' I 11 e ' t l 3:,!, ,t 4. i Ai 1 Z ,,./ 2 g 'a g =5, ! oi , ;.,4, : E 11`1 ' . , . ❑ . ,ll, n ' iii : Alai .3 : ai 9Zoo-n RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT TO ALLOW ONE SINGLE FAMILY DWELLING UNIT, TO REMOVE ALL ABOVE GROUND NATURAL GAS FACILITIES EXCEPT AN ACCESSORY BUILDING, AND TO ADD A METER HOUSE AND BOOSTER COMPRESSOR IN THE A (AGRICULTURAL) ZONE DISTRICT - WINDSOR GAS PROCESSING WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 29th day of January, 1992, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Windsor Gas Processing, 1601 West First Street, Loveland, Colorado 80537, for a Site Specific Development Plan and Amended Special Review Permit to allow one single family dwelling unit, to remove all above ground natural gas facilities except an accessory building, and to add a meter house and booster compressor in the A (Agricultural) Zone District on the following described real estate, to-wit: Part of the SE*, Section 11, Township 6 North, Range 67 West of the 6th P.M. , Weld County, Colorado WHEREAS, said applicant was represented by Ralph Nelms, Operations Manager, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Special Review Permit, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: a. The proposal is consistent with the Urban Growth Boundary Goals and Policies of the Weld County Comprehensive Plan. The Towns of Severance and Windsor have reviewed this proposal and have no objections to the request. b. The uses which would be permitted will be compatible with the existing surrounding land uses which include farmground, rural residences, and oil and gas production. The uses will also be compatible with the future development of the surrounding area as projected by the Towns of Severance and Windsor. d. The applicant has demonstrated a diligent effort has been made to conserve productive agricultural land. e. No overlay districts affect the site. f. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Amended Special Review Permit to allow one single family dwelling unit, to remove all above ground natural gas facilities except an accessory building, and to add a meter house and booster compressor in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Amended Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. The mobile home as permitted by original USR-581 is not permitted by this amendment. 4. Within 30 days of approval by the Board of County Commissioners: a. The tank cradles and any associated items on this property not approved by this Amended Special Review Permit shall be removed from the property. b. An I.S.D.S. evaluation by the Weld County Health Department shall be performed on any existing septic systems, prior to issuing the required septic permits. All systems to be abandoned shall be abandoned in compliance with the Weld County I.S.D.S. Regulations. 920077 AMENDED SPECIAL REVIEW PERMIT - WINDSOR GAS PROCESSING PAGE 3 5. Prior to recording the Special Review Permit plat, the following note shall be placed on the plat: a. The home to be placed on this site shall not be a mobile home or a manufactured home as defined by the Weld County Zoning Ordinance. The home shall be placed on a permanent foundation. Webster 920077 SITE SPECIFIC DEVELOPMENT PLAN AMENDED SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS WINDSOR GAS PROCESSING AMENDED USR-581 1. The Site Specific Development Plan and Amended Special Review Permit is to allow a single family dwelling unit, to remove all above ground natural gas facilities except an accessory building, and to add a meter house and booster compressor in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. Any required emissions permit shall be obtained from the Colorado Department of Health, Air Pollution Control Division. 5. No permanent disposal of wastes shall be permitted at this site. 6. Fugitive dust shall be controlled on this site. 7. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 8. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 9. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 10. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 920077 DEVELOPMENT STANDARDS - WINDSOR GAS PROCESSING PAGE 2 11. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 12. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 13. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Harbert, Pro-Tem Commissioner C. W. Kirby Commissioner Gordon E. Lacy Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Lanell Swanson The following business was transacted: I hereby certify that pursuant to a notice dated January 13, 1992, and duly published January 16, 1992, in The New News, a public hearing was conducted to consider the request of Windsor Gas Processing for a Site Specific Development Plan and Amended Special Review Permit to allow one single family dwelling unit, to remove all above ground natural gas facilities except an accessory building, and to add a meter house and booster compressor in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Lanell Swanson, Planning Department representative, read the Planning Commission's unfavorable Resolution of Recommendation into the record. Commissioner Lacy questioned whether the cradles had been removed from the site. Ms. Swanson said they have been removed, and the applicant agreed to place the compressor on the concrete pad, which takes care of staff's concerns. Ralph Nelms, Operations Manager of Windsor Gas Processing, represented the applicant, and showed slides of the site taken last week. Mr. Nelms explained the location of the proposed compressor and home. He said the facility has been in existence since 1983, and a small meter house, approximately 100' x 100' , will be added. Mr. Nelms answered questions of the Board and said he accepts and has complied with all stipulations. Ms. Swanson answered questions of the Board concerning proposed building sites and the process required for a mobile home. Mr. Nelms said there is a dirt pad with a gas line running to it on the property to the north of the site, with construction of a home to start this summer. Let the record reflect a recess was taken at this time to allow Ms. Swanson time to research the status of the property to the north of Windsor Gas Processing's site. Upon reconvening, Ms. Swanson informed the Board an electrical permit has been issued for a farm structure and a water line has been installed. There is no information available as to what type of home is to be constructed. Mr. Nelms said he is aware that residents in Antelope Hills have concerns, and he is willing to have a stipulation added which would not allow a mobile home and require a permanent foundation. Henry Poos, William Rexford, and Geraldine Brodzinski stated concerns about said facility. Mr. Nelms, Ms. Swanson, and the Board responded to their concerns. Ms. Swanson, addressing the concern of the mobile home, said the second sentence of Condition of Approval #3 could be eliminated. Said sentence consists of the following: "Prior to the placement of a mobile home on this property, a zoning permit must be obtained." Commissioner Lacy moved to approve the request of Windsor Gas Processing for a Site Specific Development Plan and Amended Special Review Permit to allow one single family dwelling unit, to remove all above ground natural gas facilities except an accessory building, and to add a meter house and booster compressor in the A (Agricultural) Zone District, based on the recommendation of the Planning staff, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Kirby. After further discussion, the motion carried unanimously. This Certification was approved on the 3rd day of February, 1992. I will be glad to answer any questions I can regarding the staff' s recommendation to the Planning Commission and our intent regarding that recommendation. Any questions you may have regarding the discussion and intent of the Planning Commission would need to be directed to the individual members of that Commission. The staff' s recommendation included proposed Condition of Approval 4, which provided that within 30 days of approval by the Board of County Commissioners, the tank cradles and any associated items on this property not approved by this amended Special Review permit shall be removed from the property. It was the staff's intent under this condition to refer to the concrete pad in the northwest corner of the site. If the concrete pad was to be used for the new compressor and meter house, the pad would not need to be removed. If it was not to be used with the newly approved uses, the staff was requesting its removal. It was not the staff' s intent to require removal of the fence or the small pile of gravel on the property. It was the staff' s intent to require removal of the tank cradles. I have enclosed copies of Sections 90, 24. 5, and 24.6 of the Weld County Zoning Ordinance. Each approved Special Review permit carries conditions requiring compliance with these sections of the zoning ordinance. The case law with respect to Oil and Gas development is inapplicable. He stated all of the facilities designated for removal have been taken off the property. The only thing present on the site is some concrete foundations and concrete supports which they do not intend to remove. Jean Hoffman said she assumed they would remove these concrete cradles. Ralph Nelms said they had no plans to remove these cradles , it would cost him more to remove them than the property is worth. The property will be sold "as is" . He explained these structures could be used, at a later date, as foundation walls for outbuildings, there are four of them, spaced every 35 feet and they are about 8 feet high. Jean Hoffman said she felt these structures were not compatible with surrounding uses. Bud Clemons wanted to clarify the size of the portion to be used for the compressor. Ralph Nelms said it would be a small piece in the northwest corner, just enough area for the compressor. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. Bill Rexford, surrounding property owner, said he thought once the original permit was abandoned, the property would have to return to an A (Agricultural) zone district. He wants to know what type of house was proposed. There is nothing to guarantee the size or type of home to be built. There are many high priced homes in this area, and surrounding property owners are concerned about property values. Lee Morrison explained there were no specific requirements for the type of home built on this property, other than all work would have to be permitted, and have to conform with the Uniform Building Code Requirements.
