RE: VACATE PLATTED ROAD RIGHT-OF-WAY AND ACCEPT DEEDS FOR RIGHT-OF-WAY OF WELD

U WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
a
o G7 with the authority of administering the affairs of Weld County, Colorado, and

q WHEREAS, the Board has been informed that Weld County Road 90 as it is
a physically laid out in Sections 24 and 25, Township 8 North, Range 66 West of the
UW 6th P.M. , Weld County, Colorado, is not located in the right-of-way which was
w tx originally platted in 1902, being more particularly described in Exhibit "A"
`-4no which is attached hereto and incorporated herein by reference, and
i a WHEREAS, the owners of Lots A and B of Recorded Exemption Number
ONO 0553-25-2-RE1294 have requested that Weld County vacate the right-of-way as
v x originally platted through those two lots, and accept deeds for the north 30 feet
CV W of those two lots, so as to accommodate the present physical position of Weld
H County Road 90 in Sections 24 and 25, Township 8 North, Range 66 West of the 6th
o W P.M. , Weld County, Colorado, and

zWHEREAS, pursuant to Section 43-2-303, C.R.S. , the Board has the authority
N to vacate rights-of-way in accordance with the provisions set forth therein.

W NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
cw County, Colorado, that the right-of-way for Weld County Road 90 as it was
N 10 originally platted through Lots A and B of Recorded Exemption Number
M LO 0553-25-2-RE1294 and as described in the attached Exhibit "A" is hereby vacated,
re .4 in accordance with the provisions of Section 43-2-303, C.R.S.

BE IT FURTHER RESOLVED by the Board that the properties deeded in the
attached Quit Claim Deeds are hereby accepted.
