J U O N o W (9 j Q Z F- — cv v V cn u- co 0 0 0 w 1•- 0) .t co w V) to M c Q� co tl 0 J en o v la aN I 1 N 'O v a a N 3 RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION 51666 - CONNELL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption 01666, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption 51666 was submitted by Robert and Donna Connell, 17845 East Highway 14, Ault, Colorado, 80610, for property which is described as Lot A of Recorded Exemption 0906, being located in part of the SE* of Section 12, Township 7 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 2.5 acres and 1 acre. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption 51666 submitted by Robert and Donna Connell be, and hereby is, approved conditional upon the following: 1. Prior to recording the plat, the applicants shall submit evidence that an Individual Sewage Disposal System (ISDS) evaluation has been completed by the Weld County Health Department on all existing septic systems. No new accesses from either parcel shall be allowed on State Highway 14 or Weld County Road 37. 3. The plat shall be prepared in accordance with the requirements of Section 11. 7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 4. Prior to recording the plat, the applicant shall show on the plat a reserved area on Lot A and on Lot B, with its perimeter being sixty feet (60' ) from the existing centerline of State Highway 14, in which area the applicant and/or his successors in interest cannot build any structures which will require the issuance of building permits. The parcel of land under consideration is Lot A of Recorded Exemption 906, being part of the SE4 of Section 12, T7N, R66W of the 6th P.M., Weld County, Colorado. The property is located west of and adjacent to Weld County Road 37 and north of and adjacent to State Highway 14. Recorded Exemption 906, approved by the Department of Planning Services in 1986, divided a 141.8 acre parcel into two parcels of 138.3 and 3.5 acres, more or less. This request is to divide the 3.5 acre parcel into two parcels of 2.5 acres and 1 acre, more or less. The property lies within the Urban Growth Boundary area of the Town of Ault. An existing residence is on each of the two proposed parcels. The residences are presently served by North Weld County Water District and septic systems for sewage disposal. Access to proposed Lot B is from State Highway 14 and to proposed Lot A from State Highway 14 and Weld County Road 37. Referrals received by staff from the Colorado Department of Transportation, Weld County Public Works Department and Environmental Protection Services all indicated no objection to this request. The Department of Planning Services' staff recommends conditional approval of this recorded exemption proposal. The applicants are planning no change in land use and desire only to sell one of the residences located on the property. It is the opinion of the Department of Planning Services' staff that this request does comply with the standards of Section 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance. Connell Application for Recorded Exemption, and offer the following comments: RIGHT-OF-WAY Right-of-way has not been addressed by the submittal; however, projected traffic along SH 14 indicates the need for a 150 foot total ROW, 75 feet each side of the highway centerline. Additional width to meet this projected need should be protected by reservation or, preferably, dedication as permitted by County regulations. ACCESS The application states that both parcels of the property are to continue their existing use and that no new construction is planned. The application further states that there are existing dwellings on both parcels. Since a change of use of the property is not proposed, re-evaluation of access is not necessary at this time. Access to the state highway is controlled by the State Highway Access Code, and the subdivision of property requires that access be brought into conformance with the Code at such time as property changes use. Conformance with the Code along this section of SH 14 would require that a single access for the 3 .5j acres be provided only if access cannot be achieved by way of general street system. The applicant should be aware that at such time as a change of use for either parcel would be proposed, the Department would have a warrant to re-evaluate access. The re- evaluation could require closure, relocation or improvements to the overall access picture. The plan does not show any existing access to WCR 37. If it is possible to convert access for the property from SH 14 to the county road, that will be required upon any development of the property which results in a change of use as defined by the Code. My comments are based upon the submittal as received September 2B, 1994 . I apologize for not meeting your October 7th deadline and hope that the timing of my comments has not posed a problem for the County planning process.
