a portion of the taxes for the tax year 1991 have been illegally
laid and are eligible for an abatement or refund.

Pursuant to C.R.S . 39-1-104 (d) , the Subject Property should have
identical valuations for the tax years 1991 and 1992 since these
tax years use the same base years . The valuation of the Subject
property was reduced for the tax year 1992, therefore the grounds
for that value are applicable for the tax year 1991 and therefore
a portion of the taxes for the tax year 1991 have been illegally
laid and are eligible for an abatement or refund.
