'S dai ^•+ CO > '"> ) fir i 'a 980955 i RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 1447 - DAVID AND KAYLEEN HUNT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10) (d) , CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption No. 1447, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption No. 1447 was submitted by David and Kayleen Hunt for property which is located in part of the Ez of Section 11, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 167 acres and 7 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. A Weld County septic permit is required for the proposed home and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 2. An ISDS evaluation by the Weld County Health Department on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The parcel of land on which this request is being made is described as Lot B of RE-1075 located in part of the E2 of Section 11, T6N, R67W of the 6th P.M. , Weld County, Colorado. The property is located approximately one mile south of the Town of Severance, south of and adjacent to Weld County Road 72 and west and adjacent to Weld County Road 23. Access to all lots involved is from Weld County Road 23, which is a paved road. Water will be provided by North Weld County Water District and individual septic systems will provide sewage disposal. There is one dwelling on proposed Lot A of RE-271 and two dwellings on proposed Lot A of RE-1075. There are no other dwellings on the subject lots. These two proposals, if approved, will effectively split the 219 acre parcel into parcels of 45 acres, 7 acres and 167 acres. The applicant' s intent is to sell off the 7 acre and the 45 acre parcels. The 7 acre parcel is a "sprinkler corner" and will be sold as a building site. The 45 acre parcel is flood irrigated and the applicant wishes to sell this off and keep the 167 acres that is irrigated by the center pivot sprinkler. The applicant has demonstrated that the request to split off the 7 acre parcel (sprinkler corner) is consistent with the intent of the Weld County Comprehensive Plan in that the parcel is not irrigated and therefore nonproductive. The applicant also states that the intent of this proposal is to create a more efficient farming operation and not to create a subdivision. However, the staff has concerns about the level of development and the potential for continued divisions in this area. It would be our desire to amend the Recorded Exemption on this farm to keep the approximate South 170 acres separate from Lot B . As we have put a sprinkler system on this South 170 acres and as the equipment and farming practices required are completely different for a sprinkler system as they are for flood ground, we would propose to amend the Recorded Exemption on the farm to exclude the sprinkler system. The natural division for the farm would be at the Law ditch, which is a seepage ditch and flows water year round . The type of soil in the created Lot B is a different type of soil from the soil under the sprinkler system and requires different management than what the sprinkler system requires . We can readily sell this parcel to neighboring farmers that are set up to farm this type of soil . If we get this change made, we will basically have the sprinkler system left , which is what we are set up to farm. The sprinkler system which we put on this farm makes much better use of the water . We have also , at our expense , taken a 1/2 mile dirt ditch that services a neighbor , out from under the sprinkler and replaced it with pipe . Both the sprinkler and this replaced ditch were put on this farm to conserve water , use water more efficiently , and make farming this ground more time effective . If we are allowed to amend the Recorded Exemption as stated above, it would be our further desire to receive an additional exemption on the 174 acre parcel . The approximate 7 acre corner created to the SE of the irrigation system is very inefficient and expensive to irrigate . The soil is poor producing agricultural ground . As there is a paved road and North Weld water adjacent this wasteland, we feel that the natural use for this corner would be as a house site . As there would be no improvements on this 174 acres parcel , this would not go against any county regulations . 92,0 By amending the Recorded Exemption to just include the flood ground to the north of the sprinkler and by allowing an additional Recorded Exemption on the SE corner of the sprinkler system, we will have a much more practical and useful farm. This change will in no way be detrimental to the use of the productive agricultural land on this farm and fit within the county zoning plan . We believe this proposal is consistent with the policies of the Weld County comprehensive plan, and it is also consistent with the zoning district in which the property is located . The existing Lot A of the Recorded Exemption will not be affected by this application. As previously mentioned the purpose of this amendment is to down size the acreage in Lot B . It is our understanding that our intended use will be compatible with the future development of the surrounding area as permitted by the existing zone and with future development as projected by the comprehensive plan of the county . We do not believe that our intended use of this property will be inconsistent with efficient and orderly development . We have also enclosed a letter dated August 12 , 1992 from North Weld County Water District stating water service can be made available to the new Lot B. To the best of our knowledge this property is not located in a flood plane or a geological hazard area . To the best of our knowledge the closest landing strip would be the Greeley Weld County Airport which is approximately 14 miles away from the subject property . We feel there will be no changes made in land uses therefore we respectfully request that we be granted approval on our request for the amendment to our existing Recorded Exemption .
