RE: APPROVE GRANT OF EASEMENT AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Grant of Easement between
Luree Tatum, 1930 Railroad Diagonal, Evans, Colorado 80620, and the County of
Weld, by and through the Board of County Commissioners, with the terms and
conditions being as stated in said Grant of Easement, and
WHEREAS, after review, the Board deems it advisable to approve said Grant
of Easement, a copy of which is attached hereto and incorporated herein by
reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Grant of Easement between Luree Tatum, 1930 Railroad
Diagonal, Evans, Colorado 80620, and the County of Weld, by and through the
Board of County Commissioners, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is,
authorized to sign said Grant of Easement.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 18th day of January, A.D. , 1993.

GRANT OF EASEMENT
The undersigned fee owner of the following described parcel of
land (the "Property" ) , as "Grantor, " hereby grants and conveys to
Luree Tatum, 1930 Railroad Diagonal, Evans, Colorado, 80620, as
"Grantee, " an easement on, over, and across, the Property, for the
sole purpose of maintaining a house and a garage thereon. The
easement shall exist from the date of signing as set forth below to
and until the date upon which the Grantor vacates the right-of-way
which bisects the Northwest Quarter of Section 30, Township 5
North, Range 65 West of the 6 P.M. , Weld County, Colorado,
otherwise known as "40th Street" and shown on the "Map of Evans,
Weld County, Colorado, Showing the Adjacent Lands as Subdivided by
the St. Louis Western Colony, 1873, " and kept in the office of the
Weld County Clerk and Recorder in Envelope No. 4, or until such
time as the Grantee or its successors in interest demolish or
remove the said house and garage.
This grant and conveyance is made without warranties of title,
but is irrevocable and is binding upon the Grantor, its successors,
heirs, and assigns . This Grant does not include any rights and
interests in and to the oil, gas, and other minerals in, on, and
under the Property.
The "Property" is described in the attached Exhibit "A" .

The thirty ( 30) feet immediately south of and adjacent to all of
that part of Lot Five (5) of the NE} of the NW} of Section Thirty
(30) , Township Five ( 5) North, of Range Sixty-five (65) West of the
6th P.M. , County of Weld, State of Colorado, lying South of the
abandoned Denver, Laramie and Northwestern Railroad or Railway
Right-of-way, as the same was surveyed and located over and across
the said NE* of the NW* of Section 30, in Township 5 North, of
Range 65, West of the 6th P.M. EXCEPT that part of lot Five (5) in
the Northeast Quarter (NE* ) of Section Thirty (30) , Township Five
(5) North, Range Sixty-five (65) West of the Sixth Principal
Meridian, Beginning at the Southwest Corner of Lot 5, West line
considered to be N. 00 Degrees 00 ' East 28 .45 feet;
thence North 49 Degrees 41 ' 40" East 32 .78 feet;
thence South 00 Degrees 00 ' 00" East 49 . 84 feet;
thence North 89 Degrees 34 ' 00" West 25 feet; to the Point of
Beginning.
