RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR HOME BUSINESS (WELDING AND REPAIR SHOP) IN THE A (AGRICULTURAL) ZONE DISTRICT - MICHAEL A. PIERRO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 18th day of July, 1990 , at the hour of 10 : 00 a.m. in the Chambers of the Board for the purpose of hearing the application of Michael A. Pierro, 7106 Maple Street, Longmont, Colorado 80504 , for a Site Specific Development Plan and Special Review Permit for a home business (welding and repair shop) in the A (Agricultural) Zone District on the following described real estate, to-wit: Lot 26 , Enchanted Hills Subdivision, Weld County, Colorado WHEREAS, said applicant was present, and WHEREAS, Section 24 .4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1 . The submitted materials are in compliance with the application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 .4 . 2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Weld County Comprehensive Plan' s Agricultural Goals and Policies and the Urban Growth Boundary Goals and Policies. Businesses are encouraged to minimize the removal of prime agricultural land from production. The Urban Growth Boundary Area Goals PL0811 900629 Page 2 RE: USR - PIERRO encourage the maintenance of Urban Growth Boundary Areas that provide an official definition between future urban and agricultural land uses. The Tri-Area Planning Commission' s recommendation is addressed in additional comments. The Conditions of Approval and Development Standards will ensure that the Comprehensive Plan' s Goals and Policies are met. b. The proposed use is consistent with the intent of the Agricultural Zone District. The proposed use is a home business and is provided for as a Use by Special Review in the Agricultural Zone District. c. The use which would be permitted will be compatible with the existing surrounding land uses and with the future development of the surrounding area. Surrounding land uses include rural residences, two dog kennels, and Weld County Roads 15 and 22. d. No overlay districts affect the site. e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for a home business (welding and repair shop) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1 . The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder' s Office within 15 days of approval by the Board of County Commissioners. 2 . The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 900629 Page 3 RE: USR - PIERRO 3 . Within thirty days of approval by the Board of County Commissioners , an ISDS evaluation on all existing septic systems will be necessary prior to issuing the required septic permits on the existing systems. 4 . Within 30 days of approval by the Board of County Commissioners, any required emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health. The Site Specific Development Plan and Special Review Permit is for a home business (welding and repair facility) as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2 . Approval of this plan may create a vested property right pursuant to Article 68 of Title 24 , CRS, as amended. 3 . Waste oil, waste paints, stains, treatments , anti-freeze, and other associated liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4 . No permanent disposal of wastes shall be permitted at this site. 5 . Wood shavings, sawdust, and waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 6 . Fugitive dust shall be controlled on this site. 7. The maximum permissible noise level shall not exceed the light industrial limit of 70dB (A) , as measured according to Section 25-12-102 , CRS. 8 . Operation of the facility shall be between the hours of 7: 00 a.m. and 6:00 p.m. This restriction shall not apply to operation of administrative offices or repair facilities totally enclosed within a building. 9 . Vehicles to be repaired shall be stored in the parking area north of the shop. No more than 4 vehicles to be repaired may be stored on the property at any time. 10 . Painting shall not exceed 20 hours per month. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12 . The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 900629 Page 2 RE: DEVELOPMENT STANDARDS - PIERRO 13. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24 .6 of the Weld County Zoning Ordinance. 14 . Personnel from the Weld County Health Department, Longmont Fire Protection District, and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 15 . The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16 . The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. PIERRO A public hearing was conducted on July 11, 1990, at 10:00 A.M. , with the following present: Commissioner Gene R. Brantner, Chairman Commissioner George Kennedy, Pro-Tem Commissioner Constance L. Harbert Commissioner C.W. Kirby Commissioner Gordon E. Lacy Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee D. Morrison Planning Department representative, Keith Schuett The following business was transacted: I hereby certify that pursuant to a notice dated June 25, 1990, and duly published July 5, 1990, in The New News, a public hearing was conducted to consider a Site Specific Development Plan and Special Review Permit for a home business (welding and repair shop) in the A (Agricultural) Zone District. Lee D. Morrison, Assistant County Attorney, made this matter of record. Keith Schuett, Planning Department representative, entered the favorable recommendation of the Planning Commission into the record. Michael A. Pierro, applicant, came forward to explain his request. Commissioner Lacy asked questions pertaining to the number of cars that would be setting outside the shop. Mr. Schuett said Development Standard #9 limits the number of vehicles to four. Commissioner Lacy asked questions about painting. He also asked Mr. Pierro if he is aware of the environmental health regulations. Mr. Morrison said the painting issue was not part of the application submitted to the Planning Commission. Commissioner Kirby said he would like to hear more testimony on the paint issue than what was heard by the Planning Commission. Mr. Pierro said his paint shop will be between two other buildings on approximately two and one-half acres. He said this building would be about 200 feet from the nearest resident. Chairman Brantner commented on the strictness of the regulations for paint booths. Mr. Pierro said he only spends about three hours per unit per month painting. Mr. Morrison stated that the painting would be incidental to the welding. After further discussion, Mr. Schuett said Development Standard #10 would be added to state: "Painting shall not exceed 20 hours per month." The following Development Standards will be numbered consecutively. Commissioner Harbert moved to approve the request for a Site Specific Development Plan and Special Review Permit, subject to the Conditions and Development Standards contained in the Planning Commission's recommendation, and the addition of Development Standard #10. Commissioner Kirby seconded the motion. Chairman Brantner asked when Mr. Pierro will be heard by Tri-County. Mr. Pierro said he is scheduled for August 7. He presented pictures of a 180 foot tower at Pueblo, which is very similar to this tower, to show the visual impacts. The picture was retained as evidence. An access agreement will be reached after this request is approved and the lease has been signed. The property is currently , and will remain to be , vegetated with pasture grass which will very effectively prevent any significant erosing from occurring on the site .
