RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR OIL AND GAS SUPPORT AND SERVICE FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT - DAVID AND WILMA PYLE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of December, 1990 , at the hour of 10 :00 a.m. , in the Chambers of the Board for the purpose of hearing the application of David and Wilma Pyle, 19495 Weld County Road 44 , LaSalle, Colorado 80645 , for a Site Specific Development Plan and Special Review Permit for an oil and gas support and service facility in the A (Agricultural) Zone District on the following described real estate , to-wit: Part of the W} SE} , Section 17 , Township 4 North, Range 65 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicants were represented by Tom Hellerich, Attorney, and WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicants and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. PL0823 901253 �, , Page 2 RE: USR - PYLE 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows: a. This proposal is consistent with the Weld County Comprehensive Plans ' Urban Growth Boundary Goals and Policies. The subject site is within the Urban Growth Boundary of the Town of LaSalle. The LaSalle Planning Commission has reviewed this request and found no conflicts with its ' interests. b. This proposed use is compatible with the existing surrounding land uses which include: irrigated agricultural production, livestock confinement operations and rural residences . c. This site is not in the long range growth area of the Town of LaSalle and is expected to remain agricultural. The Conditions o£ Approval and Development Standards will make the permitted uses compatible with the present land-use and future development of the area. d. No overlay districts affect the site. e. This proposal will not remove any agricultural land from production. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for an oil and gas support and service facility in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder' s Office within 30 days of approval by the Board of County Commissioners. 901253 Page 3 RE: USR - PYLE 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3 . Prior to recording the final plat: a. A screening plan for the equipment storage area shall be submitted to the Department of Planning Services for review and approval. This screening plan shall include screening along Weld County Road 44 east of the truck access, not to include berming or landscaping. The screening plan shall be incorporated into the application materials and shown on the Special Review plat map. b. The applicants shall submit an estimate of costs for the screening plan and a proposal for a performance guarantee as allowed in the Weld County Zoning Ordinance under Section 24 . 4.3 . The estimated amount and performance guarantee shall be reviewed and approved by the Board of County Commissioners. The performance guarantee shall be in a form acceptable to the Board of County Commissioners. 4. Prior to recording the Special Review Permit plat, the performance guarantee to ensure installation and completion of the screening plan shall be filed with the Clerk to the Board for the approved amount. The guarantee shall be returned to the applicants or released after the improvements have been satisfactorily completed. If the improvements have not been completed within 120 days of the date of approval of the Special Review Permit by the Board of County Commissioners, the County shall take corrective action to ensure compliance with the approved plans and the guarantee shall be forfeited. 5 . Within 180 days of approval by the Board of County Commissioners, the unused trailer and inoperable semi-tractor shall be removed from the property. 6 . The Site Specific Development Plan and Special Review Permit is for an oil and gas support and service facility as submitted in the application materials on file in the Department of Planning Services, limited to the operation of three semi-tractors with trailers, and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. The Use by Special Review Permit shall not be transferable to any successors in interest to the prescribed property and shall terminate automatically upon conveyance or lease of the property to others for operation o£ the facility. 4 . No crude oil shall be stored on the site. 5. Waste oil, treatments, anti-freeze, and other associated liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6 . No permanent disposal of wastes shall be permitted at this site. 7 . An I .S.D.S. evaluation on all existing septic systems shall be necessary prior to issuing the required septic permits on the existing systems. 8 . Waste material shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9 . Fugitive dust shall be controlled on this site. The parking area and driveway shall be surfaced with gravel and or dust pallative. 10. The maximum permissible noise level shall not exceed the industrial limit of 80 (dB (A) , as measured according to 25-12-102 , C.R. S. 11 . The screening shall be maintained in accordance with the approved screening plan. 901253 Page 2 RE: DEVELOPMENT STANDARDS - PYLE 12 . All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 13 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24 .5 of the Weld County Zoning Ordinance. 14 . The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance . 15 . Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 16 . The maintenance of the semi-tractor trailers shall be limited to minor repairs. 17 . The semi-tractor trailers shall leave the property between the hours of 6 : 00 a.m. and 6 : 00 p.m. 18 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department o£ Planning Services. 19 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 901253 HEARING CERTIFICATION DOCKET NO. 90-57 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT FOR AM OIL AND GAS SUPPORT AND SERVICE FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT - DAVID AND WILMA PYLE A public hearing was conducted on December 19, 1990, at 10:00 A.M. , with the following present: Commissioner Gene R. Brantner, Chairman Commissioner George Kennedy, Pro-Tem Commissioner Constance L. Harbert Commissioner C.W. Kirby Commissioner Gordon E. Lacy Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Brian Grubb The following business was transacted: I hereby certify that pursuant to a notice dated November 26, 1990, and duly published December 6, 1990, in The New News, a public hearing was conducted to consider a Site Specific Development Plan and Use by Special Review Permit for an oil and gas support and service facility in the A (Agricultural) Zone District for David and Wilma Pyle. Lee Morrison, Assistant County Attorney, made this matter of record. Brian Grubb, Planning Department representative, entered the favorable recommendation of the Planning staff into the record and said the Planning Commission hearing resulted in a two-to-two vote. Upon approval from Tom Houtchens, Attorney representing persons in opposition to said request, and Tom Hellerich, Attorney representing the applicants, the Conditions of Approval and Development Standards were entered into the record as written. Mr. Grubb said the Planning staff recommends a change in Development Standard #11. Mr. Hellerich explained the request and submitted pictures as exhibits. He said the applicants are willing to comply with all Conditions of Approval and Development Standards. Mr. Hellerich and Wilma Pyle, one of the applicants, answered questions of the Board. Mr. Grubb suggested all equipment be screened with the exception of the three operable tractor trailers. Mr. Houtchens stated the concerns of the surrounding property owners. Richard Lengel, Mary Shable, Rod Ulrich, and Dale Bohlender, surrounding property owners, also stated their concerns. Mr. Hellerich and Ms. Pyle responded to the concerns of the public and answered further questions of the Board. (Tape Change #90-45) After further discussion, the Board and the applicant agreed to some additional Conditions of Approval and Development Standards. Let the record reflect that a fifteen-minute recess was taken at this time to allow the Planning staff time to revise the Conditions of Approval and Development Standards. Mr. Grubb read the revisions into the record as follows: Condition of Approval #1: "The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. Commissioner Lacy moved to approve the request for a Site Specific Development Plan and Special Review Permit for an oil and gas support and service facility in the A (Agricultural) Zone District with the additional Conditions of Approval and Development Standards as stated above and the favorable recommendation of the Planning staff. Commissioner Kirby seconded the motion. Commissioner Harbert questioned the time limit for the construction of the screening. Mr. Grubb said it is 120 days and is stated in Condition of Approval #4. The motion carried unanimously. This Certification was approved on the 26th day of December, 1990. The property has two points of access onto Weld County Road 44. No new construction is necessary to continue this operation. The property will continue to stay Agricultural although it is not in production at this time. Drivers of the tankers use water and restroom facilities in the Pyles' house located on the property. The Chairman called for discussion from the audience. Weeds that are not cleared out properly in a weed control area are another concern. Abandoned and burnt-out trailers on the property were discussed as to possible screening requirements. He then called the following parties to address the Commission. Mrs. Mary Shable stated that her home is within 100 feet of the access road and the trucks are causing a maior dust problem due to the fact that the road is not paved and the gravel originally put down to relieve this problem does not seem to work. Blowing trash is also a concern as she spends alot of time picking it up once it has blown onto her property. The trucks are parked directly across from her living room window and she wanted to know if any type of screening would be put up to shield the tankers from their view. Mr. Delbert Shable was concerned about the weed problem. He stated that after helping Mr. Pyle burn them the first year they owned the property, now Mr. Pyle only cuts them and leaves the cuttings to blow in a weed controlled area. Rodney Ulrich owns rental property in the area and was concerned that he would not be able to rent as easily due to industry in the area. He stated that it could decrease property values having tanker trucks parked on nearby property. He showed pictures of an oil spill approximately loft x 10 ft and due to the natural flow of underground water, he is worried that his irrigation well could be contaminated. Dale Bohlender has an irrigation ditch where he waters livestock year around and is also concerned about contamination of his water due to oil spillage. He feels that the operation the Pyles' are proposing could make the quality of life go down for the rural property owners. Mr. Pyle responded to the above concerns by promising to take care of the weeds and trash accordingly. They would have the broken-down vehicles removed. He stated that the oil spillage was due to a 50 gallon drum used for storage that had been tipped over. Mr. Pyle now stores waste oil in a closed container in a different area on the property, away from the irrigation ditches. NOTE: Sean Hoffman and LeAnn Reid left before the vote. Jerry Kiefer requested that the staff read its recommendation. Brian Grubb read the recommendation to the Commission. The Site Specific Development Plan and Special Review permit is for an oil and gas support and service facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. The Use by Special Review permit shall not be transferable to any successors in interest to the prescribed property and shall terminate automatically upon conveyance or lease of the property to others for operation of the facility. 4. No crude oil shall be stored on the site. 5. Waste oil, treatments, anti-freeze, and other associated liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. No permanent disposal of wastes shall be permitted at this site. 7. An I.S.D.S. evaluation on all existing septic systems shall be necessary prior to issuing the required septic permits on the existing systems. 8. Waste material shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9. Fugitive dust shall be controlled on this site. 10. The maximum permissible noise level shall not exceed the industrial limit of 80 (dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 11 . All equipment related to the operation of the business with the exception of three operable semi-tractor trailers, shall be screened from all adjacent properties and public rights-of-way. 12. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 13 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 53C 1,. 3.`'3 14. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 15. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 16. Our feeling is that this agriculturally zoned district should remain exclusively for agricultural pursuits such as farming and livestock feeding. To zone it otherwise would lower our property value. 2 . Our property is immediately east and north of the Pyles ' property. Part of this property is pastureland with a natural stream of water flowing through it. Since the stream of water is at a lower elevation than the oil and gas service center, we feel there is a very real possibility that contamination to this stream of water could occur. This would, of course, render the pastureland useless and endanger our livestock. 3 . The house on our property is presently being used as a rental . It is less than a quarter of a mile from the Pyles ' acreage and is at a lower elevation. We feel a gas and oil service this close would discourage our present renter as well as prospective renters . There has been a marked increase in semi-trailer traffic since the Pyles have been operating their business from this location. We feel the traffic would increase even more if they are granted this special permit. This traffic continues day and night and is a constant source of annoyance. We feel that with a legal permit this could become much worse. The trucks come and go at all hours of the day and night. 2 . We have cattle in a pasture which joins the Pyles ' property in Section 17-T4-R65 . It has a natural stream of water that flows all year around. We also have irrigation water that flows through the pasture. This natural stream of water is only about 25 feet from the Pyles ' fence line and at a lower elevation than the Pyle property. If oily rags, papers or containers should blow in this water supply, it could become contaminated. We make our living with cattle and farming. Should any oil and gas reach this water supply, it would destroy our cattle and crops . The effect would be devastating to us and the people who use our excess irrigation water. 3 . If this request is granted, this would have a definate impact on our ability to rent this house . In the future, if our farming operation would necessitate a sale of this rental in order to keep our farming operation viable, the negative impact would be tremendous . 5. The traffic of semi-trailers has increased considerably at all hours of the day and the night since the Pyle 's have moved onto this property and are running their business out of this agriculture area . We feel the semi- traffic would increase again if they were granted this special request . We feel that this traffic is annoying and is detramental to our lifestyle, not to mention the health aspects . Zoning laws are made to be followed and are to be used for specific reasons . Central Weld has supplied the water to the property in the past, and a letter dated July 9, 1990 is enclosed with the application verifying the water source. There will be no additional water needed as a result of the applicant's activities on the property. Access to the property is off of Weld County Road 44 . The vehicles driven by the drivers, are empty tanker trucks, which are approximately 65 feet long in total length, and weigh approximately 31, 000 pounds. Each vehicle makes one trip per day from the property and returns to the property empty at the completion of the day. The sewage facilities on the applicant's property is by a septic system. Employees are only at the property approximately one half hour to one hour each day, and it is not anticipated that there is any need for additional sewage facilities. Fire protection at the applicant's property is provided by the LaSalle Fire Dept. , and in addition the applicant' s keep fire extinguishers on each truck, and two fire extinguishers in their garage. This application does not include concentration of any animals on the property. It, therefore, does not involve any stock piling or storage of waste. All buildings and structures are already in existence, and no new facilities will be built. There will be no additional storm water retention facilities required by the activities of the applicant. Trash removal at the applicant's property is provided by a local trash hauler, and consists of typical household trash. There is no other trash accumulated or required to be disposed of by the applicant. The applicant does not anticipate any additional landscaping requirements, as there is adequate landscaping supplied by the applicant's residence and the landscaping associated with the residence. No reclamation procedures will be required, as there are no earth moving activites involved by the applicant. The applicant's request is consistent with the Weld County Comprehensive Plan for an agricultural district, and the activities of the applicant are consistent with our continuation of agricultural activities. The applicant's activities will not remove any agricultural ground from present production nor will efr 3T1 remove any agricultural ground from present production nor will the activities interfere with the present existing agricultural activities. The applicant' s activities are compatible with the surrounding uses, and will have no impact on the surrounding agricultural activities or the future development of the area as projected by the Comprehensive Plan for Weld County. There are adequate health, safety and welfare protections in existence to protect the inhabitants of the county.
