RE: APPROVE VACATION OF SUBDIVISION EXEMPTION #353 - JOE PELZ
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, by Administrative Review on December 28, 1988, Department of
Planning Services staff did approve Subdivision Exemption #353 at the request of
Joe Pelz, and
WHEREAS, said action was taken concerning property described as:
Part of the NE* of Section 30, Township 7 North, Range
64 West of the 6th P.M. , Weld County, Colorado
WHEREAS, Joe Pelz has requested vacation of Subdivision Exemption #353 in
order to comply with Condition of Approval 05 of Recorded Exemption #1564, which
was approved by staff on November 30, 1993, and
WHEREAS, after hearing testimony on said matter, the Board deemed it
advisable to grant said request.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Subdivision Exemption #353 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded,
adopted by the following vote on the 29th day of December, A.D. , 1993.

Sobiect:
Staff administratively approved RE-1564 and, as a Condition of Approval, the
applicant needs to vacate SE-353. To accomplish this, they need a resolution
from the Board of County Commissioners which stipulates this vacation. Enclosed,
please find a letter from the applicant addressing this issue and a copy of RE-
1564 administrative review Conditions of Approval. Planning staff recommends
approval of this request.

TO WHOM IT MAY CONCEJN:
SE-353 was approved in 1988 for the purpose of obtaining a Residential loan on
the home.
RE-1564 has been approved on the same parcel subject to SE-353 being
vacated.
Therefore,I am asking the Weld County Board of County commissioners to
vacate SE-353 in order to obtain approval of RE-1564.

APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that the standards
of Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance have been met.
This Recorded Exemption is approved with the following conditions in accordance with
information submitted in the application and the policies of the County.
Prior to recording the plat:
1. The applicant shall submit evidence that an ISDS evaluation has been completed by
the Weld County Health Department on all existing septic systems.
2. The applicant shall obtain a resolution from the Board of County Commissioners to
vacate SE-353.
The Individual Sewage Disposal System permit shall be finalized and approved by an
Environmental Protection Specialist within one (1) year of the application date.
The applicant shall submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared
in accordance with the requirements of Section 11.7 of the Weld County Subdivision
