HomeMy WebLinkAbout920874.tiff RESOLUTION RE: ACTION OF BOARD CONCERNING SHOW CAUSE HEARING TO CONSIDER REVOCATION OF SPECIAL REVIEW PERMIT #965 - JOE KUTCHER AND COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on September 16, 1992, a Show Cause Hearing was conducted to consider revocation of Special Review Permit #965, issued to Joe Kutcher and Company, and WHEREAS, Joe Kutcher is the owner of the facility located on property described as part of the Lots 1 through 6, Block 24, Gill, Weld County, Colorado, and WHEREAS, at the hearing of September 16, 1992, the Planning staff advised the Board that Joe Kutcher and Company is now in compliance, and the Board deemed it advisable to dismiss said matter. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Show Cause Hearing concerning revocation of Special Review Permit #965, issued to Joe Kutcher and Company, be, and hereby is, dismissed. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 16th day of September, A.D. , 1992. Harbert, Pro-Tem Commissioner C. W. Kirby Commissioner Gordon E. Lacy Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Chuck Cunliffe The following business was transacted: I hereby certify that pursuant to a notice dated August 31, 1992, and duly published September 3, 1992, in the Windsor Beacon, a public hearing was conducted to consider revocation of Special Review Permit #965, issued to Joe Kutcher and Company. Lee Morrison, Assistant County Attorney, made this a matter of record. Chuck Cunliffe, Planning Department representative, entered staff's comments into the record as written. He stated the screening is complete, but the west gates and the north side have not been painted. Mr. Cunliffe said he has pictures of the screening, and he explained that Joe Kutcher, permit holder, has oiled the wood so it cannot be painted now. He said an estimate of cost has been submitted, but no performance agreement has been submitted. Mr. Cunliffe said staff recommends continuing said matter to October 7, 1992, and he submitted the pictures for the record. Mr. Kutcher was present and stated plywood was used for screening. He said the west side is painted, and the west gates and the north wall are oiled and cannot be painted now. After discussion, Commissioner Lacy moved to dismiss and close the Show Cause Hearing concerning revocation of Special Review Permit #965, issued to Joe Kutcher and Company. The motion was seconded by Commissioner Kirby. Aleta Craven, surrounding property owner, said she lives about one block from Mr. Kutcher's fence, and he has really improved the area and made it much safer. The motion carried unanimously. On behalf of Mr. Kutcher, the Board explained that no performance bond will be needed. This Certification was approved on the 21st day of September, 1992. APPROVED: ATTEST: /WW1? It is the opinion of the Department of Planning Services' staff that the following Conditions of Approval, as approved for USR-965 are not in compliance. Condition of Approval #3 provided that: "Within 30 days of approval by the Board of County Commissioners, a screening plan shall be submitted to and approved by the Department of Planning Services. The approved screening shall be constructed within 120 days of approval by the Board of County Commissioners . The screening plan shall be shown on the Special Review permit plats. " A screening plan was submitted to the Department of Planning Services on June 29. The plan was not acceptable and another plan was submitted on July 13. This plan was approved, with conditions, by the Department of Planning Services. The screening is completed, but the west gates and north side have not been painted. Condition of Approval #4 provided that: "The applicants shall submit an estimate of costs for the approved screening. The estimated amount shall be reviewed and approved by the Board of County Commissioners. Before the estimate can be approved, the following clarification is needed: 1) The cost of certain items does not appear to be consistent. On the west side of the property, you are estimating 2 x 6 panels at $1.20 each. The 2 x 6 panels on the north side are estimated at $7.50 each. Why is there such a difference in cost? 2) The cost of the 4 x 6 panels appears to be low. Our building inspection department has estimated the cost of these panels at $8.00 each. The cost of the 2 x 6 1/2 inch panels also appears to be low. 3) The reason the estimate of costs must be submitted is so that a performance guarantee can be posted by you. If the screening is not completed, the County could then use the financial guarantee you have provided to complete the screening. Therefore, your estimate of costs needs to include a realistic labor figure for installation of the screening. Please remember that you still need to provide the performance guarantee after the estimate of costs has been approved. Please let me know if you have any questions.
