NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within sixty (60) days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. 2. A Weld County septic permit is required for any new dwelling and its septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. 3. An ISDS evaluation by the Weld County Health Department on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. 4. Prior to recording, the following notes shall be placed on the Recorded Exemption Plat: A. The manure storage site shall have a water-tight surface which does not permit seepage of percolation of manure pollutants into the ground. C. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. D. No permanent disposal of wastes shall be permitted at this site. E. Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. F. The parcel of land on which this request is being made is described as Lot A of RE-882, being part of the NW4 of Section 18, T7N, R65W of the 6th P.M. , Weld County, Colorado. The property is located south of U.S. Highway 14, east of and adjacent to Weld County Road 37. This request is to divide a 12.7 acre parcel into parcels of 10 acres and 2.7 acres, more or less. The applicants plan to retire from the current farming operation and retain their residence and rental house on the 2.7 acres proposed. The remaining 10 acres would be transferred to the applicant' s son who would continue the agricultural use of the lot. There are two existing dwellings on proposed Lot A; a 140 head cattle feeding operation and approximately a 6,000 head sheep feeding operation are located on proposed Lot B. Special Use Permit SUP-148 was approved for an 8,000 head sheep feeding operation on 40 acres in 1972. The Town of Ault has reviewed the application materials and had no objections to the request. The Weld County Health Department has reviewed the application materials and has recommended approval subject to certain conditions. The concerns of the Health Department are addressed in additional comments. The staff has concerns that the proposed division will be inconsistent with efficient and orderly development. In 1986, the lot was created by Recorded Exemption 882 to divide the improvements and feed lot operation from the farm- ground. This request, if approved, would allow for the addition of a dwelling on Lot B, further intensifying the density of the uses on the property. 920128 RECOMMENDATION, RE-1391 Jacob R. and Audrey Hasbrouck Page 2 The staff also has concerns about the present uses of the feedlot and whether or not there is sufficient area to comply with the Colorado Guidelines for Feedlot Runoff Containment. The drainage from the feedlot flows in a southeast direction with no area available for containment ponds due to the location of existing pens and the east property boundary. The Staff recommends that the Board of County Commissioners consider this request and determine if the standards of Section 9-2 E. (1) (a) through (m) of the Weld County Subdivision Regulations have been met. The facility shall be in compliance with the Colorado Guidelines for Feedlot Runoff Containment. 3. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The manure storage site shall have a water-tight surface which does not permit seepage or percolation of manure pollutants into the ground. 4. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. No permanent disposal of wastes shall be permitted at this site. 6. Wood shavings, saw dust, and waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. R. lasbrouch, Ault, Colorado, requesting permission for expansion of an existing feedlot operation on the following described property, to-wit: The North Half of the South Half of the Northwest Quarter (N+SZNWI) of Section Eighteen (18), Township Seven (7) North, Range Sixty-five (65) West of the Sixth P. M. , Weld County, Colorado, containing 40 acres more or less, and WIIEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for the expansion of an existing feedlot operation, and WI[EREAS, the said requested expansion of an existing feedlot operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said feedlot operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of J. R. Hasbrouch, Ault, Colorado, for expansion of an existing feedlot operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to expand said feedlot operation and that he shall have up to one year from date hereof to begin construction for the expansion thereof. 3. That when expansion of said feedlot operation is completed, same shall not contain more than 8, 000 sheep at any one time. 4. All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado.
