Ile said he is in agreement with everything stated, except he needed further clarification on dispositioning topsoil "as soon as possible". I explained how the topsoil will be pushed back into the lake as soon as the raw aggregate material is removed from the lake bottom. John also said he was very pleased with the actions I have taken, especially since I have had an open dialogue with him for over a year concerning my project. We both agreed there ie a reasonable solution to this entire problem. After I was told by Planning there are other gravel pits in Weld County that should be issued'the name violation I hove been issued, I explained to John what I believe to be a juotifiable course of action for Laku Landing, all other gravel pits in operation in the Flood Hazard Overlay District and the Weld County Board of Commissioners. He stated this may be a workable solution, but did not absolutely say he agreed with it. Although the ideas presented next are my own, they should not be construed as a directive to the Board. I do, however, feel obligated to present any ideas that may help resolve this matter. 1. Hold a meeting with the Commissioners, FEMA and myself to discuss FEMA'e minimum requirements for Weld County to remain in the Flood Insurance Program with respect to Laku Landing. 2. Itewrite the Flood Hazard Development Permit so there is no ambiguity In the intent, and the developer is not lead to believe that the only standards that apply are on page three of the permit. In addition, more detail is needed concerning as-built and the construction phase. The fact that Planning could not answer my questions about the permit and had to meet with FEMA to get only some of the answers, tells me the permit is unclear. 3. Decide how Weld County would like any gavel pit in the Flood Hazard Overlay District to operate, and treat them all equally. If it is determined that IiEC II needs to be run and a Flood Hazard Development Permit is needed, every pit should do the exact same amount of work, and be given the same time frame to comply. .
