RESOLUTION
RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION NO. 1562 - KRAMER
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the request for Recorded Exemption No. 1562 was submitted by Larry
Kramer, Nugget Electric Company, for property which is located in part of the Si
of Section 29, Township 1 North, Range 66 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 25.5 acres and 4.5 acres, more or less, and
WHEREAS, after reviewing the Planning staff's concerns and hearing the
testimony presented, the Board determined that said request shall be denied for
the following reasons:
1. It is the finding of the Board of County Commissioners that this
proposal evades the purpose of the Weld County Subdivision Ordinance
as defined in Section 1.3.
2. It is the finding of the Board of County Commissioners that this
proposal does not meet the requirements of the Weld County
Subdivision Ordinance as specified in Section 11.5.1. The City of
Brighton has submitted an unfavorable recommendation for said
proposal.
3. It is the finding of the Board that this proposal is not consistent
with the Weld County Comprehensive Plan and does not promote
efficient and orderly development or maintain and encourage
agricultural development.
4. It is the finding of the Board that access from a public road is not
clearly delineated by proper access easements or agreements and has
not properly been determined at this time.
5. It is the finding of the Board that the applicant has not clearly
shown adequate water is available for the use for which this
property is proposed.
6. It is the finding of the Board that this proposal does not meet the
intent of the Recorded Exemption process.

Dear Commissioners:
Larry Kramer has requested a Recorded Exemption to occur on Section 29, T1N, R66W
of the 6th P.M. , Weld County, Colorado. The applicant is proposing to divide the
30 acre parcel into a 4.5 acre and 25.5 acre parcel. The parcel of land under
consideration is the total contiguous landholdings of the applicant. The parcel
of land is located within the Urban Growth Boundary of the City of Brighton. The
City of Brighton reviewed this application and recommended denial. Land use
proposals within an Urban Growth Boundary are encouraged so long as they conform
to the desires of the municipality effected.
Based upon the Weld County Comprehensive Plan, Weld County Subdivision Ordinance,
City of Brighton referral, and public input, the Department of Planning Services'
staff recommends this request be denied.
In September 1987 the applicant applied for and administratively received RE-1058
on this same parcel of land which split a 3.4 acre parcel for a residential
dwelling from a 33.35 acre parcel. The purpose for the Recorded Exemption stated
by the applicant was to enable the owner to complete a sale contract on the land)
and to enable the owners to obtain the cash necessary to further improve their
property. The applicant is now requesting to further subdivide this property
using this same rationality. The Comprehensive Plan allows a great deal of
latitude in determining the intent of the Comprehensive Plan; however financial
need does not merit a Recorded Exemption.

It is the opinion of the Department of Planning Services' staff that this
application does not meet the intent of the A (Agricultural) zone district. The
agricultural zone district was established to maintain and enhance agricultural
production. This request does not enhance nor encourage agricultural production.
In fact, this recorded exemption will enable another residence and additional
people to reside in this area.
The surrounding properties are primarily agricultural or agricultural support in
nature, and staff is concerned with the conflict between rural and urban uses.
The Comprehensive Plan discourages urban uses in rural areas which impede the
agricultural lifestyle. Efficient and orderly development cannot be maintained
with this request. Not only is this the second request for a recorded exemption
on this same 30 acre parcel, but approval of this request will create a linear
subdivision. This linear subdivision will front onto Weld County Road 4 1/4 (a
private road) which does not appear to have an access for proposed Lot A.
Staff has reviewed numerous letter and telephone calls in opposition to this
request. The surrounding property owners do not want additional traffic or use
on Weld County Road 4 1/4. Nor do they desire more residential development in
this area.
The Department of Planning Services' staff recommends denial of this request
based upon a lack of compliance with the Comprehensive Plan, lack of efficient
and orderly development, and public opposition to this request.

CONDITIONS OF APPROVAL

1. Prior to recording the plat the applicant shall apply for and receive a
principal dwelling zoning permit for the mobile home on the property.
2. Prior to recording the plat the applicant shall obtain an easement and an
agreement for joint maintenance si5ed by all applicable owners of Weld
County Road 4-1/4. Prior to recording this agreement with the Weld County
Clerk and Recorder the Department of Planning Services shall determine if
the agreement addresses the easement and access concerns associated with
this site. In lieu of this agreement the Department of Planning Services
shall accept a court decree delineating easement and maintenance of Weld
County Road 4-1/4.
3. Any existing septic system(s) which is not currently permitted through the
Weld County Health Department will require an Individual Sewage Disposal
System Evaluation prior to the issuance of the required septic permits.
4. An Individual Sewage Disposal System must be located at least 100 feet
from any well.

We have reviewed the above referenced referral . The Fort
Lupton Planning Commission feels this referral should be sent
to Brighton and/or Lochbuie as it is out of our jurisdiction.
The commission recommends clarification be made in the
following areas :
1) How many acres are to be included in the
exemption? The first sheet says 4 . 5 acres and the following
sheet says 3 .4 acres .
2 ) How many other exemptions have been made on this
property and when were they done?
3 ) The coimnission recommends that copies of the

This letter is in response to the application by Nuggett Electric
(Larry Kramer) for a recorded exemption which would lie adjacent
to or near our properties . On the outset, we would like it to be
documented that we are completely opposed to such an exemption
for the following reasons :
1) The reason for the exemption is to sell the smaller
parcel to a realto.r who moved a trailer onto this
land 5 years ago, without a permit . He has stated
that his intent is to rent the trailer.
2) Nuggett Electric applied for and received their 1st
recorded exemption in 1987 for the 3.5 acres that now
belong to the Truax's . This 3. 5 acres included an
established (1907) residence, garage, and outbuildings.
Now, 5 years later they are applying for their 2nd
recorded exemption to split 4. 5 acres of their re-
maining ground, merely for profit. If this recorded
exemption is allowed, the possibility exists that
they will continue to apply every 5 years and make
this a. "subdivision" type of area, similar to
Aristocrat Acres .
3) The owners of the only access road to the property
in question are against a recorded exemption, which
would create a new residence, and therefore additional
traffic on their road.
4) It appears that the remaining property would not
have any access allowing farm machinery to it. Our
concern is that the remaining farm ground will become
a 24 acre weed patch or a dust bowl.
5) The trailer on the recorded exemption property has
been sitting here unoccupied and falling apart for 5
years on the pretense that it was for a farm-hand.
The only progress in 5 years has been on September 20,
1993 when a well was drilled. After checking with
the State Water Commission, this well permit was
issued and water was allocated for 29 acres, not 4 . 5 .
A letter verifying this and recommending no additional
splits after the 1987 recorded exemption was sent
to Mr. Keith A. Schuett from the office of the State
Engineer.

6) We do not believe that the 4 . 5 acres will be
maintained adequately, because we know it will be
used as a rental property, as has been stated by
Ken Lambert . The weeds on the entire 4. 5 acres
have only been mowed 1 time in 3 years .
7) There are only old established residences on this
private road. A trailer and or a rental residence
is not at all compatable or acceptable to this
area or its property owners.
8) The sole purpose of the recorded exemption is for
financial gain by Nuggett Electric and the realtor
purchasing the 4. 5 acres . If the county is going
to start allowing recorded exemptions of this type
we are concerned it will encourage more property
owners in this area to apply for the same type of
recorded exemptions.
We appreciate your consideration of these concerns and will be
present if this recorded exemption application is brought to a
hearing, to answer any questions and to further justify our pos-
ition in this matter.

We live on the corner of Weld County Road 4 and what the county
is calling Road 27 1 /2 . We own the portion of the road that runs
the length of our property . This road is legally used by the
current residents of Road 4 1/4 . We feel there are already too
many cars and trucks traveling down this road .
If the county allows this recorded exemption from Nuggett
Electric , creating a new parcel of ground and a new residence ,
you will be allowing more traffic down a private road , which we
own part of and are opposed to .

To Whom It May Concern ,
The subject matter of this letter concerns my going on record as
a party clearly opposed to the agricultural zoning or recorded
exemption that either has been , or will be applied for on Weld
County Road 4 1/4 by Nuggett Electric ( Larry Kramer ) .
The reasons I am opposed to this action are too numerous to
mention entirely in this script, so I will attempt to maintain
brevity by listing some of the more important items of note .
First, my neighbors and I have placed numbers of thousands of
dollars , over the years , in agricultural business , due in large
part to the assurance of this area being zoned agriculture .
Second , the parties involved in this money making scheme have
either not been a part of this neighborhood at all , or have been
grossly inconsiderate of the needs , rights , and privacy of their
neighbors .
I believe business investment is carefully made with
consideration of all factors . The proper zoning for any business
is directly related to how many dollars are tied to the long term
investment. This principle also applies to the business of
agriculture . Most of my investment dollar , as is most of my
neighbors , is attached to agriculture .
I do not think Nuggett Electric ( Larry Kramer) has taken into
consideration that this access road is privately owned by my
mother , myself, and the Kilker ' s . As owners of the road , we are
not willing to allow anymore right of ways to any property owners
which create new residences .

The well permit enclosed is for the smaller parcel
to be split from Lot 2. There is an existing well on
that property serving the mobile home.
Larry Kramer tells me the well on the remainder of
the property was drilled in 1945 when no permits were
necessary so we cannot furnish that evidence.
The parcel to be split is a result of the contract
with Lambert-Brookman. I have enclosed a copy showing
approximate size. Kramer has not had the 4.5 acres
surveyed as yet since he did not want any more expense.
Pending approval, we will furnish you a survey if needed.

APPLICATION STATEMENTS
A. The purpose and reason for dividing this acreage into two
separate lots is for completion of the sale of 4 .5 acres
for purposes of residential living.
B. The applicant believes the proposal is consistent with
the policies of Weld County Comprehensive Plan in that

CONDfIIONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction and Pump Installation Rules
2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well
Construction and Pump Installation Contractors in accordance with Rule 17.
3) Approved pursuant to CRS 37-92-602(3)(b)(I) and policy of the State Engineer under the following conditions.
4) The use of ground water from this well is limited to ordinary household purposes inside one single family dwelling,
the watering of domestic animals, and the irrigation of not more than 43,560 square feet (1 acre) of home gardens
and lawns.
5) Production from this well is restricted to the Lower Arapahoe aquifer which corresponds to the interval between
105 feet and 335 feet below ground surface. Plain casing shall be installed and sealed to prevent production from
other zones.
6) The maximum pumping rate shall not exceed 15 GPM.
7) The annual amount of ground water to be withdrawn shall not exceed 3 acre-feet.
8) The return flow from the use of the well must be through an individual waste water disposal system of the type so
that not less than 4% of the total amount of water withdrawn is returned to the same stream system in which the
well is located.
9) This well shall be constructed not more than 200 feet from the location specified on this permit.
Note: To insure a maximum productive life of this well, perforated casing should be set through the entire
producing interval of the approved zone or aquifer indicated above.
Note: This proposed well would be the only well producing from the Lower Arapahoe aquifer on Lot 2, Weld County

Dear Mr. Daniels-Mika:
• We have reviewed the above referenced proposal to split a 4.5 acre lot from a 29.5 acre
parcel. The smaller lot is to be for agricultural residential use and the larger lot is to be for
agricultural use. The water supply for the smaller lot is to be from an individual on lot well with
permit No. 171402. This well was permitted as the only well issued under CRS 37-92-602(3)(b)(1)
on the 29.53 acre parcel. The water supply will be the larger lot is to be an unregistered well
constructed prior to 1972 in the non tributary Laramie Fox-Hills aquifer. The lot owners have
previously applied for a permit for a well in the Laramie Fox-Hills (expired permit No. 038348-F),
and our evaluation indicated that the appropriation for the well would be limited to 2.5 acre feet
• annually based on a 100 year aquifer life.
We have no objection to this proposal and recommend approval contingent upon the
applicant late registering the Laramie Fox-Hills well.

We have received additional information concerning the above referenced
proposal and an earlier proposal (RE-1058). It appears that the water supply
for the 29.953 acre tract is an old unregistered well . The well (Permit No.
20988R) referred to in our letter ditid February 9, 19$8 is located on an
adjacent tract. Therefore, as long as this is the only expanded use of the
existing well, we have no objections to this proposal .
It should be noted, however, that the earlier split (RE-1058) was based

Dear Ms. Daniels-Mika:
We have reviewed the wells involved in the above referenced proposal to split 4.5 acres from
a 29.5 acre parcel. The 29.5 acre parcel was the resultant of a previous split of 3.5 acres from a
33.35 acre parcel. The water supply for that split was in part an inhouse use well for the 3.5 acre
lot. The owner of the 3.5 acre lot has constructed a well into the Laramie Pox-I Tills aquifer,permit
No. 151834.
Exemption RE-1551 splits 4.5 acres from the 29.5 acre parcel. The water supply for the 4.5
acre lot is a well,permit No. 171402,which was issued to the 29.5 acres and has been constructed
into the Lower Arapahoe aquifer, apparently located on the proposed 4.5 acre lot. The 29.5 acre
lot has an existing well located in the southeast corner of the lot. This well is reported to serve two
houses. One of the houses may not be located on the lot. The well was drilled prior to 1972, and
was constructed into the Laramie Pox Hills aquifer. The land owner has made application(Receipt
No. 363150) to late register this well and that application is being processed and a permit is
expected to be issued.
There will be no additional well permits available for this property without a Water Court
decreed plan for augmentation.

approval criteria of the Weld County Subdivision Ordinance, you will be notified

Dear Mr. Truax:
My clients have been made aware of certain information
concerning their purchase of a parcel of property from Nugget
Electric which is adjacent to your property. It appears that you
have become an active participant in the contractual arrangements
between the parties, and it appears further that your conduct may
constitute intentional interference with the contractual
obligation between Nugget Electric and my clients.
When this matter came to my attention, I reviewed all of the
elements of liability for tortious interference with contracts
and it appears, assuming that the information furnished to me is
true, that you may have some liability to my clients in the event
that the contract to purchase is not performed by or terminated
by Nugget Electric. Essentially, the elements are as follows:
1. Lambert and Brookman have a contract with Nugget
Electric in which Nugget Electric has agreed to convey a certain
parcel of property upon payment of some certain consideration.
2 . You are aware of the contract.
3 . With your knowledge of the contract, you, by words,
conduct or both, have induced or attempted to induce Nugget
Electric, through its agent, Larry Kramer, to terminate the
contract or interfere with the performance of the contract,
causing the contract not to be performed with my clients.

4. Your words or conduct or both must be deemed to have
caused Lambert and Brookman damages or losses.
Based upon what I have observed over the past several
months, it would appear that you have become an active
participant in this matter, and in the event that a contract is
not fulfilled between Nugget Electric and my clients, you may
then be subject to liability for the projected losses which my
clients could prove as a result of the noncompletion of the
contract.
Knowing you for as long as I have, I was relatively certain
that you were unaware of this potential liability and felt it
appropriate to advise you at this time that your activity and
efforts to stop the closing of this contract may not be a wise
choice on your part as your ultimate liability may be significant
due to the losses my clients would sustain in the event that this
contract does not close.
I would hope that we could look forward to an amicable
working relationship in the future, and would look forward to
your support of the completion of this contract or at the very
least, noninterference.

• We have reviewed the above referenced proposal to divide a 33.353 acre ` }
parcel into tracts of 29.953 and 3.40 acres. It appears that each tract has
a house and an old unregistered well. No new wells are requested. La long '
as the wells have been used since prior to 1972 for fire protection, ordinary 4
household purposes inside a single-Easily dwelling, the watering of domestic
animals, and irrigation of less than one acre of lawn and garden, we recom-
mend approval of this proposal.

Based upon the information
conversation with Mr. Jim McDanold of our we o would like telephone
the
following comments to our response dated February 26, 1988. Your field
inspection of the property disclosed that the old unregistered well located on
the 29.953 acre tract is presently serving three homes, one on the property,
one on the 3.4 acre tract, and one on another adjacent tract. If this is the _
case, we would not be in favor of the addition of the mobile home to this well.

• Should the applicant apply for and obtain the in-house well permit for
the 3.4 acre tract as described in our earlier letter, and then remove that
house from the old unregistered well, we would not object to the mobile home -`
being added to the unregistered well on the 29.953 acre tract.
