RE: ACTION OF THE BOARD CONCERNING ABATEMENT OF DANGEROUS BUILDING - HORN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, on April 7, 1993 the Department of Planning Services informed the
Board that James G. and Betty Horn have a building on their property which is
considered to be dangerous to persons under the Uniform Code for the Abatement
of Dangerous Buildings, and
WHEREAS, said property is described as Lot 1, Block 3, Aristocrat
Ranchettes, Weld County, Colorado, located at 7071 Hart Street, Fort Lupton,
Colorado, and
WHEREAS, after hearing all testimony presented, the Board deemed it
advisable to continue said matter to April 21, 1993 at 9:00 a.m. , to allow Mr.
Horn to completely remove all debris, and
WHEREAS, at said meeting of April 21, 1993 Planning staff advised the Board
that all debris has been removed, and said matter should be dismissed, and
WHEREAS, based upon staff recommendation, the Board deems it advisable to
dismiss said matter.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that said matter concerning the abatement of a dangerous
building on property owned by James G. and Betty Horn be, and hereby is,
dismissed.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 21st day of April, A.D. , 1993.

CASE SUMMARY
December 28, 1992 Letter sent with citation of dangerous building under the
Uniform Code for the Abatement of Dangerous Buildings.
Dangerous building ordered to be demolished by January 12,
1993. Property owner waived appeal of order to demolish
building by not responding within specified time period.
January 14, 1993 Letter submitted from James Horn requesting extension until
February 28, 1993. Extension approved.
March 11, 1993 Property inspected. Demolition not completed.
March 30, 1993 Property inspected. Demolition completed, but debris not
removed.
April 1, 1993 Notice of hearing sent.
April 2, 1993 Property inspected. No change from March 30, 1993 inspection.
The Department of Planning Services' staff recommends that the Board authorize
of the clean-up work to remove the debris located on the property and authorize
the Purchasing Department to seek bids for the clean-up and removal of debris by
a private contractor.
The staff would also recommend that the Board set May 7, 1993, as the hearing
date to consider recovering the cost of the demolition work by special assessment
or as a personal obligation of the property owner. On May 7, 1993, the staff
will present an itemized account of the expense incurred by Weld County to
complete the work on the property.

Dear Mr. and Mrs. Horn:
An inspection was made on October 20, 1992, of the garage at 7071 Hart. The
garage is a dangerous building as defined in Section 302-8 of the Uniform Code
for Abatement of Dangerous Buildings. Section 302-8 states "whenever the
building or structure, or any portion thereof, because of dilapidation,
deterioration or decay or any other cause is likely to partially or completely
collapse. "
The garage should be demolished and removed from the property by January 12 ,
1992 . If you have any questions please call or write.
