The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.13.9 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. I spoke to Bruce Johnson, of Johnson&Associates,who explained the need for two accesses. There will be one access to the recorded exemption and one access to the subdivision exemption. The remaining Lot B of the recorded exemption is the 67-acre farm. There is presently one access off of WCR 76, which serves the southern end of the farm. An additional access is needed off of WCR 37 to access a potato seller and irrigation facilities. Those two accesses are off of separate roads and are separated by 1/4 mile. Also, to go from one end to the other requires crossing the Union Pacific Railroad tracks and US Hwy 85. To have two access to the proposed Lot B is reasonable because they are off of two different county roads; they are separated by considerable distances; and the safety aspect of crossing the railroad track and US Hwy 85. After said application is approved, a mylar plat as required by the Subdivision Exemption Procedural Guide shall be prepared and submitted to the Department of Planning Services for approval and filing with the Weld County Clerk and Recorder. An exact legal metes and bounds legal description shall describe the property. B. Application Requirements: 1 . A completed application form is attached. 2. This request is made simultaneously with a Recorded Exemption Application on subject property. The total request is to divide the existing buildings from the subject irrigated farm. The farmstead has three (3 ) homes and numerous out buildings. Two (2 ) of the homes are in extreme close proximity to each other and thus will remain in one parcel, this Subdivision Exemption. The other home is at the other end of the homestead parcel, and will be Lot A of the Recorded Exemption. The purpose of this request is to separate a tract from the balance of the farm. This tract will consist of a larger house, a small house and a barn. Simultaneously submitted is a Recorded Exemption to split the North house from the farm portion of this Subdivision Exemption. The benefits would primarily be two fold. One, the applicant has other land with building in the area and does not need any additional houses. Second, the community is in direr need of single family rural residences for sell. Purchasers as owner occupants are much better care takers and contribute much to the community. Their property is much safer and has less vandalism. 3. A copy of the Dalton Bros. , Inc. deed and their contract to sell to Bolet Company are both attached. This letter is to grant Power of Attorney to Bruce Johnson (opening paragraph) as agent. 4. The exact legal will be by surveyors metes and bounds description as described above in paragraph A4, regarding the plat. 5 .
