RE: APPROVE 1993 VICTIMS OF CRIME ACT APPLICATION FOR DOMESTIC VIOLENCE AND
SPECIAL POPULATIONS LIAISON PROJECT AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a 1993 Victims of Crime Act
Application for the 19th Judicial District Attorney's Office Domestic Violence
and Special Populations Liaison Project, with the terms and conditions being as
stated in said application, and
WHEREAS, after review, the Board deems it advisable to approve said
application, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the 1993 Victims of Crime Act Application for the 19th
Judicial District Attorney's Office be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said application.
The above and foregoing Resolution was, on motion duly made and seconded,

This meeting took place in the Weld County Board Room of the County
Commissioners, Centennial Building, Greeley, Colorado at 8 : 15 am
and ended at 10 : 00 am.
Juan Cruz and Nancy McMenamin will preside as Co-Chairpersons for
this committee on a temporary basis. This committee agreed to
name the "Coordinating Committee for Victims of Crime" with the
goal of bringing together all agencies in the 19th Judicial
District to ensure consistency and a continuity of services for
victims of crime from initial contact with law enforcement and
throughout the criminal justice system.
The following agencies have been or will be contacted for the next
committee meeting to be held in May, 1993 (date to be determined) .
All agencies involved in this committee are not necessarily VOCA
Grantees but are interested in victim services:

This list of agencies represents the services in the 19th Judicial
District for possible victim services, including special and
underserved populations. These agencies will be a part of the
response efforts and services for victims of crime in the this area
and a part of the referral source the Greeley Police Department's
newly developed Victim Advocate Project, fund by VALE Funds .
This committee will come together at regular intervals to discuss
and plan coordination services for victims of crime A flow chart
will be developed to identify each level of service to crime
victims beginning at the initial law enforcement contact.
The following particular crimes were discussed related to how this
community responds and the agencies that may be working with those
victims :
Child Sexual Assault/Abuse
Domestic Violence
Adult Sexual Assault
Crimes Against Elderly and Disabled
Hate Crimes
Gang Violence
Aggravated Assault and Robbery
DUI and DWAI, Injury and Death
Survivors of Homicide Victims
It was felt by the attendees of this meeting that working together
with other agencies that work with victims of crime can ensure
better services to those victims and will have an opportunity to
determine the gaps and overlaps, and quality in this system. It
was agreed that another meeting will be set for May, 1993 and at
this time, the committee will determine the direction of this
committee and how often it will meet.

15-18 Project Sea:unary
The 1992 statistics continue to indicate the growing severity of
the domestic violence problems in the 19th Judicial District (the
19th Judicial District is synonomous with Weld County) . In 1992 ,
there were 568 arrests made in domestic violence crimes . However,
this does not reflect the over 100O police contacts involving
domestic disputes . In 1992, A Women' s Place, the battered women' s
shelter in Greeley, reports 3,233 nights of crisis shelter given to
approximately 258 battered women and their children, 1130 crisis
counseling calls, plus a total of 2, 381 domestic violence
information and referrals . These growing numbers impact the 19th
Judicial District Attorney' s Victim Assistance Program as this
project provides education, legal liaison, referral and support
services to these victims . This program is only one of its kind
within the 19th Judicial District to provide such a service.
In addition to domestic crimes, the special populations of the
elderly and disabled are in great need of education, legal liaison,
referral and support services within the the 19th Judicial
District. There are no unique services for the elderly and
disabled within the 19th Judicial District ' s Criminal Justice
System. Investing time through this project with these unique
victims can be empowering in order for them to be invested in the
court process and their own recovery.
16. Project Description:
The 19th Judicial District Attorney's Domestic Violence and Special
Populations Victim Liaison Project is staffed with one .20
FTE,Community Counselor II, who is the coordinator and 1 volunteer,
both of whom work directly with domestic violence and the elderly
and disabled victims of crime who are involved in the Criminal
Justice System.
A domestic violence victim is referred to this project by the
shelter. It is at this time that the support services and
education are offered to that victim, i,e. , court process
information, bond/sentencing options, referrals to other agencies,
victim compensation and crisis counseling.
This project will provide legal liaison, education and personal
support services to the elderly and disabled victims of crime who
are involved in the 19th Judicial District Criminal Justice System.
Referrals will come from law enforcement, District Attorney' s
Office, and other agencies in the community. As a part of the
District Attorney's Office this project will continue to educate
Law Enforcement, the D.A. 's Office and community agencies about the
special . services to be provided by this project early in the
criminal justice process and collect data on numbers served for
future planning.

17. Goals and Objectives:
GOAL 1 :
To provide direct services as Criminal Justice support and
education to victims of domestic violence in the 19th Judicial
District Criminal Justice System.
OBJECTIVE :
- To send copies of Restraining Orders and Bond Conditions to 600
(not including children) to victims of domestic violence when
partners are arrested.
- To provide information about liason services to 300 domestic
violence victims (i .e. case status, dropping of charges , bond
conditions, disposition and courtroom advocacy)
- To provide liaison services to 300 domestic violence victims
and the District Attorney.
- To refer 300 domestic violence victims to other community
agencies including; victim compensation, A Woman' s Place, Legal
Aid, mental health services, Department of Social Services and
Child Advocacy Resource and Education, Inc . (CARE) for services .
- To provide education and information to the 19 law enforcement
agencies in Weld County and at least 10 other agencies working
with victims of crime about the liaison services through this
project for domestic violence victims and their children.
GOAL 2 :
To enhance and expand direct services as criminal justice support
and education to elderly and disabled victims of crime in the 19th
Judicial District Criminal Justice System.
- To provide education and information to the 19 law enforcement
agencies in Weld County and at least 4 other agencies working
with elderly and disabled about the liaison services through this
project.
- To act as liaison to eldery and disabled victims of crime
between the victim and the District Attorney by providing
legal education, liaison, referral and support services within
first quarter of the 1993-94 funding year.
- To provide assistance to elderly and disabled victims of
crime in applying for Victim Compensation within the first
quarter of the 1993-94 funding year.
- To collect statistical data related to the number of elderly and
disabled victims of crime served by this project on a monthly
basis for the 1993-94 funding year.

Describe the major differences between your 1992 VOCA Project and the proposed 1993 VOCA Project Justify any increase
requested over your 1992 award amount
The major differences between our 1992 VOCA Project and the
proposed 1993 VOCA Project is the focus on special populations,
specifically elderly and disabled victims of crime. Our 1992 VOCA
Project concentrated primarily on the domestic violence victims and
how the Domestic Violence Task Force made significant changes in
the direct services to domestic violence victims and their children
in Weld County.
The numbers have increased in our direct services to victims of
domestic violence and with the impact of the Victims ' Rights
Amendment, and it is anticipated that the domestic violence numbers
will grow along with all other populations of crime victims who are
in need of direct services within the Criminal Justice System.
Also, this project will seek to unite all agencies who serve
victims of crime to enhance services and to identify the quality
and consistency of direct services in this area. Increased
education regarding our services to law enforcement, the D.A. 's
office and other agencies regarding domestic violence victims and
special populations will also increase the numbers served by this
project.
The amount requested for this proposal is less than 10% of the
amount received in our 1992 VOCA Grant Award ( 1993 requested:
$5, 000 . 00; received in 1992 : $4,605.00) a difference of $395 . 00 .
It is felt that with a small increase and slight alteration of
priorities, this project can provide direct services to both
domestic violence victims and elderly and disabled victims of
crime. Data collection will be important to determine the numbers
of special populations receiving services from this project for
1993-94 to assess future need.

Project Liaison:
The salary is based on Ms . Walker' s 1992 figure of $25, 000x with
20% of her time exclusively devoted to the District Attorney' s
Domestic Violence and Special Populations Victim Liaison Project.
Ms . Walker' s salary is made up by the Victim Assistance Program and
VALE Funds ( job description in Appendix B) .
This position is described as Community Counselor III per the Weld
County Personnel pay level at $11 . 05 per hour. This rate per hour
is equivalent to the average pay scale for counselors performing in
a similar position in this area with the addition of benefits .
This rate of pay is determined by Weld County Personnel for the
position held by Jennifer Walker.
Benefits :
Benefits, insurance and taxes for 15% of Ms . Walker' s salary is
calculated at the Weld County rate.
Supplies and Operating Expenses :
Copying, materials, and maintenance of copiers are supplied by Weld
County (copies based on . 11 per copy plus maintenance) . Cost
breaks out to be approximately $46 .00 per month) .
Supplies are also supplied by Weld County which includes all
materials used for this project (letterhead, envelopes, pens,
pencils, mailing costs, etc. ) Cost breaks out to be approximately
$57 . 00 per month.

The applicant hereby certifies that the project described in this application meets all the requirements of the Victims of Crime
Act, 1984,as amended, that all information contained in the application is correct, that there has been appropriate coordination
with affected agencies and that the applicant will comply with all provisions of the Act and all other applicable Federal and state
laws, rules and regulations that have been or may hereafter be established.
The applicant further understands and agrees that any subgrant received as a result of this application shall incorporate this
application into the subgrant award, and shall also be subject to the grant conditions set forth in the Statement of Grant Award
and in the Division of Criminal Justice publication,Administrative Guide for Federal Justice Grant Programs.
A. Financial and Administrative Managanent
1. The applicant assures that fund accounting,auditing,monitoring,evaluation procedures and such records as the Division
of Criminal Justice shall prescribe shall be provided to assure fiscal control, proper management and efficient
disbursement of funds received.
2. The applicant assures that it will comply with applicable financial and administrative OMB Circulars A-87, A-102
(Common Rule), A-128, A-110, and A-133, and will comply with the provisions of the Office of Justice Programs
publication M7100.ID,Financial and Administrative Guide for Grants. For practical purposes,the requirements which
are pertinent to the management of Victims of Crime Act funds have been extracted from the above documents and are
contained in the Administrative Guide for Federal Justice Grant Programs referenced above. However, such a guide
cannot cover every foreseeable contingency,and the applicant is ultimately responsible for compliance with applicable
state and federal laws, rules and regulations.
B. Match and Non-Supplanting of State/Local Funds
1. The applicant certifies that federal funds made available under this formula grant will not be used to supplant state or
local funds but will be used to increase the amounts of such funds that would,in the absence of federal funds,be made
available.
C. Inspection, Recordkeeping, and Audit
1. The applicant assures that it will procure an audit by a CPA or licensed public accountant incorporating the subgrant.
Audits must be performed in accordance with OMB Circular A-I28 (State and Local Units of Governments),or OMB
. Circular A-133(Institutions of Higher Education and Non-Profits).At such time as the audit is completed,ONE COPY
OF THE AUDIT REPORT MUST BE FORWARDED TO THE DIVISION OF CRIMINAL JUSTICE for clearance.
If the audit report does not meet the applicable A-US or A-133 standards or is not submitted in a timely manner, then
the applicant accepts responsibility for the costs of a financial program audit to be performed by the Department of
Public Safety.
2. The applicant assures that it will maintain all project records as will facilitate an effective audit for three years from the
date of the final financial report or beyond the three year period if an audit is in progress and/or the findings of a
completed audit have not been resolved satisfactorily.
3. The applicant assures that it will keep copies of all documents and correspondence related to this subgrant in a separate
file bearing the project title and grant number. All expenditures must be supported by documentation and only actual
approved expenditures will be permitted.
4. The applicant assures that the Division of Criminal Justice, the Department of Public Safety, and the Comptroller
General of the United States Department of Justice or his designee, shall have access for purposes of audit and
examinations to any bonds, documents, papers and records of the subgrantee and to relevant books and records of
subcontractors of the subgrantee. The applicant shall notify any subcontractor of the subgrantee of these provisions.

S. The applicant assures that signatories of the application and subgrant award and personnel employed through this
subgrant will appear when requested at any administrative hearing,conference or meeting conducted by the Division of
Criminal Justice.
6. The applicant assures that it shall maintain such data and information and submit such reports in such form, at such
times,and containing such data and information as the Division of Criminal Justice may reasonably require to administer
the program. The applicant further assures that quarterly financial and narrative reports shall be submitted within 15
days of the end of each calendar quarter and shall be current and actual.
D. Discrimination Prohibited
1. The applicant assures that it will comply with the nondiscrimination requirements of the Omnibus Crime Control and
Safe Streets Act of 1968,as amended; Title VI of the Civil Rights Act of 1964;Section 504 of the Rehabilitation Act
of 1973, as amended; Title IX of the Education Amendments of 1972; the Age Discrimination Act of 1975; the
Department of Justice Nondiscrimination Regulations 28 CFR Part 42,Subparts C,D, E,and G;and Exeentive Order
11246, as amended by Executive Order 11375, and their implementing regulations, 41 CFR Part 60.1 et.seq.,as
applicable to construction contacts.
2. The applicant certifies that he/she will comply with the letter and spirit of the Colorado Antidiscrimination Act of 1957,
as amended, and other applicable law respecting discrimination and unfair employment practices(24-34-402.CRS 1988
Replacement Vol.), and as required by Executive Older, Equal Opportunity and Affirmative Action, dated April 16,
1975. Pursuant thereto, the following provisions shall be contained in all state contracts or subcontracts.
During the performance of this contract, the contractor agrees as follows:

h. The contractor will include the provisions of paragraph (a) through(h) in every sub-contract, subcontractor and

such provisions will be binding upon each subcontractor or vendor. The contractor will take such action with
respect to any sub-contracting or purchase order as the contracting agency may direct,as a means of enforcing such
provisions,including sanctions fur non-compliance; provided, however, that in the event the contractor becomes
involved in, or is threatened with, litigation with the subcontractor or vendor as a result of such direction by the
contracting agency, the contractor may request the State of Colorado to enter into such litigation to protect the

3. The applicant assures that in the event a Federal or state court or administrative agency makes a finding of discrimination
after a due process hearing on the grounds of race, color, religion,national origin or sex against a recipient of funds,
• the recipient will forward a copy of the fording to the Division of Criminal Justice.
4. a. The applicant assures that if required to formulate an Equal Employment Opportunity Program (EEOP), in
accordance with 28 CFR 42.301 ., it will maintain a current one on file and agrees to submit a copy of the
current EEOP, which meets the applicable requirements to the Division of Criminal Justice.
b. If the parent organization of the subgrantee receives subgrants of$500,000 or more in federal funds; an equal
employment opportunity program for women and minorities is required to be approved by the U.S. Department of
Justice through the Division of Criminal Justice prior to the start of the project
E. Victim Assistance Services
1. The applicant assures that victim assistance grant funds shall be used only to provide direct services to victims of crime.
2. The applicant assures that it will assist victims in making available crime victim compensation benefits.
3. The applicant assures that it will promote, within the community served, coordinated public and private efforts to aid
crime victims.
F. Proatranem and Contracts
1. The applicant assures that open,competitive procurement procedures must be followed for all purchases under the grant,
including especially the purchase of equipment and professional services. All contracts for professional services,of any
amount, and equipment purchases over one thousand dollars must receive prior approval by the Division of Criminal
Justice.

2. The applicant assures that no contract or agreement will be made for execution of project activities or provisions of
services(other than purchase of supplies or standard commercial or maintenance services)which is not incorporated in
the approved application or approved in advance by the Division of Criminal Justice.
3. The applicant assures that contractors/vendors who assist the subgrantee to develop specifications, requirements,
statements of work and/or RFP's for a proposed procurement shall be excluded from bidding or submitting a proposal
to compete for the award of such procurement.
4. The applicant assures that the Division of Criminal Justice shall have an irrevocable nonexclusive, royalty-free license
to any invention and to reproduce, publish and use any materials in whole or in part, and authorize others to do so,
which are produced under this subgrant.
G. Ltdarrwflauion
To the extent authorized by law,the subgrantee shall indemnify,save and hold harmless the State,its employees and agents,
against any and all claims, damages, liability and court awards including costs, expenses, and attorney fees incurred as a
result of any act or omission by the subgrantee,or its employees,agents,subcontractors,or assignees pursuant to the terms
of this subgrant.
H. Prohibited Ass
1. The signatories hereto aver that they are familiar with 18-8-301,et.seq.,(Bribery and Corrupt Influences)and 18-8-401,
et. seq., (Abuse of Public Office), CRS, 1978 Replacement Vol.,and that no violation of such provisions is present.
2.. The signatories aver that to their knowledge, no date employee has personal or beneficial interest whatsoever in the
service or property described herein in the application/proposal.
I. Other Federal and State Requirements
1. The laws of the State of Colorado and rules and regulations issued pursuant thereto shall be applied in the interpretation,
execution and enforcement of this subgrant. Any provision of this subgrant whether or not incorporated herein by
reference which provides for arbitration by any extrajudicial body or person or which is otherwise in conflict with said
laws,rules and regulations shall be considered null and void. Nothing contained in any provision incorporated herein
by reference which purports to negate this or any other special provision or condition in whole or in part shall be valid
or enforceable or available in any action at law whether by way of complaint, defense or otherwise. Any provision
rendered null and void by the operation of this provision will not invalidate the remainder of this subgrant to the extent
that the subgrant is capable of execution.
2. Financial obligations of the State of Colorado payable after the current fiscal year are contingent upon funds for that
purpose being appropriated, budgeted,and otherwise made available.
3. Any subgrant award is subject to and contingent upon the continuing availability of federal funds for the purposes hereof.
4. Either party may terminate the grant with thirty days written notice of intent to rance1 or terminate. The grant may be
terminated if the services are not satisfactorily performed by the subgrantee or if it is in the best interest of the state of •
Colorado to terminate the grant. If the grant is terminated by either the subgrantee or the state, the subgrantee shall be
paid a prorated amount based on the number of days of project operation prior to termination.
5. The grant may be suspended or terminated at any time by the Division of Criminal Justice if the subgrantee fails to
comply with the provisions of the Victims of Crime Act or any of the Certified Assurances and Special Provisions.

1. The prospective subgrantee certifies, by submission of this proposal, that neither it nor its principals subcontractors or
suppliers are presently debarred, suspended,proposed for debarment,declared ineligible,or voluntarily excluded from
participation in this transaction by any Federal department or agency.
a. By signing and submitting this proposal, the prospective subgrantee is providing the certification set out below.
b. The certification in this clause is a material representation of fact upon which reliance was placed when this
transaction was entered into. If it is later determined that the prospective subgrantee knowingly rendered an
erroneous certification,in addition to other remedies available to the Federal Government,the department or agency

A three-year plan for the 19th Judicial District Attorney's
Domestic Violence and Special Populations Liaison Project is
directed toward increased services to the underserved special
populations beginning with elderly and disabled in our 1993
proposal. There is very little information in local data
collections that shows the need for service for special populations
within the criminal justice system. A plan for research on special
populations is being developed at this time and a University of
Northern Colorado Intern will be involved in collecting data and
researching this subject next spring quarter. This research can be
very helpful in determining future needs of this population and how
our office can provide this direct service.
With the anticipated impact of the Victims ' Rights Amendment, this
program is planning on approaching the Weld County Commissioners
for an increase in personnel . We will be requesting one FTE.
Counselor to provide the clerical and counseling services for those
victims of crimes designated by the amendment. The Victim
Assistance Program is collecting data related to the increase of
services due to the Victims ' Rights Amendment. With an increae of
one FTE Counselor, this project would no longer seek funding from
VOCA and would have an institutionalized counselor.
Also, included in our three-year plan is a request for supplies and
other expenses related to the increased services to victims of
crime related to the Victims ' Rights Amendment. With a full-time
counselor funded by Weld County and the utilization of interns and
volunteers, the Victim Assistance Program in the 19th Judicial
District would be capable of expansion and enhancement of services
to victims of crime.
In addition, it is planned to continue working with other agencies
in Weld County through the Coordinating Committee for Victims of
Crime to assess and improve the services to victims of crime.

support for continued partial VOCA funding for the services
provided by Jennifer Walker in the Victim's Assistance
office.
Jennifer is an invaluable resource to our clients, women who
are victims of domestic violence. She supports them
throughout the criminal justice process from their initial
victimization through their participation as witnesses in
the court proceedings for the perpetrator. She also
coordinates with A Woman's Place to make sure that the
victims understand the domestic violence cycle and how it
affects their lives and that they have access to available
services to help them learn how to break that cycle.
Continued V0CA funding would help ensure the continuation of
these valuable services for battered women in Weld County.
We strongly encourage continued VOCA funding for these
services.
