RESOLUTION
RE: ASSESSMENT OF COST OF IMPROVEMENTS FOR WELD COUNTY ROADS 15 AND 84 LOCAL
IMPROVEMENT DISTRICT NO. 1991-2
WHEREAS, the Board of County Commissioners of Weld County, Colorado, -r
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested �.
with the authority of administering the affairs of Weld County, Colorado, and a U'
WHEREAS, in accordance with CRS, Section 30-20-607, as amended, a statement
of expenses and apportionment has been filed with the Weld County Clerk to the T T
n
Board by the Weld County Engineer, which is attached hereto as Exhibit B, and
WHEREAS, pursuant to CRS, Section 30-20-608, there has been proper notice
of this hearing and of the cost of the improvements, and the share to be assessed
to each lot, and

WHEREAS, the Board of County Commissioners finds that the properties ;
described herein, which includes those properties described in Exhibit A, which .2 C
is attached hereto and incorporated herein by this reference, have been
specifically benefitted by the construction of the improvements authorized under
the Resolution of September 4, 1991, for the following reasons: `
A. The market value of each of the properties will increase;
B. The proposed improvements will adapt the property to a more ; +
profitable use;
C. There will be an alleviation of fugitive dust, eliminating the r
health hazards to the benefitted properties and to users of the
public roads to be improved; o
D. The alleviation of fugitive dust will reduce maintenance costs to
the subject properties and paving will lessen the maintenance
required for a public road; and
E. The proposed improvements will facilitate access to each of the
properties and thereby increase the convenience of the use of said c. Li
property.
WHEREAS, copies of the Resolution creating this Local Improvement District
have been provided to the Division of Local Government and the Weld County
Treasurer and Assessor, and
WHEREAS, at the time and place set forth in the notice, the Board of County
Commissioners met in open session for the purpose of hearing and considering any
complaints, objections, and protests that might be made against the proposed
assessments and there being only one protest, complaint, or objection, presented
by representatives of the Mill Trust, and

WHEREAS, the Board reaffirms that no change or modification is necessary
in the interest of equity and justice, because the property owned by the Mill
Trust will be specially benefitted as other properties being assessed are
similarly situated with respect to the improvements, and

property assessed is benefitted, the amount of the assessment, and that the CO w

A. That a local improvement district for the construction and m
installation of street improvements, to include shaping, grading,
drainage, preparation of the base and grading, compaction, andc.°71
paving, together with any necessary incidentals on a certain County H E
Road as hereafter described, was created and established in H
accordance with the laws of the State of Colorado, and is known as
"Weld County Roads 15 and 84 Local Improvement District No. 1991-2." C
All proceedings heretofore taken by the Board of County
Commissioners and the County staff and then adopted in connection x f
with the district are hereby ratified, approved and confirmed. The a
proposal to create said district was initiated by the Board of N
County Commissioners by Resolution of July 10, 1991, upon a °J
petition, proper in form, subscribed by a majority of the owners of a
property who will bear the cost of more than 1/2 of the total C
proposed assessment in the district and notice duly given as [nom
heretofore stated. o

B. That the property to be assessed for said improvements shall be the
properties specifically benefitted by said improvements and more o n
particularly described as follows:

The area to be included within the district includes those
properties described in Exhibit A, which is attached hereto and
incorporated herein by this reference.
C. That the Statement of Expenses and Apportionment, attached hereto
and incorporated herein by this reference as Exhibit B, has been
submitted based upon the fact that there has been completion of the
entire local improvement as previously authorized.

D. That the assessment, as set forth in the attached Exhibit B, per lot
or parcel being levied for the improvements shall be due and payable
within thirty (30) days after the effective date of this assessing
Resolution. However, all such assessments may be paid at the
election of the owner in ten (10) equal annual installments of
principal together with installments of interest on unpaid o
installments at an interest rate of nine percent (92) simple ,—, w
interest per annum. The first of said installments of assessment rn w
shall be due and payable at the same time as ad valorem property
taxes for the year 1992, due and payable in 1993, and similarly in rvj
each successive year thereafter until all are paid in full. n

F. The Clerk to the Board shall prepare a local assessment roll, in a rn
cooperation with the Weld County Treasurer and Accounting z
Department, in a form showing in suitable columns, each parcel of w C
land assessed, the total amount of assessment, the amount of each
installment of principal and interest if, in pursuance of Part 6 of z
Article 20 of Title 30, CRS, the same is payable in installments,
and the date when each installment will become due, with suitable n1/4O
columns for use in case of payment of the whole amount or of any
installment or penalty, and shall deliver the same, duly certified,
under the County seal, to the County Treasurer for collection.

G. Failure to pay the whole assessment prior to March 2, 1992, shall be n
a conclusive determination and held to be an election on the part of o
all persons interested, whether under disability or otherwise, to
d
pay in such installments. All persons so electing to pay in p ro
installments shall be conclusively held and considered as consenting
to said improvements. Said election shall be conclusively held and m o
considered as a waiver of any right to question the power or d
jurisdiction of the County to construct the improvements, the
quality of the work, the regularity or sufficiency of the 2 w
proceedings, the validity or correctness of the assessments, or the
validity of the lien thereof. n o

H. That all Resolutions or parts thereof in conflict with this
Resolution are hereby repealed.
I. Failure to pay any installment, whether principal or interest, when
due shall cause the whole of the unpaid principal to become due and
collectible immediately, and the whole amount of the unpaid
principal and accrued interest shall thereafter draw penalty
interest at the rate of one percent (1%) per month from the first
day of May until the day of payment, or until the day of sale. In
computing the amount of penalty interest due under this section, any
portion of a month shall be counted a whole month.

J. That all Resolutions or parts thereof in conflict with this
Resolution are hereby repealed, but all portions of the Resolution
indicating the intent to create the District not in conflict with
the provision of this Resolution are re-enacted as if set forth
herein.
K. The effective date of this Resolution shall be February 1, 1992. CO

$409,657.44. to

generate $66,500.00. That totals $357,600.00 which is less than the cost of z
construction. Therefore, all the parcels in the district should be assessed
$3,500.00 in accordance with the improvement district petition. r7

Dear 3-:
The Board of Weld County Commissioners, on January 8, 1992, approved the
assessment of costs for the Weld County Roads 15 and 84 Local Improvement
District No. 1991-2. Pursuant to the Resolution, your lot or parcel has been
assessed $4-. You may pay this amount to the Weld County Treasurer prior to
March 1, 1992. When making your payment, please advise the Treasurer's Office
that the payment is for the assessment concerning the Weld County Roads 15 and
84 Local Improvement District No. 1991-2.
Should you choose not to pay in full by March 1, 1992, you may pay in ten (10)
equal annual installments of principal together with installments of interest on
unpaid installments at an interest rate of nine percent (9%) simple interest per
annum. A copy of the amount of installments due is enclosed. This amount will
be separately billed to you after January 1, 1993, along with your property
taxes. Please note that the interest will accrue in full on January 1 of each
year.

County Planner, Lanell J. Curry dated December 11, 1989 , a copy
of the Deed and a copy of the parcel identification map. The
Property listed as parcels 013 and 018 were purchased as one
parcel by Elmer and Shirley Remmenga. Therefore in preparing the
petition for a Improvement District for the paving of Weld County
Road 15 north of Highway 14, Elmer and Shirley Remmenga should be

As property owners, you are probably aware that there are efforts to
improve Weld County Road 15 from State Highway 14 north for 3.3. miles,
and Weld County Road 84 between Weld County Roads 13 and 15.
This is to notify you that a meeting with the board of County
Commissioners concerning the Local Improvement District will be held at
10:00 a.m. on July 10, 1991, in the First Floor Hearing Room, Weld County
Centennial Center, 915 Tenth Street, Greeley, Colorado. The purpose of
this meeting will be to consider the adoption of a preliminary order and
preliminary plans and specifications, which would describe the materials
to be used, the number of installments and the period of time in which the
cost of improvements shall be payable and the property to be assessed.
The preliminary order will also contain the cost estimates and approximate
amount to be assessed on each property. A great deal of this information
is now contained in your petition.

Dear Greg:
I have reviewed the material you supplied me by your letter of
May 3 , 1991, regarding whether or not your parents ' property
described at Reception No. 1388076 in the records of the Weld
County Clerk and Recorder constitutes two parcels which would be
subject to separate assessments should the Local Improvement
District for Weld County Road 15 be created. Based upon my
understanding that your parents do not view this as two separate
parcels , given the letter of December 11 , 1989 , from Lanell J .
Curry of the Department of Planning Services , and the fact that
your parents obtained title through a document which does not split
the 3 . 5 acres south of the East Half of the Northeast Quarter of
Section 31, Township 8 North, Range 67 West of the 6th P .M. , off as
a separate parcel, it would be my opinion that your parents should
not have two assessments against the parcel if the road is financed
through the Local Improvement District .
By copy of this letter, I am advising the Weld County Engineers
Office and the Clerk to the Board ' s Office that your parents '
property should be subject only to a single assessment for the Weld
County Road 15 Local Improvement District based upon the
information I currently have available. Thank you for your
attention to this matter.

NOTICE OF COMPLETION OF LOCAL IMPROVEMENT
WELD COUNTY ROADS 15 AND 84 LOCAL IMPROVEMENT DISTRICT NO. 1991-2
STATEMENT OF COST; AND PORTION TO BE ASSESSED UPON EACH LOT
Docket No. 91-35
All owners of real estate and property hereinafter described and all
persons generally, are hereby notified that the Board of County
Commissioners of Weld County, Colorado, has received a Notice: of
Completion, Statement of Expenses, and Apportionment regarding the Local
Improvement District within unincorporated Weld County, Colorado,
designated as Weld County Roads 15 and 84 Local Improvement District No.
1991-2, all in accordance with the laws of the State of Colorado. The
property within the Local Improvement District is described in the
attached Exhibit "A".
1. All persons are further notified that the whole cost of the
improvements as has been completed is to be $409, 657.44 which
excludes any costs which have been assumed by the County in terms of
engineering and administrative fees. The costs to be apportioned to
the landowners in the local improvement district are a portion of the
costs of the labor and materials for installation of hot bituminous
pavement and base preparation which is to be apportioned equally
among the nineteen parcels in an apportionment of $3, 500.00 per
parcel or $66,500.00 for the district. No portion of the costs will
be paid by a district-wide sales tax.
2. Any owner of the affected lots may file a complaint or objection in
writing addressed to the Weld County Board of County Commissioners,
915 10th Street, P.O. Box 758, Greeley, Colorado 80632, which
objection must be filed within twenty (20) days from the publication
date of this notice. Any complaint or objection properly made will
be heard and determined by the Board of County Commissioners before
the passage of any Resolution assessing the costs of the
improvements.
3. The hearing where such complaints or objections will be heard will be
on the 8th day of January, 1992, at or about 9:00 a.m. , in the First
Floor Meeting Room of the Centennial Center, 915 10th Street,
Greeley, Colorado.
