RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #1671 -JONES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1671, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption#1671 was submitted by Kenneth C. and
Janice T. Jones, 20799 Weld County Road 28, Hudson, Colorado 80642, for property which is
located in part of the S 1/2 NE 1/4 of Section 8, Township 4 North, Range 64 West of the 6th P.M.,
Weld County, Colorado, being more particularly described in the plat which shall be provided by
the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS,this request is to divide the property into parcels estimated to be approximately
7 acres and 73 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption#1671 submitted by
Kenneth C. and Janice T. Jones be, and hereby is, approved conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
2. Prior to recording the plat, the following note shall be placed on the plat:
"No more than one residential access shall be
allowed per legal parcel."
3. Prior to recording the plat, evidence shall be provided to the Department of Planning
Services showing legal access to Lots A and B, or the plat shall show a 30-foot
shared access easement across Lot A onto Weld County Road 53, for the benefit
of Lots A and B.

4. A Weld County septic permit is required for the proposed home, and its septic
system shall be installed according to the Weld County Individual Sewage Disposal
System (ISDS) regulations. An ISDS evaluation by the Weld County Health
Department on all existing septic systems will be necessary prior to issuing the
required septic permits on the existing systems.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 14th day of November, A.D., 1994.

Dear Commissioners:
This request for a recorded exemption is submitted by Kenneth C. and Janice T. Jones. The parcel
of land on which this request is being made is described as the S2 NE4, Section 8, T4N, R64W of
the 6th P.M., Weld County, Colorado. The property is located approximately 1/4 mile south of Weld
County Road 48 and west of and adjacent to Weld County Road 53. This request is to divide a 80
acre parcel into two parcels of 73 acres, Lot A, and 7 acres, Lot B. Currently both proposed lots
are vacant farm ground. Proposed Lot A has one tank battery located on the Northeast corner.
No residences are presently located on the property. The subject 80 acre parcel was part of a 160
parcel which was purchased by the applicant on August 26, 1994, from Clarence A. Reed and
Vivian N. Reed, who are also applying for a recorded exemption (RE-1670) on the remaining 80
acre parcel.
The applicant has stated that this recorded exemption is to separate approximately 7 acres from
the balance of the 80 acre farm in order to defray the purchase price of the farm. On the remaining
73 acres the applicant intends to build a new home and reestablish the farm to its full agricultural
capacity. In telephone conversation with the applicant he indicated that he does not have water
rights for the subject property. The water rights were sold on October 8, 1986. The applicant
intends to lease water from the Grantee, as stated in the Non-Irrigation Covenant, in order to farm
the land.
The Department of Planning Services' staff has concerns that the proposed division is inconsistent
with efficient and orderly development and with the agricultural goals and policies as stated in the
Weld County Comprehensive Plan. The applicants currently have the legal right to place a single-
family dwelling on the existing 80 acre parcel. This request, if approved, would allow for a
residence on both Lots A and B, greatly intensifying the residential uses on the property thus
reducing the agricultural use of farm ground. The A (Agricultural) zone district was established to
promote and maintain agriculture as a vital support element for Weld County Citizens, and not be
continually decreased for residential development.

The Department of Planning Services' staff has concerns that the proposed division is inconsistent
with efficient and orderly development and with the agricultural goals and policies as stated in the
Weld County Comprehensive Plan. The Comprehensive Plan allows a lot in the A (Agricultural)
zone district to be divided into two separate parcels if the intent of the recorded exemption is met.
This applicant however, is not able to satisfy any of the three established criterion.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider this proposal and determine if the standards of Sections 11.5.1 through 11.5.7 of the Weld
County Subdivision Ordinance have been met.

RECORDED EXEMPTION QUESTIONNAIRE
1 . Explain the reason for the proposed recorded exemption and how
each proposed lot will be used .
The reason for this recorded exemption is to separate approximately 7
acres from the balance of the 80 acre farm in order to defray the
purchase price of the farm . Lot B will be used as a rural
agricultural plot . The property (80 acre) in it ' s entirety has not
been farmed or maintained for a number of years due to previous
owners financial difficulties . Our intent is to build our new home
on the remaining 73 , plus or minus , acres and reestablish the farm to
its full agricultural capacity .
2 . Describe the location , size and present use of the area where
each proposed new lot will be created .
The subject property is located approximately 3 1/2 miles south of
Kersey at the intersection of Weld County Roads 53 and 48 . Proposed
lot B will be approximately 7 acres in size and proposed Lot A will
consist of 73 acres more or less . The present use which exists in
the area is irrigated farming and other agricultural uses .
3 . Explain how the proposal is consistent with the Weld County
Comprehensive Plan and any adopted municipal plan , if applicable .
This proposal is consistent with the Comprehensive Plan of Weld
County in the division of non-productive agricultural property .
4 . Explain how the uses permitted will be compatible with the
existing uses surrounding the proposed recorded exemption .
The uses permitted on both of the proposed lots will be those
currently in plane and allowed under the Agriculture zoning. Uses on
the surrounding properties is the same as those utilized on the
subject proposed Lots A and B. These uses are consistent and very
compatible with the area and will positively impact the appearance of
both proposed Tots A and B and the surrounding area . No change of
use or zoning is sought .
5 . Explain how the proposal is consistent witkthe intent of the
zoning district it is located within.
This proposal is consistent with the intent of the Agricultural
zoning currently in place which allows uses and activities related to
agriculture . Both of the proposed Lots A and B will continue to be
used in a fashion consistent with the past uses , no changes in zoning
and/or use are required or anticipated .

6 . Explain how the proposal is consistent with efficient and orderly
development .
This proposal is consistent with existing uses in the area and would
not have a negative impact on the efficient and orderly development
of the area in any way . This proposal would create lots which are
suitable to and blend in well with the surrounding area and its
current uses .
7 . Explain how adequate provision for the protection of the health,
safety . and welfare of the inhabitants of the neighborhood and the

By adhering to and following all ordinances , regulations , and
requirements as set forth by Weld County . Proper water sources and
sewage disposal methods are or will be installed , access to both
proposed Lots A and B exist from Weld County Road 53 , and sufficient
utilities are available to adequately serve the property .

This Agreement made and entered into this 28th day of November, 1994,by and between SNYDER
OIL CORPORATION,a Delaware Corporation, 1625 Broadway, Suite 2200,Denver, CO 80202,
as First Party, and K.C. JONES, as Second Party;
WITNESSETH:
THAT WHEREAS, First Party has the right of ingress and egress upon and across an access road
located approximately 1/2 mile South of Weld County Road 48 off Weld County Road 53 running
westerly in the E/2 of Section 8, of Township 4 North, Range 64 West, of the 6th P.M., Weld
County, Colorado, to service the Benner #1 and Ruff 8-7I4 gas wells located in the S/2NE/4 of
Section 8, of Township 4 North, Range 64 West, of the 6th P.M., Weld County, Colorado. It is
understood that Second Party is the surface owner on part of the above referenced land and is in the
process of obtaining a Recorded Exemption from Weld County and desires the right to share the use
of the existing access off Weld County Road 53 and the road as it traverses across the above
referenced lands.
NOW THEREFORE,First Party hereby grants Second Party permission to a non-exclusive use of
the access off Weld County Road 53 and the roadway into Second Party's property located in the E/2
of Section 8, Township 4 North, Range 64 West, 6th P.M. It is understood that nothing in this
agreement will adversely affect Snyder Oil Corporation's rights to continue to utilize said access and
roadway.
