RE: DENIAL OF RECORDED EXEMPTION NO. 1440 - BOYD M. AND ALLISON J. MEYER
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, a request for Recorded Exemption No. 1440, submitted by Boyd M.
and Allison J. Meyer, for property which is located in part of the N; of Section
24, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, has
been presented to the Board, and

WHEREAS, this request is to divide the property into parcels estimated to
be approximately 10 acres and 40 acres, and

q WHEREAS, after reviewing the recommendation of the Planning staff and
o w• hearing the testimony presented, the Board determined that said request shall be

Subject: Recorded Exemption 1440
Dear Commissioners:
This request for a recorded exemption is submitted in conjunction with a request
to amend Recorded Exemption 942. The applications have been submitted by Boyd
M. and Allison J. Meyer. The parcel of land on which this request is being made
is described as part of the N2 of Section 24, T6N, R67W of the 6th P.M. , Weld
County, Colorado. The property is located south of Highway 392, approximately
.5 miles east of Weld County Road 23. This request is to take the portion of Lot
B of Recorded Exemption 942, lying north of the ditch, and to divide that 50 acre
parcel, into two lots of 10 acres and 40 acres, more or less.
The applicants propose using North Weld County Water District as the water source
for both proposed parcels. Septic systems would provide sewage disposal.
Neither proposed lot contains a dwelling.
It is the opinion of the Department of Planning Services' staff that sufficient
reasons have not been given by the applicant to warrant creating these two
additional building sites at this time. The applicant has failed to show in the
submitted application materials how this request is consistent with the Weld
County Comprehensive Plan and efficient and orderly development. The guidelines
used to allow a division of an agricultural lot into two separate lots are
outlined in Agricultural Policy 7. The intent of this policy is to:
A. Enable the property owner who is retiring an opportunity to live on or
sell the existing farm improvements.
B. Enable the property owner to sell off agricultural land that is
nonproductive for one single family dwelling homesite; and
C. Enable the property owner to provide a residence for direct members of the
farm family and also for workers employed at the farm.

This application states that the purpose of this recorded exemption is to split
off a building site. The reasons stated do not comply with the intent of this
policy as established in the Comprehensive Plan.
The Department of Planning Services' staff has concerns about the level of
development and the potential for continued division occurring in this area.
Recorded Exemption 1381, immediately west of this parcel, was approved by the
staff in 1991, as shown on the attached aerial photograph. Development in this
area has reached a level where continued divisions will evade the intent and
purpose of the Weld County Subdivision Regulations. Residential development in
rural areas necessitates an increased demand for road maintenance, police and
fire protection, school busing, snow removal, utilities, and other urban
services. Service demands increase as density increases.
The staff requests the Board of County Commissioners deny this request.

That part of the N3 of Section 24 , Township 6 North, Range 67 West
of the 6th P.N. , Weld County, Colorado more particularly described
as follows:
Beginning at a point on the North line of said Section 24, 310 feet
West of the Northeast corner thereof , running thence South 1472. 50
feet to an iron pipe on the South bank of No. 2 ditch; thence along'
the South bank of said Ditch; North 65°51 '00" West 167 feet ; thence
North 56°16'00" West 142. 50 feet ; thence North 76°14'00" West 103. 5
feet ; thence North 49°03'00" West 98 feet to an iron pin; thence

to the Southwest corner of the NE3 of said Section 24; thence West

To Whom it May Concern:
Application Requiremehts form r5 the above referenced Recorded
Exemption:
1. The purpose of this recorded exemption is to split off an
8 acre building site lying Westerly of an existing access
road from the balance of the farm.
2. This proposal is consistent with the policies of the Weld
County Comprehensive plan in that the uses and nature of the
land will not be changed by this recorded exemption. The
lands are now zoned agriculture and shall remain a primary
agricultural use, thus insuring the proposal is consistent
with the intent of the agricultural zone district in which
this property is located.
3. The uses that will be permitted are limited to .those permitted
by the Weld County agricultural zoning district which includes
crop, pasture and limited animal husbandry. This is compatible
with the existing surrounding land uses as they are also
presently engaged in the same agricultural uses.
4. The uses permitted wilii be compatible with the future development
of the surrounding areas as permitted by the existing zoning
and with future development as projected by the comprehensive
plan of Weld County.
5. This proposal will not be inconsistent with efficient and
orderly development as the existing uses will not change as
a result of this recorded exemption.

6. No existing services are currently in use on this property lying
Northerly of the Greeley No. 2 Ditch. Domestic Water taps
and on-lot septic systems are proposed on the subject property.
7. This property does not lie in a flood plain, geologic hazard . .
or the Weld County Airport Overlay District.

Dear Ms. Swanson:
We have reviewed the application for the Meyer Recorded Exemption, and
we have the following comments:
Projected traffic on S.H. 392 indicates the need for a 150 foot total right
of way, 75 feet each side of the highway centerline. Since the existing
width along this property may be less than 75 feet south of the centerline,
additional width to meet the projected need should be protected by reservation
or, preferably, dedication, as permitted by County regulations.
Direct access to the state highway from the two Lots created by this Recorded
Exemption must continue to be via the existing driveway. At such time
that there is a change of use of the properties that increases the volume
of traffic using the access, an access permit may be required. No additional
direct access to the highway will be permitted. An access permit will
not be required as a condition of this Recorded Exemption, only at such
time that the land use changes.
