RE: APPROVE CONTINUANCE OF HEARING TO SHOW CAUSE FOR REVOCATION
OF SPECIAI, USE PERMIT #208 - HESSEE
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Pule Charter, is vested with the authority of administering the
-affairs of Weld County, Colorado, and
WHEREAS, on August 29 , 1990 , a hearing was held to show cause
for revocation of Special Use Permit No. 208, held by Richard
P essee, and
WHEREAS, at said hearing the Board was advised that Mr.
Eessee has applied for an Amended Special Use Permit, and the
-Board deemed it advisable to continue said Show Cause Hearing to
November 7 , 1990 , to allow the submitted Amended Special Use
P ermit to be heard by the Planning Commission and the Board of
County Commissioners, and
WHEREAS, at said Show Cause Hearing of November 7 , 1990 , the
-Board deemed it advisable to continue said Show Cause Hearing to
December 17. , 1990 , to allow the Amended Special Use Permit to be
considered by the Board of County Commissioners, and
WHEREAS, at the Show Cause Hearing of December 12 , 1990 , the
Board deemed it advisable to continue said Hearing to March 13 ,
1-991 , to allow the applicant time to submit the necessary
documents to the Planning Department as to their final decision.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hearing to -show
cause for revocation of Special Use Permit No. 208 , held by
Richard Hessee , be , and hereby is , continued to March 13 , 1991 , at
10 : 00 a.m.

RE: SHOW CAUSE HEARING TO CONSIDER REVOCATION OF SPECIAL USE PERMIT
#208 - RICHARD -HESSEE
A public hearing Haas conducted on December 12, 1990, at 10:00 A.M. ,
with the following present:
Commissioner Gene R. Brantner, Chairman
Commissioner George Kennedy, Pro-Tem
Commissioner Constance L. Harbert
Commissioner C.W. Kirby
Commissioner Gordon E. Lacy
Also present:
Acting Clerk to the Board, Shelly Miller
Assistant County Attorney, Lee Morrison
Planning Department representative, Lanell Curry
Health Department representative, Wes Potter
The following business was transacted:
I hereby certify that -pursuant to a notice dated Duly 11, 1990, and
duly published August 16, 1990, in The New News, a public -hearing was
conducted to consider the _revocation of Special Use Permit -#208, issued
to Richard Hessee. Lee Morrison, Assistant County Attorney, made this
matter of record. Lanell Curry, Planning Department representative,
recommended that the loard either revoke the existing Permit or decide
whether or not the additional pens shoulA be removed. She said the
original _Permit allows 3600 head of cattle, and the addition of the
pens is what caused the violation, not the number of cattle. Wes
Potter, Health Department representative, said the run-off facility is
marginal. Mr. Morrison -clarified the options of the Board and the
issue to _be discussed. Michael Callahan, Attorney representing the
applicant, said they would like to amend the Permit to include the four
extra pens with the original number of cattle to remain the same. He
also requested 1�0 -days to make a final decision and submit the
necessary paperwork. Commissioner Lacy Tmved to continue this matter
180 days to allow the applicant to proceed as necessary. Commissioner
Kirby seconded the motion. Commissioner Harbert moved to amend the
motion to allow the applicant only 90 -days. Commissioner Kennedy
seconded the motion. The motion to amend the original motion carried
three to two, with Commissioner Lacy and Chairman Brantner voting nay.
On a roll call vote, the motion to allow the applicant 90 days to
proceed carried three to two, with Commissioner Lacy and Chairman
Brantner voting nay. The hearing was continued to March 13, 1991, at
10:00 a.m.
This Certification was approved on the 17th day of December, 1990.
