RESOLUTION RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR AN AGRICULTURAL SERVICE ESTABLISHMENT (ORGANIC MATERIALS COMPOSTING AND PROCESSING FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT - DUANE AND FRANCIS WILSON (A-1 ORGANICS) WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 30th day of January, 1991, at the hour of 10:00 a.m. , in the Chambers of the Board for the purpose of considering the request of Duane A. and Francis E. Wilson, A-1 Organics, 16350 Weld County Road 76, Eaton, Colorado 80615 for a Site Specific Development Plan and a Special Review Permit for an Agricultural Service Establishment (organic materials composting and processing facility) in the A (Agricultural) Zone District on the following described property to wit: Part of the E/2 NW/4 of Section 35, Township 7 North, Range 66 West of the 6th P.M. , Weld County, Colorado WHEREAS, Duane A. Wilson, applicant, being present; and WHEREAS, Sections 24. 7 and 24.3 of the Weld County Zoning Ordinance provide standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendation of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: a. The proposed special review permit area is located within the Urban Growth Boundary of the Town of Eaton and the Town of Ault. A representative of the Town of Eaton in his referral response indicated that the Town has no objections to the request. A representative of the Ault Planning Commission in his referral response stated that the request complies with Ault's Comprehensive Plan. The location of the Special Review Permit site and the attached conditions and development standards will ensure consistency with the goals and policies of the Weld County Comprehensive Plan. The proposal is consistent with the intent of the Agricultural Zone District and, as an agricultural service establishment, is provided for as a Use by Special Review. c. The uses which will be permitted will be compatible with the existing surrounding land uses and with the future development of the surrounding area. Surrounding land uses include oil and gas production, agricultural production, a feedlot, and residences. Conditions of Approval and Development Standards will ensure compatibility. d. No overlay districts affect the site. e. Special Review Permit Development Standards and Conditions of Approval will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and a Special Review Permit for an Agricultural Service Establishment (organic materials composting and processing facility) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Within 30 days of approval by the Board of County Commissioners: a. the applicant shall submit evidence to the Department of Planning Services that the Weld County Health Department has determined that the facility is in compliance with the Colorado Guidelines for Feedlot Runoff Containment. 910079 Page 3 RE: Special Review Permit - Duane A. and Francis E. Wilson b. the applicant shall submit evidence to the Department of Planning Services that an application for all required emissions permits has been submitted to the Air Pollution Control Division, Colorado Department of Health, for fugitive dust and odors. c. the existing septic systems shall be reviewed by a Colorado Registered Professional Engineer, and a copy of that review submitted to the Weld County Health Department for ISDS evaluation. The Site Specific Development Plan and Special Review Permit is for an organic materials composting and processing facility as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 C.R.S. , as amended. 3. The applicant shall store, handle, and compost manure in a manner that will prevent nuisance conditions. The manure and other waste piles shall not exist or deteriorate to a condition that facilitates excessive odors, flies or insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 4. The facility shall be maintained at all times in compliance with the Colorado Guidelines for Feedlot Runoff Containment. 5. Waste oil, treatments, anti-freeze, and other associated liquid and solid wastes, shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. The property shall be maintained in compliance with the Air Pollution Control Division, Colorado Department of Health, Emissions Permit for fugitive dust and odors. 7. No permanent disposal of wastes shall be permitted at this site. 8. Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 9. Fugitive dust shall be controlled on this site. 10. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 910079 Page 5 RE: Special Review Permit - Duane A. and Francis E. Wilson 13. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 14. The property owner or operator shall be responsible for complying with the supplementary regulations of Section 45.2 of the Weld County Zoning Ordinance. 15. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 16. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 17. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Composting of some paper products will be done in conjunction with Brad Keirns at the landfill site. The Board of County Commissioners asked that they be allowed to watch the paper and phone book grinding operation. Mr. Wilson stated they will be holding an open house all day on February 28, and March 1, and 2. There were no public comments. Commissioner Webster moved the Board approve the request of Duane A. and Francis E. Wilson, A-1 Organics, for a Site Specific Development Plan and Special Review Permit for an Agricultural Service Establishment for an organic materials composting and processing facility in the A (Agricultural) Zone District based on the recommendation of the staff and the Planning Commission. Duane Wilson, applicant, submitted a request to conduct an agricultural service establishment. He explained that what this involves is making compost from organic waste materials. Mr. Wilson explained that he is working very hard to try to keep organic waste out of the landfills by turning them into a beneficial use through composting. This process takes the odor out, and makes it a very stable commodity by eliminating air pollution or underground water pollution. The chairman called for questions from the board. Don Feldhaus asked if Christmas Trees would fall into this category. Duane Wilson, explained that it would, but not this year. They will have a large grinder and will be looking at this process in the future. Bud Clemons wanted to verify that this was the same site that had been in production in the past. Duane Wilson acknowledged that it was. The chairman called for discussion from the audience. There was none. The Chairman asked Mr. Wilson if he had had an opportunity to review the comments and that he would have no objection to placing them into the record instead of reading them. Duane Wilson answered yes, he agreed. Bud Clemons stated, for the record, that he has known Mr. Wilson for a number of years and have personally been to the site. He stated that Mr. Wilson is a diligent caretaker of the property and if there are any concerns from neighbors, he is sure Mr. Wilson will address those concerns .
