RESOLUTION
RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FORA TEMPORARY FREIGHT
RELAY TERMINAL IN THE A (AGRICULTURAL) ZONE DISTRICT - CONSOLIDATED FREIGHTWAYS,
INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant
to Colorado statute and the Weld County Home Rule Charter, is vested with the
authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 30th day
of January, 1991, at the hour of 10:00 a.m. , in the Chambers of the Board for the
purpose of considering the request of Consolidated Freightways, Inc. , c/o Michael
Nelson, 5251 South Quebec Street, Suite 220, Englewood, Colorado 80111 for a Site
Specific Development Plan and a Special Review Permit for a temporary freight relay
terminal in the A (Agricultural) Zone District on the following described property
to wit: 4
North 1/2 of Section 19, Township 11 North, Range 67 West of the 6th P.M. ,
Weld County, Colorado.
WHEREAS, Michael Nelson, authorized agent of Consolidated Freightways, Inc. ,
being present; and
WHEREAS, Sections 24.7 and 24.3 of the Weld County Zoning Ordinance provide
standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, has studied the request of the applicant and the
recommendation of the Weld County Planning Commission and all of the exhibits and
evidence presented in this matter and, having been fully informed, finds that this
request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant
has shown compliance with Section 24.3 of the Weld County Zoning Ordinance
as follows:
a. The proposed use is consistent with the intent of the A
(Agricultural) Zone District and is provided for in the Weld County
Zoning Ordinance as a Use by Special Review.
b. The proposed use is consistent with the Weld County Comprehensive
Plan's Agricultural Goals in that no use of prime agricultural land
will be required.

c. It is the opinion of the Board of County Commissioners that
conditions of approval, Development Standards and the temporary
nature of this proposal will make it compatible with the existing and
future land uses in the area.
d. No overlay districts affect the site.
e. Special Review Development Standards will provide adequate protection
of the health, safety and welfare of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application for a Site Specific Development Plan and a
Special Review Permit for a temporary freight relay terminal in the A (Agricultural)
Zone District on the hereinabove described parcel of land be, and hereby is, granted
subject to the following conditions:
1. The attached Development Standards for the Special Review permit be
adopted and placed on the Special Review plat prior to recording the plat.
2. The Special Review activity shall not occur nor shall any building or
electrical permits be issued on the property until the Special Review plat
has been delivered to the Department of Planning Services' office and the
plat is ready to be recorded in the office of the Weld County Clerk and
Recorder.
3. A site reclamation plan shall be submitted to the Department of Planning
Services and the West Greeley Soil Conservation District for review and
approval. The site reclamation plan shall include a proposal for the
removal of all improvements and the revegetation of the site. The
approved plan shall be incorporated into the application materials.
4. A road improvements plan shall be submitted to the Department of Planning
Services and the Weld County Engineering Department for review and
approval. The approved plan shall be incorporated into the application
materials and shown on the Special Review plat map.
5. The applicants shall submit an estimate of costs for implementation of the
screening plan, the site reclamation plan and the road improvements, and
a proposal for a performance guarantee as allowed in the Weld County
Zoning Ordinance under Section 24.4.3. The estimated amount and
performance guarantee shall be reviewed and approved by the Board of
County Commissioners. The performance guarantee shall be in a form
acceptable to the Board of County Commissioners.

6. The performance guarantee to ensure implementation and completion of the
screening plan and road improvements agreement shall be filed with the
Clerk to the Board for the approved amount. The guarantee shall be
returned to the applicants or released after the improvements have been
satisfactorily completed. If the improvements have not been completed
within 120 days of the date of approval of the Special Review Permit by
the Board of County Commissioners, the County shall take corrective action
to ensure compliance with the approved plans and the guarantee shall be
forfeited.
7. The performance guarantee to ensure implementation and completionof the
reclamation plan shall be filed with the Clerk to the Board for the
approved amount. The guarantee shall be returned to the applicants or
released after the reclamation plan has been satisfactorily completed. If
the plan has not been completed within 120 days of the expiration date of
the Special Review Permit, the County shall take corrective action to
ensure compliance with the approved plans and the guarantee shall be
forfeited.
8. The plat shall be amended to show the correct legal description and
appropriate setbacks from the temporary office trailer.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 30th day of January, A.D. , 1991.

SITE SPECIFIC DEVELOPMENT PLAN
SPECIAL REVIEW PERMIT
DEVELOPMENT STANDARDS

1. The Site Specific Development Plan and Special Review Permit is for a temporary
freight relay terminal as submitted in the application materials on file in the
Department of Planning Services and subject to the Development Standards stated
herein.
2. Approval of this plan may create a vested property right pursuant to Article 68
of Title 24 C.R.S. , as amended.
3. The operation of this facility shall cease within two years from the date of
approval by the Board of County Commissioners. An extension beyond the two year
period shall be considered a major change and a new permit will be required.
4. The Use by Special Review Permit shall not be transferable to any successors in
interest to the prescribed property and shall terminate automatically upon
conveyance or lease of the property to others for operation of the facility.
5. Sources of light shall be shielded so that light rays will not shine directly
onto property outside of the Special Review Permit area.
6. Waste oil, anti-freeze, and other associated liquid and solid wastes, shall be
stored and removed for final disposal in a manner that protects against surface
and groundwater contamination.
7. No permanent disposal of wastes shall be permitted at this site.
8. Fugitive dust shall be controlled on this site.
9. The maximum permissible noise level shall not exceed the industrial limit of 80
dB(A) , as measured according to 25-12-102, Colorado Revised Statutes.
10. All construction on the property shall be in accordance with the requirements
of the Weld County Building Code Ordinance.
11. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
12. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.

Development Standards - Consolidated Freightways, Inc.
13. Personnel from the Weld County Health Department and Weld County Department of
Planning Services shall be granted access onto the property at any reasonable
time in order to ensure the activities carried out on the property comply with
the Development Standards stated herein and all applicable Weld County
Regulations.
14. The Special Review area shall be limited to the plans shown herein and governed
by the foregoing Standards and all applicable Weld County Regulations. Major
changes from the plans or Development Standards as shown or stated shall require
the approval of an amendment of the Permit by the Weld County Planning
Commission and the Board of County Commissioners before such changes from the
plans or Development Standards are permitted. Any other changes shall be filed
in the office of the Department of Planning Services.
15. The property owner or operator shall be responsible for complying with all of
the foregoing Development Standards. Noncompliance with any of the foregoing
Development Standards may be reason for revocation of the Permit by the Board
of County Commissioners.

DISTRICT - CONSOLIDATED FREIGHTWAYS, INC.
A public hearing was conducted on January 30, 1991, at 10:00 A.M. , with
the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 9, 1991, and duly
published January 13, 1991, in The New News, a public hearing was
conducted to consider the request of Consolidated Freightways, Inc. Lee
Morrison, Assistant County Attorney, made this matter of record. Keith
Schuett, Current Planner, represented the Department of Planning Services.
He asked the recommendation of the staff and the Resolution of the
Planning Commission be entered into the record as written. Mike Nelson,
authorized agent, represented Consolidated Freightways, Inc. They are
applying for a Special Review Permit to store vans. They have a two year
lease on the land and are asking this Special Review permit be granted for
a period of two years. If they wish to use the property after two years
they will go through a new permit process. (Tape change #91-03)
Consolidated Freightways will deposit $2,500.00 with the County to pay for
the paving of one hundred feet of pavement. Lee Morrison pointed out
Condition of Approval #3. c. was amended by the Planning Commission and
requires that a performance guarantee be filed with the Clerk to the
Board's office until all reclamation work is done. The Chairman stated
the lack of a performance guarantee at this time should not hold-up the
Board's action. If the Board moves for approval of this request it can be
with the condition that reclamation plans and the cost of reclaiming the
land be worked out with Keith Schuett prior to recording the plat. The
applicant can then post a performance bond, returnable upon satisfactory
completion of the project. There were no public comments. Commissioner
Kirby moved the Board conditionally approve the request of Consolidated
Freightways for a Site Specific Development Plan and Special Review Permit
for a temporary freight relay terminal in the A (Agricultural) Zone
District based on the recommendation of the staff and the Planning
Commission, and that prior to recording the plat a reclamation plan be
agreed upon with the planning staff and a performance guarantee be posted.
The motion was seconded by Commissioner Harbert. Motion carried
unanimously.

PROCEDURE FOR REQUESTING PRE-ADVERTISING
ON A LAND USE APPLICATION
On June 6, 1984, the Board of County Commissioners adopted the following
procedure for requesting pre-advertising on a land-use application:
1. The applicant shall submit a letter to the Clerk to the Board's Office
when requesting pre-advertising for a Board of County Commissioner's
hearing for a land-use application. The letter shall set forth the
reasons why the applicant is requesting the pre-advertisement.
2. The Clerk to the Board's Office shall schedule the request for pre-
advertisement on the first available regular Board of County
Commissioner's meeting.
3. The Clerk to the Board's Office shall inform and furnish a copy of the
letter requesting the pre-advertisement to the Department of Planning
Services.
4. The applicant shall appear at the Board of County Commissioner's meeting
and explain why the pre-advertisement has been requested. The applicant
• requesting the pre-advertisement shall give sufficient reasons why the
Board should approve the request for pre-advertisement.
S. If the Board of County Commissioners approves the request for pre-
advertisement of the land-use application, the Department of Planning
Services shall provide the following information to the Clerk to the
Board's Office:
a. One (1) copy of the land-use application materials submitted
to the Department of Planning Services office by the applicant
when the application was made;
b. One (1) copy of the legal notice prepared by the Department
of Planning Services staff for advertising the land-use
1 application for the Planning Commission hearing;
c. One (1) copy of the list of surrounding property owners and
mineral owners certified to be accurate by the applicant or
an authorized agent; -
d. A written statement signed by the applicant or authorized
agent stating that all costs associated with the pre-
advertisement will be paid by the applicant;

REQUEST: A Site Specific Development Plan and Use by Special Review Permit
for a temporary freight relay terminal.
LEGAL DESCRIPTION: Part of the N1 of Section 19 , T11N, R67W of the 6th
P.M. , Weld County, Colorado.
LOCATION: Approximately 2.5 miles west of the unincorporated Town of Carr;
north and adjacent to Weld County Road 1261, and approximately 1000 feet
east of Interstate 25.
Mike Nelson, representative for Consolidated Freightways, Inc. , submitted a _
request to operated a freight relay terminal between Colorado and Wyoming
off of I-25. He explained that they are allowed to run triples in Colorado
but cannot run them into Wyoming. What they plan to do is run 2 tandems
from Wyoming down, pull into the relay yard, unhook one of the vans and
hook it to other vans so they can run three down to Denver. No onsite
personnel are necessary, a small trailer is required by state law. He
explained that they are not allowed to run during rain, snow or high winds.
It will save them about 800,000 miles per year in costs.
Jerry Keifer wanted to know if this was a recent change in Colorado Law.
Mr. Nelson explained that it has been in effect since 1983.
Ann Garrison asked if the trailers would be loaded and unloaded. She
wanted to know if there would be cargo in them and who would transfer it.

Mr. Nelson said there would be cargo in them, but it would not be
transferred. All the drivers would do is hook or unhook the trailer. No
trailer would be left for more than an hour.
Jean Hoffman wanted to know if there was any problem with the screening
plan that was to be submitted by January 15, 1991.
Mr. Nelson said that he did have a problem with the screening plan. He
feels that the location and the fact that this will be a temporary relay
terminal does not warrant a 14 foot fence.
The chairman called for discussion from the audience.
Larry Thomas owns property three miles to the east of the proposed
facility. He was concerned due to wildlife (foxes) in the area. He stated
that he is a cattle rancher and moves livestock frequently and the terminal
would create a traffic hazard. This is also a school bus route and a mail
route. He feels any screening would be a detriment to snow build up. He
feels that another site could be found so as not to be a hazard in their
area.
Mrs. Thomas is a postal employee and drives the route daily, She stated
that she agrees with her husband about the potential hazard.
The chairman called for discussion from the board.
Jean Hoffman stated that she saw no reason to require screening around a
temporary facility of this nature. It would create more of a hazard and
not really be beneficial to the surrounding community. She felt it was an
unnecessary expense for Consolidated Freightways due to the fact that this
is to be a temporary facility of two years.
MOTION:
Ann Garrison moved to delete 3(a) and any other reference to screening from
the Conditions of Approval of USR-933.
Jean Hoffman seconded the motion.

Dear Brian:
Per the Weld County Planning Commission resolution for USR - 933,
we have prepared the following reclamation plan to be incorporated
into our application package.
Consolidated Freightways Inc. , the tenant, proposes that upon
cessation of their tenancy, will enact the following reclamation
plan:
1. Remove six (6) on site metal light poles.
2. Remove temporay office from site.
3. Remove on site 4 strand barbwire range fence.
4. Remove temporary entrance gate and road, if owner
request.
5. Reshape the site and prepare an adequate seedbed, as
directed by West Greeley Soil Conservation District.
6. Prepare the following seeding mix and revegetate the site

Moved by Ann Garrison that the following amendment to the resolution be

A screening plan to visually screen the south and west sides of the
subject property from Interstate 25 shall be submitted to the
Department of Planning Services for review and approval. The approved

adopted and placed on the Special Review plat prior to recording the
plat.
2. The Special Review activity shall not occur nor shall any building or
electrical permits be issued on the property until the Special Review
plat has been delivered to the Department of Planning Services' office
and the plat is ready to be recorded in the office of the Weld County
Clerk and Recorder.
3. Prior to January 15, 1991 :
(a) a site reclamation plan shall be submitted to the Department of

a proposal for the removal of all improvements and the
revegetation of the site. The approved plan shall be incorporated

(b) a road improvements plan shall be submitted to the Department of
Planning Services and the Weld County Engineering Department for
review and approval. The approved plan shall be incorporated into
the application materials and shown on the special review plat
map.
(c) the applicants shall submit an estimate of costs for
implementation of the site reclamation plan and the road
improvements, and a proposal for a performance guarantee as
allowed in the Weld County Zoning Ordinance under Section 24.4.3.
The estimated amount and performance guarantee shall be reviewed
and approved by the Board of County Commissioners. The
performance guarantee shall be in a form acceptable to the Board
of County Commissioners.
4. Prior to recording the special review permit plat:
(a) the performance guarantee to ensure implementation and completion
of the road improvements agreement shall be filed with the Clerk
to the Board for the approved amount. The guarantee shall be
returned to the applicants or released after the improvements have
been satisfactorily completed. If the improvements have not been
completed within 120 days of the date of approval of the Special
Review permit by the Board of County Commissioners, the County
shall take corrective action to ensure compliance with the
approved plans and the guarantee shall be forfeited.
(b) the performance guarantee to ensure implementation and completion
of the reclamation plan shall be filed with the Clerk to the Board
for the approved amount. The guarantee shall be returned to the
applicants or released after the reclamation plan has been
satisfactorily completed. If the plan has not been completed

1. The Site Specific Development Plan and Special Review permit is for a
temporary freight relay terminal as submitted in the application
materials on file in the Department of Planning Services and subject to
the Development Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Article 68 of Title 24 C.R.S. , as amended.
3. The operation of this facility shall cease within two years from the
date of approval by the Board of County Commissioners. An extension
beyond the two year period shall be considered a major change and a new
permit will be required.
4. The Use by Special Review permit shall not be transferable to any
successors in interest to the prescribed property and shall terminate
automatically upon conveyance or lease of the property to others for
operation of the facility.
5. Sources of light shall be shielded so that light rays will not shine
directly onto property outside of the Special Review permit area.
6. Waste oil, anti-freeze, and other associated liquid and solid wastes,
shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
7. No permanent disposal of wastes shall be permitted at this site.
8. Fugitive dust shall be controlled on this site.
9. The maximum permissible noise level shall not exceed the industrial
limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
10. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
11. The property owner or operator shall be responsible for complying with
the Design Standards of Section 24.5 of the Weld County Zoning
Ordinance.
12. The property owner or operator shall be responsible for complying with
the Operation Standards of Section 24.6 of the Weld County Zoning
Ordinance.

13. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in order to ensure the activities
carried out on the property comply with the Development Standards
stated hereon and all applicable Weld County Regulations.
14. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the
office of the Department of Planning Services.
15. The property owner or operator shall be responsible for complying with
all of the foregoing Development Standards. Noncompliance with any of
the foregoing Development Standards may be reason for revocation of the
Permit by the Board of County Commissioners.

13. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the
property at any reasonable time in order to ensure the activities
carriedcarried out on the property comply with the Development Standards
stated hereon and all applicable Weld County Regulations.
14. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the
Permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the
office of the Department of Planning Services.
15. The property owner or operator shall be responsible for complying with
all of the foregoing Development Standards. Noncompliance with any of
the foregoing Development Standards may be reason for revocation of the
Permit by the Board of County Commissioners.

The property is vacant range land and located approximately 1.000 feet east
of I-25 on the north side of Weld County Road 126i. Weld County Road 126}
has a gravel surface. The property slopes upward to the north and drains to
the south toward Weld County Road 126} , The closest residence appears to be
approximately one mile to the south. The property is visible from I-25 in
both directions. Screening of the property should be considered. The 10
foot setback for the temporary office trailer should be 20 feet. The plat
needs to be amended.

I reviewed the proposed temporary use permit from Consolidated
Freightways , Inc. The proposal is for a 2 acre temporary freight
relay terminal just east of Interstate 25 and north of County Road 126
1 /2 .
The current land use is rangeland. The soils should not present any
limitations for this type of use. One suggestion is to replant the
area to adapted native grasses after the temporary permit expires .
After the site is no longer being used as freight area , I would
suggest reshaping the site and preparing an adequate seedbed . The
following seeding mix can be used to revegetate the disturbed areas :

Comments regarding Consolidated Freightways Special Review
1 . If developed and operated in accordance with the application, there
should be no significant impact on Larimer County.
2 . Development of this use should not be considered as a precedent to
justify other commercial uses at this interchange. Larimer County
Planning would not support an intensive commercial use such as truck
stop, vehicle maintenance facility, shipping terminal, camping area,
etc.
3 . The site should not be used for overnight stays by drivers.

RE: Use By Special Review
The Applicants, Consolidated Freightways Inc. , submit this Use By
Special Review, for the temporary operation of a freight relay
terminal (temporary shuttling and storage of freight trailers) on
leased grazing land from Terry Grazing Assn located in a part of (A
Parcel of Land Located in the North One Half of Section 19,
Township 11 North, Range 69 West of the Sixth Principal Meridian) ,
Weld County, Colorado Colorado. Consolidated Freightways (CF)
needs the ability to either add or drop off a third freight trailer
after leaving or before entering Wyoming. At this time, Wyoming
does not allow the operating of triple freight trailers ( hauling
three 38 ft. vans behind tractor) within their borders, as Colorado
does. CF plans to shuttle the trailers between their bulk transfer
facility in Cheyenne and the proposed relay terminal.
Livestock grazing is the prevalent use in the surrounding
properties at this time and the balance of Terry Grazing Assn.
property is used for summer grazing, except for a gravel mining
operation to the north. The approximate distances to the
surrounding residential structures are as follows:
4,550 feet to the south
2 miles to the north
5,800 feet to the West, in Larimer County
6,250 feet to the east
There will be no buyers, patrons or members visiting the site. The
only user of the proposed site will be CF.
There will be no on site employees, only the occasional truck
driver making up or breaking up the trailers. The relay and
shuttling operation can operate around the clock, but will be
mainly during 5:00 am to 11:00 pm and not during icy or snowing
conditions.
Since there is no on site employee and only a temporary facility,
bottle water will be the only water source and no sewage facility
will be necessary.

Use By Special Review Narrative
Access to the proposed site is off of Weld County Road 126
approximately 300 yards to the east of I-25 at the Carr Exit. All
traffic will exit at Exit 196 then east to the site. Weld County
Road 126 is paved to the entrance to the proposed terminal. There
will be approximately 20 sets of multi-sets of singles, doubles and
triples of 38 foot vans (freight trailers) and tractors per day. At
the max configuration of three 38 foot vans with tractor, will have
a weight of 40,000 lbs empty and 100,000 lbs loaded on either eight
or seven axles.
Fire protection will be provided by fire extinguishers located on
the tractors and in the temporary office trailer.
This application does not include any concentration of animals on
the site and will be fenced from the surrounding grazing land. It,
therefore, does not involve any stock piling or storage of waste.
Since the surface of the site will be road base, which allows
sufficient permeability, no storm water retention facility will be
needed. The proposed facility is only a temporary parking lot, for
freight trailers, so waste and debris should not be a problem. The
site will be monitored by CF crews and will be maintained
accordingly.
The applicant does not anticipate any landscaping will be required
due to the transitory use and the surrounding area. Upon cessation
of the freight relay use, CF will remove all improvements,
temporary structures and reclaim the road base from the site. The
site will be reseeded with native grass seed. Upon county approval
of this Use By Special Review and obtaining all necessary permits,
the construction of the improvements and the startup of operations
will take approximately three weeks.
The applicants' request is consistent with the Weld County
Comprehensive Plan for an agricultural district, and the activities
of the applicant are only temporary and will not permanently impede
with the continuation of agricultural activities. The applicants'
activities will not remove any prime agricultural ground from
present production nor will the activities interfere with the
existing agricultural activities.
The activities of the applicant, the temporary parking of freight
trailers, will not impose any dangers to the community at large.
Since the proposed site is located next to I-25, there are adequate
health, safety and welfare protections in existence to protect the
inhabitants of the county.

Currently, the existing surrounding land use is predominantly
grazing of livestock. All the adjacent land uses is grazing and
will remain so for into the future, except the property to the
south. At this time, the city of Fort Collins has the adjacent
property to the south under contract to purchase. Fort Collins
plans to convert the non-prime agricultural land to solid waste
disposal site.
The proposed site of the applicant, is not located in a flood plain
or geological hazard, nor the Weld County Airport overlay district
area.
Therefore, the applicant requests that the staff, the planning
commission, and the the Board of County Commissiners approve this
application, and grant a Use By Special Review to the applicants.
