BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
SEPTEMBER 16, 1991

The Board of County Commissioners of Weld County, Colorado, met
in regular session in full conformity with the law and bylaws of
said Board at the regular place of meeting in the Weld County
Centennial Center, Greeley, Colorado, September 16, 1991, at the
hour of 9:00 A.M.
ROLL CALL: The meeting was called to order by the Chairman and on roll call
the following members were present, constituting a quorum of the
members thereof:
Commissioner Gordon E. Lacy, Chairman
Commissioner George Kennedy, Pro-Tem
Commissioner Constance L. Harbert
Commissioner C. W. Kirby
Commissioner W. H. Webster
Also present:
Weld County Attorney, Thomas O. David
Acting Clerk to the Board, Carol Harding
Finance and Administration Director, Don Warden
MINUTES: Commissioner Kennedy moved to approve the minutes of the Board
of County Commissioners meeting of September 11, 1991, as
printed. Commissioner Webster seconded the motion, and it
carried unanimously.
CERTIFICATIONS
OF HEARINGS: Commissioner Kennedy moved to approve the Certifications for the
hearings conducted on September 11, 1991, as follows: 1) Show
Cause Hearing, James McDonald, c/o Adrenalin Adventures; and 2)
Show Cause Hearing, James McDonald. Commissioner Harbert
seconded the motion, and it carried unanimously.
ADDITIONS: There were no additions to today's agenda.
CONSENT AGENDA: Commissioner Kennedy moved to approve the consent agenda as
printed. Commissioner Harbert seconded the motion, and it
carried unanimously.

REPORTS: There were no reports given today.
WARRANTS: Don Warden presented the following warrants for approval by the
Board:
General fund $175,386.53
Handwritten warrants:
General fund $ 1,263.00
Commissioner Kennedy moved to approve the warrants as presented
by Mr. Warden. Commissioner Webster seconded the motion which
carried unanimously.
Let the record reflect that a recess was taken at this time to
allow the Board to convene as the Board of Social Services.

BUSINESS:
NEW: CONSIDER TAX ABATEMENT PETITION FROM FRANKLIN M. AND MARGARET J.
JOHNSON: Gordon Bachman, Assessor's Office, gave the Assessor's
recommendation for approval based upon an illegal land split,
which results in less value for the land. A motion was made by
Commissioner Harbert to concur with the Assessor's
recommendation. Seconded by Commissioner Webster, the motion
carried unanimously.
CONSIDER TAX ABATEMENT PETITION FROM JOHN D. AND JEAN L. EACHUS:
Mr. Bachman explained the Assessor is recommending approval
based on a 30' road which was assessed in error. Commissioner
Harbert moved to approve said Petition. Seconded by
Commissioner Kennedy, the motion carried unanimously.
CONSIDER TAX ABATEMENT PETITION FROM JERRY DEAN AND CORTNEY
ILEANE MILLER: Mr. Bachman stated the Assessor is recommending
approval since proof has now been submitted proving this parcel
is valid agricultural land. Commissioner Kirby moved to approve
said Petition. Seconded by Commissioner Webster, the motion
carried unanimously.
CONSIDER TAX ABATEMENT PETITION FROM RAYMOND KETTLER, LILLIAN
BURROW, AND BETTY K. MCRAE: Mr. Bachman explained the Assessor
is recommending approval of this parcel since the 1990 value was
adjusted, it can now be applied to the previous year.
Commissioner Webster moved to approve said recommendation.
Seconded by Commissioner Kirby, the motion carried unanimously.
CONSIDER THREE ASSIGNMENTS OF OIL AND GAS LEASE FROM KAPPA NU II
PARTNERSHIP TO BOSWELL ENERGY CORPORATION - 524, TBN, R66W; 514,
TBN, R66W; AND 56, TBN, R65W: Mr. David explained his office
has reviewed the applicable leases and is recommending approval
of the assignments. Commissioner Webster moved to approve said
assignments. Seconded by Commissioner Kirby, the motion carried
unanimously.
CONSIDER MATERNAL AND CHILD HEALTH PRENATAL CONTRACT WITH STATE
DEPARTMENT OF HEALTH AND AUTHORIZE CHAIRMAN TO SIGN: Jeannie
Tacker, Health Department, reviewed the contract for maternal
and child health. Weld County will receive $37, 118 to provide
prenatal care for 33 non-Medicaid patients, 200 home visits, and
diagnostic testing services. The term of the contract is
October 1, 1991 through September 30, 1992. Commissioner Kirby
moved to approve said Contract and authorize the Chairman to
sign. Seconded by Commissioner Harbert, the motion carried
unanimously.
CONSIDER HANDICAPPED CHILDREN'S PROGRAM CONTRACT WITH STATE
DEPARTMENT OF HEALTH AND AUTHORIZE CHAIRMAN TO SIGN: Ms. Tacker
reviewed the contract for 258 handicapped children. Weld County
will receive $5,912 to cover the costs of nurse activities and
services given to patients, casefinding, assisting with
registrations, doing home visits, clinic management, and follow-
up to children who require intensive care. The period is
September 1, 1991 through September 30, 1992. Commissioner
Webster moved to approve said Contract and authorize the
Chairman to sign. Seconded by Commissioner Harbert, the motion
carried unanimously.

CONSIDER CONTRACT BETWEEN STATE DEPARTMENT OF PUBLIC SAFETY,
DIVISION OF CRIMINAL JUSTICE, AND WELD COUNTY COMMUNITY
CORRECTIONS BOARD AND AUTHORIZE CHAIRMAN TO SIGN: Jan Allison,
Assistant County Attorney, explained the delay in presenting
said Contract for approval. This is the Contract for the
Community Corrections program in Weld County. Commissioner
Kirby moved to approve said Contract and authorize the Chairman
to sign. Seconded by Commissioner Kennedy, the motion carried
unanimously.
CONSIDER ADDITIONS TO LIST OF ARBITRATORS FOR PROPERTY
ASSESSMENT APPEALS: Mr. Bachman explained that since more
property tax assessment appeals are going through arbitration
this year, it is necessary to add more names to the arbitrators
list. The Assessor recommends adding the names of Ernie Scott,
George Barber, Lynn J. Karowsky, Kim R. Houtchens, and Roger A.
Klein as arbitrators. Commissioner Kirby moved to approve said
recommendation. Seconded by Commissioner Kennedy, the motion
carried unanimously.
FINAL READING OF ORDINANCE N0. 119-I, AMENDMENTS TO WELD COUNTY
BUILDING CODE ORDINANCE: Commissioner Kennedy moved to read by
title only. Seconded by Commissioner Kirby, the motion carried
unanimously. Mr. David read the title of Ordinance No. 119-I.
Chairman Lacy asked for public comments. There were none.
Commissioner Kennedy moved to approve Ordinance No. 119-I on
final reading. Seconded by Commissioner Harbert, the motion
carried unanimously.
RESOLUTIONS AND
ORDINANCES: The Resolutions were presented and signed as listed on the
consent agenda. Ordinance No. 119-1 was approved on third and
final reading.
Let the minutes reflect that the above and foregoing actions
were attested to and respectfully submitted by the Acting Clerk
to the Board.
There being no further business, this meeting was adjourned at
9:15 A.M.

The Board of County Commissioners of Weld County, Colorado, met
in regular session as the Board of Social Services in full
conformity with the law and bylaws of said Board at the regular
place of meeting in the Weld County Centennial Center, Greeley,

of Social Services meeting of September 11, 1991, as printed.
Commissioner Harbert seconded the motion, and it carried
unanimously.

the amount of $28,913.30. Commissioner Kennedy moved to approve
the warrants as presented by Mr. Warden. Commissioner Kirby
seconded the motion which carried unanimously.
