RE: ALLOCATION OF FEDERAL FUNDS RECEIVED FOR PAWNEE GRASSLANDS
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS , Weld County annually receives payment-in-lieu o£
taxes and U.S. Forest Service funds for federally owned property
in Weld County, and
WHEREAS, the funds, in accordance with State statute, must be
allocated between the County Road and Bridge fund and public
schools in the County, but not less than five percent of the
amount received annually shall be allocated for either purpose,
and
WHEREAS , Weld County is the only county sharing more than 58
with schools , and
WHEREAS, under the School Finance Act, school districts are
not penalized for receiving these funds , and
WHEREAS, the original intent of the payment-in-lieu of taxes
for Federal land was to mitigate local impacts of the Federal
lands , and
WHEREAS , no school children reside on the Federal lands to
impact school districts, and
WHEREAS, Weld County maintains several miles of roads in the
Pawnee Grasslands and collects no taxes for the Federal
government.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado that, effective with the
1991 budget, only 27. 58 of the U.S. Forest Service funds shall be
allocated to school districts per State statute, and beginning in
1992 only 58 shall be allocated.
