS, the Board was informed that the property was not
posted ten days prior to the hearing, as required; therefore, the
hearing must be continued, and
WHEREAS, the Board deemed it advisable to continue said
hearing to March 7 , 1990 , at 10 : 00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hearing to
consider the request of C & M Companies for a Site Specific
Development Plan and Use by Special Review Permit be, and hereby
is, continued to March 7 , 1990, at 10 : 00 a.m.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 28th day of
February, A.D. , 1990.

A public hearing was conducted on February 28, 1990, at 10:00 A.M. ,
with the following present:
Commissioner Gene R. Brantner, Chairman
Commissioner George Kennedy, Pro-Tem
Commissioner Constance L. Harbert
Commissioner C.W. Kirby
Commissioner Gordon E. Lacy
Also present:
Acting Clerk to the Board, Mary Reiff
Assistant County Attorney, Lee D. Morrison
Planning Department representative, Rod Allison
The following business was transacted:
I hereby certify that pursuant to a notice dated December 27, 1989, and
duly published January 11, 1990, in The New News, a public hearing was
conducted to consider the request of C & M Companies for a Site
Specific Development Plan and Use by Special Review Permit for gravel
mining and concrete and asphalt batch plants. Lee Morrison, Assistant
County Attorney, made this matter of record. Mr. Morrison said this
hearing was continued from January 24, 1990, by Resolution dated
January 15, 1990, and that the hearing room was posted on January 24.
Chairman Brantner noted that the Commissioners received a memo from the
Clerk to the Board's Office advising that the property was not posted
the required ten days prior to this hearing. Rod Allison, Planning
Department representative, stated that Gary Tuttle, representing the
applicant, has requested that this hearing be continued to March 7, and
a sign has been posted for that date. Commissioner Lacy moved to
continue this hearing to March 7, 1990, at 10:00 a.m. Commissioner
Kirby seconded the motion. No public comment was offered concerning
the postponement of this hearing. The motion carried unanimously.
This Certification was approved on the 5th day of March, 1990.

The applicant, C & M Companies , failed to post a sign the required
ten days before this hearing date. After discussion, the
applicant was advised that this hearing will be rescheduled for
March 7 , 1990, at 10 : 00 a.m. , and the sign, containing this
information, was to be posted.
The surrounding landowners were notified that the sign had not
been posted, and the hearing would probably be rescheduled. We
will send out a notice informing them of the rescheduled date.

NOTICE OF RESCHEDULING
Be advised that the Board of Weld County Commissioners has deemed it
necessary to reschedule the hearing for C & M Companies because the
applicant failed to post the required sign on the property giving ten days
notice of the hearing date scheduled for February 28, 1990, at 10:00 a.m.
Because the appropriate signs have now been posted, the Board has determined
that the hearing shall be rescheduled to be heard on March 7, 1990, at 10:00
a.m. Said public hearing, concerning the Site Specific Development Plan and
Special Review Permit, will be held in the Chambers of the Board of County
Commissioners of Weld County, Colorado, Weld County Centennial Center, 915
10th Street, First Floor, Greeley, Colorado. All persons in any manner
interested are requested to attend and may be heard.
Should the applicant or any interested party desire the presence of a court
reporter to make a record of the proceedings, in addition to the taped
record which will be kept during the hearing, the Clerk to the Board's
Office shall be advised in writing of such action at least five days prior
to the hearing. The cost of engaging a court reporter shall be borne by the
requesting party.
BE IT ALSO KNOWN that the text and maps so certified by the Weld County
Planning Commission may be examined in the office of the Clerk to the Board
of County Commissioners, located in the Weld County Centennial Center, 915
10th Street, Third Floor, Greeley, Colorado.
