RESOLUTION
RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION NO. 1543 - FURROW
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the request for Recorded Exemption No. 1543 was submitted by
Stanley E. Furrow, for property which is located in part of the W} SW} of Section
18, Township 6 North, Range 64 West of the 6th P.M. , Weld County, Colorado, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 25.351 acres and 14.202 acres, and
WHEREAS, after reviewing the Planning staff's concerns and hearing the
testimony presented, the Board determined that said request shall be denied for
the following reasons:
1. It is the opinion of the Board of County Commissioners that this
proposal evades the purpose of the Weld County Subdivision Ordinance
as defined in Section 1.3.
2. The Board feels this division would be inconsistent with efficient
and orderly development.
3. The Board feels this proposal is not consistent with the Weld County
Comprehensive Plan.
4. It is the opinion of the Board that any further division of these
lots will create additional accesses onto Weld County Road 49 and
will increase the density of the existing linear subdivision.
5. The Board feels this proposal increases the need for more urban-type
services in the area.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request for Recorded Exemption No. 1543, submitted by
Stanley E. Furrow be, and hereby is, denied.

Subject: Recorded Exemption #1543
Dear Commissioners:
Stanley Furrow has requested a Recorded Exemption to occur on part of the W2 SW4
of Section 18, T6N, R64W of the 6th P.M. , Weld County, Colorado. The 39 acre
parcel is located approximately 3.5 miles northwest of the Town of Gill; north
of Highway 392 and east of Weld County Road 49. The parcel of land under
consideration Is the total contiguous land holdings of the applicant.
Based upon submitted information, referral agencies, and the governing mechanism
of the County, the Department of Planning Services' staff recommends this request
be denied.
Originally the applicant owned a 125 acre parcel. From 1978 to the present the
applicant has created 6 buildable lots within Section 18. The applicant is
requesting to divide this section once again. The applicant has invaded the
intent of the recorded exemption process by creating multiple lots without
utilizing the subdivision process. The result is a quarter section which has
been inundated with piecemeal development.
1. The applicant has not demonstrated that this application is consistent
with efficient and orderly development. This is the fifth request for a
Recorded Exemption in the southwest quarter of this section four of which
have been submitted by this applicant:
In August of 1978, Recorded Exemption #332 was approved creating
parcels of 125 acres and 10 acres, more or less. (Furrow)

In June of 1982, Recorded Exemption #550 was approved creating
parcels of 5.7 acres and 4.6 acres, more or less. (Ybarra)
In August of 1984, Recorded Exemption #697 (Furrow) was approved
creating parcels of 115 acres and 10 acres, more or less, which were
part of the 125 acre tract created by Recorded Exemption #332.

In July of 1988, Amended Recorded Exemption #697 was approved,
excluding 36 acres from Lot B which resulted in creating three lots.

2. The conflict between rural and urban activities is evident in this
request. When an urban growth pattern is established without regard to
long range comprehensive planning the outcome lacks the essential elements
of long term desirability. Higher costs are incurred by providing many
public services to urban sprawl areas. As urban areas develop and expand
they inadvertently influence surrounding areas. These areas are either
converted to urban uses themselves or are in direct conflict and
competition with agricultural areas.
3. The applicant has failed to comply with the A (Agricultural) zone district
intent. This parcel is located outside of an Urban Growth Boundary Area.
Continued division of this parcel emphatically opposes the intent of the
A (Agricultural) zone district. The potential to interfere and encroach
upon the agricultural activities of this area is evident. The A
(Agricultural) zone district was established to promote and maintain
agriculture as a vital support element for Weld County Citizens, and not
to be continually decreased for residential development. The Agricultural
zone policies discourage the conversion of agricultural land for
residential uses within an area located outside of an urban growth
boundary. The intent is to eliminate incompatibilities that exist and
minimize costs to Weld County tax-payers.
Instead of applying for and adhering to the subdivision regulations the applicant
has chosen to subdivide the land without regard to the long term impacts of the
divisions. By doing so, the applicant has not been required to pay for the cost
of public services, improvements, and maintenance his previous divisions have
produced. The Department of Planning Services' staff is concerned with this lack
of regard for the Comprehensive Plan and Subdivision Ordinance.

The Department of Planning Services' staff recommendation of denial for this
request is based upon: inconsistency with efficient and orderly development,
conflict with the Comprehensive Plan, and Subdivision Ordinance, and
incompatibility with the A (Agricultural ) zone district. The ability to provide
services under current budgetary constraints combined with current legislative
and growth conditions make future growth management decisions challenging;
however, the elimination of urban sprawl may provide one avenue for conservation
of County funds. The Department of Planning Services' staff requests that the
Board of County Commissioners determine if the standards of 11.2 through 11.8 of
the Weld County Subdivision Ordinance have been met, and if the proposed division
adheres to the Goals and Policies of the Weld County Comprehensive Plan.

REGOP ED EXEMPTION QUESTIONNAIRE
1. Explain the reason for the proposed recorded exemption and how each
proposed lot will be used.
The 14 acre tract is not used because the oil companies' right of way severs it from
the remaining 25 acres. The 25 acres will continue to be used as the applicant's
home, while the 14 acre tract can be used as a family home site.
2. Describe the location, size and present use of the area where each
proposed new lot will be created.
The property consists of 39 acres at the intersection of State Highway 392 and Weld
County Road 49 in the SW} of Section 18, Township 6 North, Range 64, West of the
6th P.M. The 14 acre lot is in the southwest corner of the property at the
intersection of Highway 392 and Weld County Road 49. The 1* acre lot has not been
used since the creation of the oil company row 10 years ago. The 25 acre tract is
the appl capes residence.
3. Explain how the proposal is consistent with the Weld County Comprehensive
Plan and any adopted municipal plan, if applicable.
The proposed confines any further development to the intersection of two major
roadways through Weld County. As such there will not be significant demands upon
resources, as the existing methods of delivery service will continue. The site is
far enough from all municipalities so that it is not affected by any municipal
plans.
4. Explain how the uses permitted will be compatible with existing uses
surrounding the proposed recorded exemption.
The surrounding area consists of a number of single family residences with acreage
attached as well as farm and ranch ground. The utilities, school bus service,
postal routes already pass by this property and can therefore service this property
without altering existing routes.
5. Explain how the proposal is consistent with the intent of the zoning
district it is located within.
The property is in an agricultural zone, and therefore there are a number of single
family residences as well as farms and ranches in the area. The use of the 14 acre
tract as a homesite with some pasture ground will certainly be consistent with such
zoning.
6. Explain how the proposal is consistent with efficient and orderly
development.
The proposal will place the 14 acre tract to beneficial use and will be a positive
change to the neighborhood. Presumably the owner of the 14 acre tract will beautify
the property and maintain it in a manner consistent with other properties in the
neighborhood.
7. Explain how adequate provision for the protection of the health, safety, .
.and welfare of the inhabitants of the neighborhood and the County will be
accomplished.
The healty, safety and welfare of the neighborhood will be sustained and likely
enhanced by placing the property to beneficial use. The beauty of the neighborhood
will be improved by a new home site, and the fact that the property will now be
,ccupied and maintained will promote the better health, safety and welfare of the
eighborhood. 931085

APPLICANT'S SUPPORTING STATEMENT
(a) The reason for submission of the Recorded Exemption Application is
that the smaller tract, approximately 14 acres, is separated from the
remainder of the property by a 1,000' long right-of-way held and used by the
oil companies which have oil wells on this property and adjacent properties.
The applicant has no mineral interests, and therefore has no interest
whatsoever in the wells. The oil and gas right-of-way road has been graveled
by the oil companies, and is used by the oil companies on a daily basis. As a
practical matter, the right-of-way renders the 14 acre tract unusable as farm
or ranch ground. The 14 acre tract is therefore non-productive, and because
it borders upon State Highway 392 and Weld County Road 49, applicant believes
that such tract can be better utilized as a single family dwelling site.
Applicant proposes to continue to utilize the 25 acre tract as his home,
leaving the remainder of the 25 acres in pasture. The 14 acre site could be
utilized as a single family home site, together with pasture for horses.
(b) The proposed 14 acre lot is bordered on the south by State Highway
392 and on the West by Weld County Road 49. Applicant would expect that
access to the 14 acre tract could easily be obtained directly off of Weld
County Road 49. The larger lot, approximately 25 acres in size, is triangular
in shape and lies immediately to the north of the 14 acre lot. It has access
directly from Weld County Road 49, which access will not be affected by
granting the recorded exemption. The 25 acre lot has been the home site of
the applicant for the past 24 years. The 14 acre tract has never been
developed, and the applicant certainly believes that such tract can be put to
productive use as a single family home site.
(c) Applicant's proposal is consistent with the Weld County
Comprehensive Plan in that it confines any the development to acreage which is
near other single family residences, and it borders on State Highway 392 and
Weld County Road 49. There are a number of other homes along Weld County Road
49 and along State Highway 392 near the subject site. The Eaton School
District's buses presently proceed along Weld County Road 49 to pick up and
deliver other school children who reside in the area, and the U.S. Postal
Service regularly stops along Weld County Road 49 to deliver mail to other
residents of the area. The applicant does not believe that the applicant's
proposal for the subject property would conflict with any adopted master plan
of any municipality. The subject property is located approximately five miles
east of the Town of Lucerne and approximately 8 miles southeast of the Town of
Eaton.
(d) Use of the 14 acre tract as a single family home site together with
some pasture ground, will be very consistent with the surrounding uses of
similar properties. There are a number of single family homes together with
small acreages utilized therewith on both sides of Highway 392 as well as on
the east side of Weld County Road 49. The overall area is generally used as
farm ground or pasture ground, and the good roadways and the friendly
residents of the area make the creation of another home in the area very
compatible. By allowing the recorded exemption, the 14 acre tract can now be
put to productive use and can be maintained and beautified by a family
residing upon that property.

(e) The applicant's proposal is consistent with the intent of the
applicable zoning district, since the proposal will not subdivide the property
for any more than one additional single family dwelling site, which site will
have with it approximately 14 acres of ground which can be used as pasture.
Further, the applicant's proposal follows an existing barrier between the 25
acres to the north and the 14 acres to the south, which barrier consists of
the oil companies' right-of-way. The applicant is unable to restrict the
access of the oil companies through the subject property.
(f) The applicant's proposal will be consistent with the efficient and
orderly development of the area, as the additional building site proposed is
located at the northeast corner of the intersection of Weld County Road 49 and
State Highway 392. The property has never been developed, and the applicant
believes that development of the property will be in the best interests of the
entire neighborhood, since the property will presumably be beautified and
maintained by the owner of such property. As stated previously, all of the
necessary utilities can be provided to the 14 acre tract, including postal
service and school buses. The 25 acre site owned by the applicant to the
north of the 14 acre tract will continue to be utilized by the applicant as
his home if the Recorded Exemption Application is granted.
(g) The protection of the health, safety and welfare of the inhabitants
of the neighborhood and the county can be assured, as the property will now be
developed as a single family home site, and therefore the property will
presumably be upgraded and maintained by such family. Thus, the health,
safety and welfare of the inhabitants of the neighborhood and the county will
be furthered by granting the applicant's request. The property under
consideration is located in a flood plain, but it is not located within the
confines of any known geologic hazard or Weld County Overlay District.
Properties near the 14 acre tract have been utilized as home sites, with the
owners building up the home sites to the point that such do not present
concerns in the flood plain. Applicant presumes that such action can also be
undertaken on the 14 acre tract.
(h) The applicant would note that the 14 tract has no existing
buildings upon the property, but water service can be made available by North
Weld County Water District.

1. Explain the reason for the proposed recorded exemption and how each
proposed lot will be used.
The 14 acre tract is not used because the oil companies' right of way severs it from
the remaining 25 acres. The 25 acres will continue to be used as the applicant's
home, while the 14 acre tract can be used as a family home site.
2. Describe the location, size and present use of the area where each
proposed new lot will be created.
The property consists of 39 acres at the intersection of State Highway 392 and Weld
County Road 49 in the SW+ of Section 18, Township 6 North, Range 64, West of the
6th P.M. The 14 acre lot is in the southwest corner of the property at the
intersection of Highway 392 and Weld County Road 49. The 1 . acre lot has not been
used since the creation of the oil company row 10 years ago. The 25 acre tract is
the applicant's residence.
3. -Explain how the proposal is consistent with the Weld County Comprehensive
Plan and any adopted municipal plan, if applicable.
The proposed confines any further development to the intersection of two major
roadways through Weld County. As such there will not be significant demands upon
resources, as the existing methods of delivery service will continue. The site is
far enough from all municipalities so that it is not affected by any municipal
plans.
4. Explain how the uses permitted will be compatible with existing uses
surrounding the proposed recorded exemption.
The surrounding area consists of a number of single family residences with acreage
attached as well as farm and ranch ground. The utilities, school bus service,
postal routes already pass by this property and can therefore service this property
without altering existing routes.
5. Explain how the proposal is consistent with the intent of the zoning
district it is located within.
The property is in an agricultural zone, and therefore there are a number of single
family residences as well as farms and ranches in the area. The use of the 14 acre
tract as a homesite with some pasture ground will certainly be consistent with such
zoning.
6. Explain how the proposal is consistent with efficient and orderly
development.
The proposal will place the 14 acre tract to beneficial use and will be a positive
change to the neighborhood. Presumably the owner of the 14 acre tract will beautify
the property and maintain it in a manner consistent with other properties in the
neighborhood.
7. Explain how adequate provision for the protection of the health, safety,
and welfare of the inhabitants of the neighborhood and the County will be .
accomplished.
The healty, safety and welfare of the neighborhood will be sustained and likely
enhanced by placing the property to beneficial use. The beauty of the neighborhood
will be improved by a new home site, and the fact that the property will now be
occupied and maintained will promote the better health, safety and welfare of the
neighborhood.

problems on this site. No major problem with topography on this site, the
property is flat. There is an irrigation ditch on the southern part of the
property. The site is currently pasture/weeds.

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic
system and shall be installed according to the Weld County Individual
Sewage Disposal Regulations.
2. The existing septic system which is not currently permitted through the
Weld County Health Department will require an I.S.D.S. Evaluation prior to
the issuance of the required septic permit.
3. An Individual Sewage Disposal System must be located at least 100 feet
from any well.
4. An Individual Sewage Disposal System permit must be finalized and approved
by an Environmental Protection Specialist within one (1) year of the
application date.

I have visited the site on WCR 49 just north of State Highway 392.
The site is flat and appears to be used as a pasture area now. There is no
sight distance problem either to the north or to the south at the proposed
access location.
There appears to be a drainage ditch on the west side of the property. I would
like to see a 15" CMP culvert placed at the access to the property.
There are many access points cluttered in this particular area.
