RE: APPROVAL OF RECORDED EXEMPTION NO. 1482 - MCDONALD
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(l0) (d) , CRS, as amended, did determine at a public meeting held
in the Chambers of the Board, that a certain parcel of land, to be divided into
two parcels, as shown on the plat known as Recorded Exemption No. 1482, does not
come within the purview of the definition of the terms, "subdivision" and
"subdivided land", and
WHEREAS, the request for Recorded Exemption No. 1482 was submitted by Gary
S. McDonald, c/o Ken Lind, for property which is located in part of the Es NW***
of Section 21, Township 7 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, being more particularly described in the plat which shall be provided
by the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to
be approximately 38.93 acres and 2 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby
is, exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that this approval is conditional upon
the following:
1. A Weld County septic permit is required for the proposed home, and
its septic system shall be installed according to the Weld County
Individual Sewage Disposal System (ISDS) regulations.
2. Prior to recording the plat, the applicant shall submit evidence
that an ISDS evaluation has been completed by the Weld County Health
Department on all existing septic systems.
3. The applicant shall submit a mylar plat to the Department of
Planning Services to be recorded in the office of the Weld County
Clerk and Recorder. The plat shall be prepared in accordance with
the requirements of Section 11.7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty days from the
date of approval by the Board of County Commissioners. The
applicant shall be responsible for paying the recording fees.

1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be prepared in accordance with the requirements
of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall
be submitted within sixty (60) days from the date of approval by the
Department of Planning Services. The applicant shall be responsible for

Dear Commissioners:
This request for a recorded exemption is submitted by Gary S. McDonald c/o Ken
Lind. The parcel of land is described as part of the E2 NW4 of Section 21, T7N,
R66W of the 6th P.M. , Weld County, Colorado. The property is located south of
Weld County Road 80, approximately .5 miles east of Weld County Road 29. This
request is to divide a 40.93 acre parcel of land, which is the total contiguous
land holdings of the applicant, into two parcels of 38.93 and 2 acres, more or
less.
The property is currently served by North Weld County Water District and a septic
system. The applicants proposed serving the 2 acre parcel with the same
services.
It is the opinion of the Department of Planning Services' staff that this
application should be denied. Until February, 1992, this 40 acre parcel was part
of an 80 acre lot. At that time, Mr. McDonald sold the southern portion of his
parcel to his neighbor to the south. The effect of this transaction was to make
the two residences on the 40 acre parcel nonconforming structures, because they
are now located on a lot which is under the minimum lot size. It is the staff' s
opinion that the applicant has evaded the intent of the Subdivision Ordinance and
is attempting to further evade the intent of the Subdivision Ordinance with the
proposed division.
As shown on the attached aerial photograph, this quarter section has been divided
into six parcels. Two of the parcels in the west half of this quarter section
were created using a Recorded Exemption process. The other two parcels were
created in 1971. The level of development and the potential for continued
divisions warrants concern. The Board should consider whether it wants to allow
this kind of piecemeal development to continue. Continued divisions may evade
the intent and purpose of the Weld County Subdivision Ordinance. Residential

development in rural areas requires an increased amount of urban-type services
such as road maintenance, sheriff and fire protection, school busing, snow
removal and utilities. Service demands increase an density increases.
The Department of Services' staff has received one letter from a surrounding
property owner who objects to this request.
The staff recommends the Board of County Commissioners deny this request.

Re : Recorded Exemption Application (McDonald)
Ladies & Gentlemen:
The purpose of the requested Recorded Exemption application is
to create a lot in the agricultural zoned district for a new single
family residential building site .
This application is compatible with existing uses surrounding
the proposed Recorded Exemption as all surrounding uses include ag
and rural residential . This application is also not inconsistent
with the master plan or development plan of the Town of Ault . This
application is consistent with the ag zoning district as the larger
parcel of land will continue to be used for agricultural purposes .
The smaller lot will be located upon a parcel of land on the
extreme northwest boundary of the property thus minimizing the loss
of agricultural land and production. The application is also
consistent with efficient and orderly development as a domestic
water line is in place, there is easy access onto a Weld County
road and there is not a high degree of surrounding residential
development .
The existing property does have 1 principal residence and a
labor home . The existing land is used for alfalfa production to
provide feed for the equine operation of the applicants . The new
parcel (2 acres) will consist of approximately 1 acre of alfalfa,
;4 acre of orchards and 34 acre for access road and dwelling. The
proposed site for the 2 acre parcel is currently used for marginal
alfalfa production as the area has a severe alkali problem.
The new parcel and residence will provide a second home for
the mother and father of the wife of the applicants . The main
purpose of the new residence is to provide a home for relatives who
will help provide farm and animal husbandry care to the main

operation as well as to provide medical care for the father of the
applicants who requires full time assistance which the current
owners cannot now provide .
As the new residence is for family members, for a medical
purpose as well as ag related purpose, the proposal is consistent
with the Weld County Comprehensive Plan. This use is reasonably
necessary as an accessory to the farm use and provides a means by
which the dwelling can be constructed and allowing the financial
institution to take a security interest in the residential property
without jeopardizing existing agricultural uses . The fact that the
new residence results in the loss of only % acre of marginally
productive land also shows its consistency with the ag district and
Weld County Comprehensive Plan.
The property is not located in a flood plain, geological
hazard or other overlay district area .

Dear Ms . Adler:
We object strongly to the division of prime irrigated farm land
into any parcels of less than 40 acres. While we do not know the
full details of the division, we understand Ms. McDonald ' s
parents want to build on the property. Even though we may, at
some time in the future, want to also provide a place for our
parents to live near us, we feel that no property zoned
agriculture should be divided into parcels less than 5 acres,
preferably 10 .
Weld County ranks in the top 10 agricultural production counties
in the US . Once we start letting land owners break up farm
ground in two acre parcels we will have an urban mess in the
rural area, and revenue and jobs will be lost.
