Dear Commissioners: This request for a Recorded Exemption is submitted by Truman and Elaine Emery. The parcel of land on which this request is being made is described as the S2 of the N2 of the N2 of Section 13, T1N, R68W of the 6th P.M. , Weld County, Colorado. The property is located approximately 1/4 mile north of Weld County Road 8 and west of and adjacent to Weld County Road 13. This request is to divide a 34 acre parcel into two parcels of 21.9 acres and 12.2 acres, more or less. There is an existing dwelling and out buildings on proposed Lot B and a salt water well and natural gas well on proposed Lot A. The applicants have indicated in the application materials that they intend to sell proposed Lot B with improvements and retain Lot A to rent out on a crop share basis. Central Weld County Water District currently provides proposed Lot B with water and is proposed for Lot B. A septic system currently provides Lot B with sewage disposal and is proposed for Lot A. The City of Northglenn, the Town of Frederick, and the City of Dacono have reviewed this proposal and find no conflicts with their interests. The Weld County Health Department and Public Works Department have reviewed this request and both recommend conditional approval. The Department of Planning Services' staff has concerns that the proposed division will be inconsistent with efficient and orderly development and the agricultural goals and policies as stated in the Weld County Comprehensive Plan. The concerns stem from the manner in which the area has been divided previously. The lot under consideration is one of several in a row type development, and was created in 1971. The division of this lot would create a land locked parcel and would require an access easement to access proposed Lot A. 100% of the 34 acre site is identified as prime farm ground of National Importance by the Department 94 072.4 RECOMMENATION, RE-1627 Truman and Elaine Emery Page 2 of Agriculture Soil Conservation Service and the Colorado State University Test Station. We, the property owners, are now retired and want to sell Lot B which contains the existing farm improvements,i.e. , house, barn, and pasture so we can move to a smaller place with less upkeep. We want to retain Lot A which is unimproved land but does provide us income from a salt water disposal well, a gas well and farmland that is rented out on a crop share basis. 2. Describe the location, size and present use of the area where each proposed new lot will be created. Lot A is located at the back of our current property which is described as the south half of the north half of the north half of Section 13, Township One lying east of the Union Pacific Railroad Right-of-Way and contains 12.2 acres more or less of unimproved land and is used primarily as agricultural land. This proposed lot can be accessed by means of an existing road that is maintained by Union Pacific Resources as they have a salt water disposal well there and a natural gas well. Also a small ditch runs through the property on the east end of the proposed lot. 3. Explain how the proposal is consistent with the Weld County Comprehensive Plan and any adopted municipal plan, if applicable. It will remain agricultural land. 4. Explain how the uses permitted will be compatible with existing uses surrounding the proposed recorded exemption. The land surrounding the proposed lot is all used as agricultural on all four sides and our proposal will continue to use the land as agricultural. 5. Explain how the proposal is consistent with the intent of the zoning district it is located within. It is all zoned agricultural and will continue to be used as agricultural. 6. Explain how the proposal is consistent with efficient and orderly development. No change is requested for the use of the land. 7.
