RE: APPROVE AGREEMENT FOR GRADING AND SNOW REMOVAL WITHIN THE BOUNDARIES OF
THE TOWN OF HUDSON AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for Grading and
Snow Removal Within the Boundaries of the Town of Hudson, with the terms and
conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said
agreement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement for Grading and Snow Removal Within the
Boundaries of the Town of Hudson be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 2nd day of December, A.D. , 1991.

THIS AGREEMENT, made and entered into this 4 ND day of
a re .n 6e. , 1991, by and between THE TOWN OF HUDSON,
hereinafter referred as "Town, " and THE COUNTY OF WELD, STATE OF
COLORADO, by and through the Board of County Commissioners of the
County of Weld, Colorado, hereinafter referred to as "County. "
WHEREAS, Town wishes to have County perform grading and snow
removal services on certain roads within the boundaries of the
Town of Hudson, and
WHEREAS, County is agreeable to rendering such services
pursuant to the terms and conditions hereinafter set forth, and
WHEREAS, Agreements between County and other governmental
entities are authorized and provided for by the provisions of
Section 29-1-203, C.R.S. , and so provided for Section 2-3 of the
Weld County Home Rule Charter.
NOW, THEREFORE, pursuant to the terms of the aforesaid
statute and Weld County Home Rule Charter, it is agreed as
follows:
1. That the County, by way of the Road & Bridge
Department, agrees to provide road grading and snow
removal services on certain roads within the boundaries
of the Town of Hudson.
2 . That the County shall furnish and supply all labor,
supervision and equipment for said services.
3 . The Town shall submit in writing to the County a
request for road services, specifying the particular
roads to be worked on and the proposed date for
completion. Such work order must be approved by both
the Town and the County prior to commencement. The
Town understands that County projects will be given
priority and that grading and snow removal will be
scheduled so as not to interfere with County work.
4. The Town agrees to pay the County for the services
rendered under this agreement at the cost incurred by
the County. The Town understands that this cost will
vary in accordance with the salary of the personnel
completing task and the equipment used, but the average
cost will be approximately $35.00 per hour as of the
date of this agreement. County reserves the right to
raise said average cost at any time without prior
approval of Town.

County shall bill Town on a periodic basis for those
services which have been performed in said period.
5. The County understands that it will not necessarily be
the exclusive contractor for this type of service and
that Town may employ whomever it determines to be most
adequate to perform such services.
6. The Town will name the County as an additional insured
for the purposes of carrying out the duties specified
in this Agreement. A certificate naming the County as
an additional insured will be provided to the County.
7. This agreement shall run from year to year unless
terminated by either the Town or the County, providing
the party seeking to terminate this agreement gives the
other party ten (10) days written notice.
