HomeMy WebLinkAbout940168.tiff RESOLUTION RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR POUDRE RIVER TRAIL SYSTEMS AND AUTHORIZE CHAIRMAN TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Intergovernmental Agreement among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, the Town of Windsor and the City of Greeley, with terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Intergovernmental Agreement among the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, the Town of Windsor and the City of Greeley be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized to sign said agreement. Kirkmeyer 940168 p 6,00i INTERGOVERNMENTAL, AGREEMENT FOR POUDRE RIVER TRAIL, SYSTEMS WHEREAS, the CITY OF GREELEY, COLORADO ("City"); the TOWN OF WINDSOR, COLORADO ("Town"); and WELD COUNTY, COLORADO ("County"), have found that it is in the best interest of the health, safety, and welfare of their citizens and the general public to develop a trail corridor along the Poudre River for educational, cultural, and recreational use; and WHEREAS, alternative transportation systems such as a Poudre River Trail will promote improved air quality, health, environmental awareness and fitness; and WHEREAS, this Intergovernmental Agreement will allow a greater advancement of these goals than each individual entity could accomplish on its own, NOW, THEREFORE, the City, Town, and County agree as follows: 1. The City, Town, and County will designate within their individual political boundaries, and in consultation and cooperation with each other, such trail routes and corridors as they deem appropriate among themselves. 2. The City, Town, and County agree that they may individually, at their sole individual discretion, acquire appropriate rights-of-way, easements, access, and donations for the designated routes lying within their individual political boundaries, in coordination with each other and as resources permit. 3. The City, Town, and County agree that they may individually, at their sole individual discretion, provide uniform signage, maintenance, and other improvements of each trail or designated route within its individual political boundaries, and to conduct these activities in coordination and cooperation with each other and as resources permit. The City, Town and County agree that they may contract and assign these activities between each other as part of this Intergovernmental Agreement. 4. An advisory board of seven members is hereby established to advise the City, Town and County on routes, land acquisition, expenditures, maintenance, and other associated requirements of the Poudre River Trail Corridor. A. The City, Town, and County shall each appoint two members. These appointees shall elect a seventh member to the board. B. Appointments shall be for two years, except the initial appointments where City, Town, and County shall appoint one one-year term member, and one two-year term member. The board appointed member shall be for a term of two years. 940169 C. The board shall adopt such internal rules as it deems necessary and shall set priorities to be recommended to the City, Town, and County in matters of routes, land acquisition, maintenance, and any other matter it deems appropriate regarding the Poudre River Trail Corridor. 5. This agreement shall be effective upon the signing of this agreement by the representatives of the City, Town, and County. 6. This agreement may be terminated by any party with thirty (30) days written notice to the other parties. DATED this 9TH day of FEBRUARY , 1994.
