GRIESS vs WELD COUNTY BOARD OF EQUALIZATION Dear Petitioner: The Board of Assessment Appeals received a letter from Weld County Assessor' s Office postmarked October 4 , 1993 , on October 5, 1993 . Rule 6 of the "Rules of the Board of Assessment Appeals" requires all appeals to the Board to be on forms prescribed by the Board. I have enclosed the Board' s petition form and packet of information for your use in filing the above-referenced appeal . Please prepare your appeal according to the instructions in the cover letter and return it to the Board no later than October 20 , 1993 , or within 30 days from the date of the Weld County Board of Equalization' s decision (whichever is the later date) . If you are filing on the behalf of a property owner or a corporation, please pay particular attention to 1 .b on page 2 and 4 .b. on page 3 of the "Dear Petitioner" letter attached to the appeal form. The Board will rule as to whether jurisdiction can be accepted when all documentation is- received. ALL MATERIAL FILED WITH THIS BOARD MUST BE SUBMITTED IN QUADRUPLICATE. Griess Dear Ms . DeVries : James T. and Ruth H. Griess own property located at 2801 11th Street Road, Greeley, Colorado 80631 . This property is also known as Lot 11 of Block 4 , in the Wilshire Subdivision of Greeley and is listed in this office as Parcel No. 095912202012 . Mr. and Mrs . Griess received their Notice of Valuation on or about May 1, 1993 . They protested their valuation to the Weld County Assessor. Enclosed is a copy of the Notice of Adjustment dated May 13, 1993, wherein the Assessor' s valuation on the property was adjusted from $83 ,752 to $75,500 . Also enclosed is a copy of the Weld County Assessor' s Office "1993 Personal Inquiry. " The Personal Inquiry has attached to it three pages of information regarding comparables . The information on the comparables was used in making the adjustment. Mr. and Mrs . Griess received the Notice of Adjustment and the information about their right to appeal the assessor' s decision in mid May, 1993 . A copy of the advisement on the Griess ' right to appeal is enclosed. The Griess ' s then completed the "Personal Property Protest Form" and mailed the same to the Weld County Assessor' s Office by certified mail, which was received on June 23, 1993 . A copy of the Notice of Valuation, date stamped as being received at the Weld County Assessor' s Office on June 23 , 1993, along with the Personal Property Protest Form and a copy of the envelope in which these items were mailed. Thus , Mr. and Mrs . Griess ' s protest was received by Weld County on or before July 15 , 1993 . The protest should have gone to the Weld County Board of Equalization. When the Assessor' s Office received the protest, it was considered to be a late filing of an appeal to the assessor. The Assessor' s Office staff failed to see that the Griess ' s had already protested their real property to the Assessor' s Office and failed to realize that this protest should Board of Assessment Appeals October 1, 1993 Page 2 have been transferred on to the Weld County Board of Equalization. Enclosed is a copy of the "Notice of Denial" which was sent to the Griess ' s on June 24 , 1993 . The result is that the Weld County Board of Equalization never heard the Griess ' s protest for Parcel No. 095912202012 , in spite of the fact that the Griess ' s filed their protest in a timely fashion. It is my understanding that in cases such as these, the state Board of Assessment Appeals has jurisdiction to hear the tax protest, pursuant to Section 39-2-125 ( 1) (e) , C.R.S . I have provided a copy of this letter to Mr. and Mrs . Griess . I have also provided them with an explanation as to how they should go about appealing their valuation to the Board of Assessment Appeals . Griess Dear Ms . DeVries : I am requesting a hearing to the State Board of Assessment Appeals . Somehow our request was overlooked before the Weld Board of Equalization. Inclosed you will find a copy of the letter to your office from the Weld County Assessor' s OYfice and a copy of his letter to us . We will be leaving in another week for Arizona for the winter.
