RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT
#1062 FOR A COMMERCIAL USE (TRUCK PARKING AND BUSINESS) IN THE
A (AGRICULTURAL) ZONE DISTRICT - ROBERT AND KATHLEEN SCHNEIDER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 16th day of
November, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of Robert and Kathleen Schneider, P.O. Box 2472, Greeley, Colorado 80632, for
a Site Specific Development Plan and Special Review Permit#1062 for a commercial use (truck
parking and business) in the A (Agricultural) Zone District on the following described real estate,
to-wit:
Part of the W 1/2 SW 1/4 of Section 10, Township 4
North, Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, Robert Schneider, said applicant, was present, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for
review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Weld County
Planning Commission and all of the exhibits and evidence presented in this matter and, having
been fully informed, finds that this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has shown
compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows:
a. The proposal is consistent with the Weld County Comprehensive Plan's
Urban Growth Boundary Area Goals and Policies. The Town of LaSalle
reviewed this request and has no objections.
b. The proposal is consistent with the intent of the Agricultural Zone District
and is provided for as a Use by Special Review.

c. The uses which would be permitted will be compatible with the existing
surrounding land uses. The uses which would be permitted will be
compatible with the future development of the surrounding area as permitted
by the Agricultural Zone District.
d. The applicant has demonstrated a diligent effort has been made to conserve
productive agricultural land in the location decision for the proposed use.
e. No overlay districts affect the site.
f. Special Review Permit Development Standards will provide adequate
protection of the health, safety, and welfare of the neighborhood and
County.
g. This recommendation is based, in part, upon a review of the application
materials submitted by the applicant, other relevant information regarding
the request, and responses from referral entities.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Robert and Kathleen Schneider for a Site Specific
Development Plan and Special Review Permit #1062 for a commercial use (truck parking and
business) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and
hereby is, granted subject to the following conditions:
1. The attached Development Standards for the Special Review Permit shall be
adopted and placed on the Special Review plat prior to recording the plat. The plat
shall be delivered to the Department of Planning Services and be ready for
recording in the Weld County Clerk and Recorder's Office within 15 days of
approval by the Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building or electrical
permits be issued on the property until the Special Review plat is ready to be
recorded in the office of the Weld County Clerk and Recorder.
3. Within 30 days of approval by the Board of County Commissioners, the existing
septic system will require an I.S.D.S. Evaluation prior to the issuance of the required
septic permit(s). The septic system serving the office shall be evaluated by a
Colorado Registered Professional Engineer. The system serving the home can be
evaluated either by the Weld County Health Department or an engineer. In the
event the system(s) is found to be inadequate, the system(s) must be brought into
compliance with current I.S.D.S. regulations.

1. The Site Specific Development Plan and Special Review Permit is for a commercial (truck
parking and business) in the A (Agricultural) Zone District as submitted in the application
materials on file and subject to the Development Standards stated herein. Vehicles used
for the business and parking on the property shall be only vehicles owned by the applicant.
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld
County Zoning Ordinance.
3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
4. No permanent disposal of wastes shall be permitted at this site.
5. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
6. Fugitive dust shall be controlled on this site.
7. The maximum permissible noise level shall not exceed the commercial limit of 60 db(A), as
measured according to 25-12-102, CRS.
8. There shall be no commercial washing of trucks other than the applicants' own trucks and
no washing of the interior of the tanks.
9. The Special Review Permit shall not be transferable to any successors in interest to the
property and shall terminate automatically upon conveyance or lease of the property to
others for the operation of the business or parking.
10. All construction on the property shall be in accordance with the requirements of the Weld
County Building Code Ordinance.
11. The property owner or operator shall be responsible for complying with the Design
Standards of Section 24.5 of the Weld County Zoning Ordinance.
12. The property owner or operator shall be responsible for complying with the Operation
Standards of Section 24.6 of the Weld County Zoning Ordinance.
13. Personnel from the Weld County Health Department and Weld County Department of
Planning Services shall be granted access onto the property at any reasonable time in
order to ensure the activities carried out on the property comply with the Development
Standards stated herein and all applicable Weld County regulations.

14. The Special Review area shall be limited to the plans shown herein and governed by the
foregoing Standards and all applicable Weld County regulations. Major changes from the
plans or Development Standards as shown or stated shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the Board of
County Commissioner before such changes from the plans or Development Standards are
permitted. Any other changes shall be filed in the office of the Department of Planning
Services.
15. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of County Commissioners.

A public hearing was conducted on November 16, 1994, at 10:00 a.m., with the following

Let the record reflect that Commissioner Constance L. Harbert is the Acting Chairman for
all scheduled meetings and hearings on this date.
I hereby certify that pursuant to a notice dated October 26, 1994, and duly published
November 3, 1994, in the Windsor Beacon, a public hearing was conducted to consider the
request of Robert and Kathleen Schneider for a Site Specific Development Plan and
Special Review Permit for a commercial use (truck parking and business) in the
A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter
of record. Acting Chairman Harbert notified the applicant that only three Board members
are present and explained, pursuant to the Home Rule Charter, three affirmative votes are
required for approval of any matter; therefore, the applicant has the option to continue said
matter. Gloria Dunn, Planning Department representative, consulted with said applicant
and indicated he desires the Board proceed today. Ms. Dunn entered the favorable
recommendation of the Planning Commission into the record as written and noted
Development Standard#8 was changed at the Planning Commission's hearing to allow the
applicants to wash only the outside of their own two trucks, but no washing of the interior
tanks or commercial washing shall be allowed. Robert Schneider, applicant, stated his
residence and business are now in one location, and they haul crude oil to Denver. He
explained they operate two trucks and this location is satisfactory and serves their
purposes. Mr. Schneider confirmed that all Conditions of Approval and Development
Standards are acceptable, including the change to Development Standard #8. He stated
he does not foresee having more than three trucks in the future, and Ms. Dunn reiterated
the Planning Commission wanted the applicants to be limited to washing only their own
trucks and no commercial vehicles. Acting Chairman Harbert suggested removing the word
"two" from the Development Standard. Responding to a question from Commissioner
Baxter, Mr. Schneider stated the mobile home was moved onto the property and they will

be living in it until the house is remodeled. He confirmed the mobile home will then be used
as an office and his son will live there for security. He also confirmed the mechanic shop
is used to service his own trucks. No public testimony was offered concerning this matter.
Commissioner Baxter moved to approve the request of Robert and Kathleen Schneider for
a Site Specific Development Plan and Special Review Permit for a commercial use (truck
parking and business) in the A (Agricultural) Zone District, based on the recommendations
of the Planning staff and the Planning Commission, with the Conditions of Approval and
Development Standards as entered into the record and the change to Development
Standard #8. The motion was seconded by Commissioner Kirkmeyer, and it carried
unanimously.
This Certification was approved on the 21st day of November, 1994.

REQUEST: A Site Specific Development Plan and a Special Review permit for a commercial use
(truck parking and business) in the A(Agricultural) zone district.
LEGAL DESCRIPTION: Part of the W2 SW4 of Section 10, T4N, R65W of the 6th P.M., Weld
County, Colorado.
LOCATION: Approximately 2 miles southeast of LaSalle; located at 22308 Weld County Road 43.
Robert Schneider, applicant, explained he owns two trucks that haul crude oil to refinery's in Denver. He
wants to have his residence and the business located at the same site. There is a shop already on the
property and he currently has two employees.
Jack Epple asked about the types of trucks and Robert replied they were tanker trucks. Richard Kimmel
asked how much of the area at the proposed location was already gravel led. Robert said the north, west,
and south sides of the shop were already in gravel. Robert was concerned that Development Standard
#8, regarding the washing of trucks would be too restrictive since the trucks had to be washed before they
could be serviced. Discussion followed between Jeff Stoll from the Health Department and the
Commission. It was determined he would be able to wash only the two trucks he presently owns as long
as he did not wash the interior of the tanks at this site.
The Chairman asked if there was anyone in the audience who wished to speak for or against this
application. No one wished to speak.
Marie Koolstra moved Case Number USR-1062, with the amendment to Development Standard#8, be
forwarded to the Board of County Commissioners with the Planning Commission's recommendation for
approval. Curt Moore seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision.

Moved by Marie Koolstra that the following resolution with an amendment to Development Standard#8,

1. The submitted materials are in compliance with the application requirements of Section 24.7 of the
Weld County Zoning Ordinance.
2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section
24.3 of the Weld County Zoning Ordinance as follows:
The proposal is consistent with the Weld County Comprehensive Plan's Urban Growth
Boundary Area Goals and Policies. The Town of LaSalle reviewed this request and has
no objections.
The proposal is consistent with the intent of the Agricultural zone district and is provided
for as a use by special review.
The uses which would be permitted will be compatible with the existing surrounding land
uses. The uses which would be permitted will be compatible with the future development
of the surrounding area as permitted by the Agricultural zone district.
The applicant has demonstrated a diligent effort has been made to conserve productive
agricultural land in the location decision for the proposed use.
No overlay districts affect the site.
Special Review Permit Development Standards will provide adequate protection of the
health, safety, and welfare of the neighborhood and County.
This recommendation is based, in part, upon a review of the application materials
submitted by the applicant, other relevant information regarding the request, and
responses from referral entities.

The Planning Commission's recommendation for approval is conditional upon the following:
1. The attached Development Standards for the Special Review permit shall be adopted and placed
on the Special Review plat prior to recording the plat. The plat shall be delivered to the
Department of Planning Services and be ready for recording in the Weld County Clerk and
Recorder's office within 15 days of approval by the Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building or electrical permits be issued
on the property until the Special Reviedw plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
3. Within 30 days of approval by the Board of County Commissioners the existing septic system will
require an I.S.D.S Evaluation prior to the issuance of the required septic permit(s). The septic
system serving the office shall be evaluated by a Colorado Registered Professional Engineer.
The system serving the home can be evaluated either by the Weld County Health Department or
an engineer. In the event the system(s) is found to be inadequate, the system(s) must be brought
into compliance with current I.S.D.S. regualtions.

DEVELOPMENT STANDARDS

1. The Site Specific Development Plan and a Special Review permit is for a commercial (truck
parking and business) in the A(Agricultural) zone district as submitted in the application materials
on file in the Department of Planning Services and subject to the Development Standards stated
hereon. Vehicles used for the business and parking on the property shall be only vehicles owned
by the applicant.
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld
County Zoning Ordinance.
3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects
against surface and groundwater contamination.
4. No permanent disposal of wastes shall be permitted at this site.
5. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
6. Fugitive dust shall be controlled on this site.
7. The maximum permissible noise level shall not exceed the commercial limit of 60 db(A), as
measured according to 25-12-102, Colorado Revised Statutes.
8. There shall be no commercial washing of trucks other than the applicants own two trucks and no
washing of the interior of the tanks.
9. The Special Review permit shall not be transferable to any successors in interest to the property
and shall terminate automatically upon conveyance or lease of the property to others for the
operation of the business or parking.
10. All construction on the property shall be in accordance with the requirements of the Weld County
Building Code Ordinance.
11. The property owner or operator shall be responsible for complying with the Design Standards of
Section 24.5 of the Weld County Zoning Ordinance.
12. The property owner or operator shall be responsible for complying with the Operation Standards
of Section 24.6 of the Weld County Zoning Ordinance.
13. Personnel from the Weld County Health Department and Weld County Department of Planning
Services shall be granted access onto the property at any reasonable time in order to ensure the
activities carried out on the property comply with the Development Standards stated hereon and
all applicable Weld County Regulations.
14. The Special Review area shall be limited to the plans shown hereon and governed by the
foregoing Standards and all applicable Weld County Regulations. Major changes from the plans
or Development Standards as shown or stated shall require the approval of an amendment of the
permit by the Weld County Planning commission and the Board of County Commissioners before
such changes from the plans or Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning Services.
15. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may
be reason for revocation of the permit by the Board of County Commissioners.

2. A. The proposed use of this property is a residental home,
the parking of our trucks and an office and shop where we will be
doing light maintenance of our equipment. We will not be doing
maintenance for hire the shop is for the maintenance of our
equipment only.
B. The need for this permit is so we can live and park our
equipment in one location and be able to have ready access.
We also need this permit so we can park a mobil home on the mobil home
site. the site is already there. The mobile will be our residence
until we can get a contractor out to look at the house to see if
it is feesable to remodle. If remodeling will be feesable the
mobile home will be used as an office, an employee lounge and a place
to house security and the overseer of our employees and equipment
while we are away from home. We owne very expensive equipment
and tools this is why we are filing for the special permit.
C. The surrounding properties are fields and crops there is
and oil well to the south which is surrounded by crops.
D. Our proposed use of this property is residental and parking
of our trucks. There is a resident to the N.W. 1/10 of a mile,
mile south another resident and to the N.E. 3/10 of a mile
is the third there is no resident with in a mile to the west of
the property, the property is surrounded by fields.
E. There will by 3 residents living on this property none
of which are employees.
F. The employees will enter the property get into there
trucks and leave the property until there shif is over. There
Are No Hours of operation on this property the number of employees
are 2.
G. The type of water source that is now on the property is
centeral weld water.
H. The access route to this property is WCR 43 which runs
north and south.
I. The vehicular traffic associated with the use of this
property is personal car and pickup traffic and 2 tractor
trailer riggs approxmently 28,000 lbs each entering
and exiting once per day.
J. The sewage facilities, are septic for the house and mobile which is
already on the property No sewage is needed for the equipment
K. The type of fire protection will be The LaSalle fire district
and fire extinguishers one for the house, office and each of the
trucks.
L. The types of animals will be a dog a couple of cats and
maykie, a farm animal to help keep the pasture and weeds mowed.
M. There will be no proposed stock piling or storage areas

facilities are proposed

there is a serviced dumpster.
P. This property is already land caped but we will bring
in rock to harden the road entery way and the area where we will
park the trucks. We will be putting in pasture grass for the non
used areas for water and errosin control.
Q. This property will be used for a residence and truck parking
no reclamation procedures to be employed.
R. A proposed starting date for us to move onto this property
is late September or early october 1994 and the proposed construction
time of the rock and pasture grass is early spring 1995.
The remodeling of the house we need to get with a contractor
and the bank so that proposel date to be finished looks like the
year 2000.
3. A. We are not changing the land usage only applying for a
special use permit to park a mobile home on the site that is
already there and to park our trucks so the land should remain
consistant with the countys comprehensive plan.
B. We are not changing the land usage so it will remain
consistent with the district in which it is located.
C. N/A we are not changing the zoning it will remain Ag.
D. N/A this is not industary or manifacturing the safety and
welfare remains as always.
E. This use permit will be compatible with the existing
surroundings land because it will have no impact on the surrounding
properties the zoning and use will remain the same.
F. We spoke to Weld planning and Zoning there is no other
future development of this property or surrounding properties
it will remain Ag.
G. According to Weld planning and Zoning this property is
not located in a flood plain or a geolgic hazard area and does
not fall in the Weld county airport overlay district.
H.We have a.letter from Centeral weld water district that states
there is adequate water for this property and its uses. See
attached letter.
I. A copy of the redemptinn and deed is attached.
J. The noise level of this property will not change the trucks
make no more noise that any farm or Ag. equipment.

Your application and related materials for the request described above are
complete and in order at the present time. I have scheduled a meeting with the
Weld County Planning Commission for October 18, 1994, at 1:30 p.m. This meeting
will take place in the County Commissioners' Hearing Room, first floor, Weld
County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended
that you and/or a representative be in attendance to answer any questions the
Planning Commission members might have with respect to your application.
It is the policy of Weld County to refer an application of this nature to any
town or municipality lying within three miles of the property in question or if
the property under consideration is located within the comprehensive planning
area of a town or municipality. Therefore, our office has forwarded a copy of
the submitted materials to the LaSalle Planning Commission for its review and
comments. Please call Kathy Ells at 284-6931 for further details regarding the
date, time, and place of this meeting. It is recommended that you and/or a

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 24.7 of the
Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Section 24.3 of the Weld County Zoning Ordinance as follows:
The proposal is consistent with the Weld County Comprehensive Plan's Urban Growth
Boundary Area Goals and Policies. The Town of LaSalle reviewed this request and has
no objections.
The proposal is consistent with the intent of the Agricultural zone district and is provided
for as a use by special review.
The uses which would be permitted will be compatible with the existing surrounding land
uses. The uses which would be permitted will be compatible with the future development
of the surrounding area as permitted by the Agricultural zone district.
The applicant has demonstrated a diligent effort has been made to conserve productive
agricultural land in the location decision for the proposed use.
No overlay districts affect the site.
Special Review Permit Development Standards will provide adequate protection of the
health, safety, and welfare of the neighborhood and County.
This recommendation is based, in part, upon a review of the application materials
submitted by the applicant, other relevant information regarding the request, and
responses from referral entities.
The Department of Planning Services' staff redommendation for approval is conditional upon the following:
1. The attached Development Standards for the Special Review permit shall be adopted and placed
on the Special Review plat prior to recording the plat. The plat shall be delivered to the
Department of Planning Services and be ready for recording in the Weld County Clerk and
Recorder's office within 15 days of approval by the Board of County`Commissioners. , EXPOSIT

2. The Special Review activity shall not occur nor shall any building or electrical permits be issued
on the property until the Special Reviedw plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
3. Within 30 days of approval by the Board of County Commissioners the existing septic system will
require an I.S.D.S Evaluation prior to the issuance of the required septic permit(s). The septic
system serving the office shall be evaluated by a Colorado Registered Professional Engineer.
The system serving the home can be evaluated either by the Weld County Health Department or
an engineer. In the event the system(s) is found to be inadequate, the system(s) must be brought
into compliance with current I.S.D.S. regualtions.

1. The Site Specific Development Plan and a Special Review permit is for a commercial (truck
parking and business) in the A(Agricultural)zone district as submitted in the application materials
on file in the Department of Planning Services and subject to the Development Standards stated
hereon. Vehicles used for the business and parking on the property shall be only vehicles owned
by the applicant.
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld
County Zoning Ordinance.
3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects
against surface and groundwater contamination.
4. No permanent disposal of wastes shall be permitted at this site.
5. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions.
6. Fugitive dust shall be controlled on this site.
7. The maximum permissible noise level shall not exceed the commercial limit of 60 db(A), as
measured according to 25-12-102, Colorado Revised Statutes.
8. There shall be no washing of trucks at this location.
9. The Special Review permit shall not be transferable to any successors in interest to the property
and shall terminate automatically upon conveyance or lease of the property to others for the
operation of the business or parking.
10. All construction on the property shall be in accordance with the requirements of the Weld County
Building Code Ordinance.
11. The property owner or operator shall be responsible for complying with the Design Standards of
Section 24.5 of the Weld County Zoning Ordinance.
12. The property owner or operator shall be responsible for complying with the Operation Standards
of Section 24.6 of the Weld County Zoning Ordinance.
13. Personnel from the Weld County Health Department and Weld County Department of Planning
Services shall be granted access onto the property at any reasonable time in order to ensure the
activities carried out on the property comply with the Development Standards stated hereon and
all applicable Weld County Regulations.
14. The Special Review area shall be limited to the plans shown hereon and governed by the
foregoing Standards and all applicable Weld County Regulations. Major changes from the plans
or Development Standards as shown or stated shall require the approval of an amendment of the
permit by the Weld County Planning commission and the Board of County Commissioners before
such changes from the plans or Development Standards are permitted. Any other changes shall
be filed in the office of the Department of Planning Services.
15. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may
be reason for revocation of the permit by the Board of County Commissioners.

property appears to be to the northeast. The closest residence on adjacent properties appears to be 400 to
500 feet north of the property and is located on the west side of Weld County Road 43. The public notice sign
was posted on the property at the time of inspection. C

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
4. Fugitive dust shall be controlled on this site.
5. The maximum permissible noise level shall not exceed the commercial limit
of 60 db(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
6. The existing septic system(s) do not appear to be permitted through the
Weld County Health Department. Each system will require an I.S.D.S.
Evaluation prior to the issuance of the required septic permit(s) . The
septic system serving the office shall be evaluated by a Colorado
Registered Professional Engineer. The system serving the home can be
evaluated either by the Weld County Health Department or an engineer. In
the event the system(s) is found to be inadequate, the system(s) must be
brought into compliance with current I.S.D.S. regulations.
7. There shall be no washing of trucks at this location.
