RESOLUTION
RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT FOR A
SINGLE FAMILY DWELLING UNIT ON A LOT UNDER THE MINIMUM LOT SIZE IN THE (A)
AGRICULTURAL ZONE DISTRICT - WENDY A. DYER
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the
15th day of May, 1991, at the hour of 10:00 a.m. in the Chambers of the Board for
the purpose of hearing the application of Wendy A. Dyer, 3872 Weld County Road
21, Fort Lupton, Colorado 80621, for a Site Specific Development Plan and
Special Review Permit for a single family dwelling unit on a lot under the
minimum lot size in the (A) Agricultural Zone District on the following described
real estate, to-wit:
Part of the N/2 N/2 NW/4, Section 14,
Township 1 North, Range 67 West of the 6th
P.M. , Weld County, Colorado
WHEREAS, said applicant was present, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides
standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, has studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24.4.2 of the Weld
County Zoning Ordinance as follows:
a. The proposal is located within the urban growth boundary
area of the City of Fort Lupton. The proposal is
consistent with the Weld County Comprehensive Plan's
Urban Growth Boundary Goals and Policies. The City of
Fort Lupton Planning Commission has no objection to this
proposal.
b. The proposal is consistent with the intent of the
Agricultural Zone District and is provided for as a Use
by Special Review.

c. The uses permitted will be compatible with the existing
surrounding land uses which include oil and gas
production, pasture, and rural residences.
d. The uses permitted will be compatible with the future
development of the surrounding area as permitted by the
Fort Lupton Comprehensive Plan and as permitted by the
Agricultural Zone District.
e. No overlay districts affect the site.
f. Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare
of the neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application for a Site Specific Development Plan and
Special Review Permit for a single family dwelling unit on a lot under the
minimum lot size in the (A) Agricultural Zone District on the hereinabove
described parcel of land be, and hereby is, granted subject to the following
conditions:
1. The attached Development Standards for the Special Review Permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's Office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld County
Clerk and Recorder.
3. Prior to the issuance of building permits, an I.S.D.S. evaluation
shall be performed by the Weld County Health Department on all
existing septic systems.
4. Prior to recording:
a. The Special Review permit plat shall be amended to show
the mobile home as proposed. The house shown as
existing on the plat shall be deleted.
b. An easement agreement, approved by the Weld County
Attorney's Office, shall be submitted to the Department
of Planning Services regarding the shared use of the
barn on the south property line.

DEVELOPMENT STANDARDS

1. The Site Specific Development Plan and Special Review Permit is for a
single family dwelling unit on a lot under the minimum lot size in the
Agricultural Zone District as submitted in the application materials on
file in the Department of Planning Services and subject to the Development
Standards stated herein.
2. Approval of this plan may create a vested property right pursuant to
Article 68 of Title 24 C.R.S. , as amended.
3. Areas of the site which are not otherwise covered shall be seeded to
adapted grasses.
4. No drainage from the site shall be allowed to enter the Bull Canal. No
trespass, fences, roadways, walkways or any other use shall be allowed
within 20 feet of the centerline of the Bull Canal.
5. The property shall be maintained in compliance with the requirements of
the Panhandle Eastern Pipe Line Company.
6. The use of the well on this property is limited to ordinary household
purposes inside one single family dwelling, the watering of domestic
animals, and irrigation of not more than 10,000 square feet of home
gardens and lawns.
7. A mobile home shall not be placed on this property unless a zoning permit
for the mobile home has been reviewed and approved.
8. The animal units on the property shall be maintained in compliance with
the Weld County Zoning Ordinance.
9. Should the barn which is on the southern property line be destroyed by any
means to an extent more than fifty percent (509,) of its replacement cost
at time of destruction, it shall not be restored except in conformance
with the provisions of the Weld County Zoning Ordinance. Ordinary
repairs, the value of which do not exceed fifty percent (507,) of
replacement cost of the structure, may be permitted.
10. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
11. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
12. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.

13. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the property
at any reasonable time in order to ensure the activities carried out on
the property comply with the Development Standards stated herein and all
applicable Weld County Regulations.
14. The Special Review area shall be limited to the plans shown herein and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
15. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

The following business was transacted:
I hereby certify that pursuant to a notice dated April 15, 1991, and duly
published April 25, 1991, in The New News, a public hearing was conducted
to consider the request of Wendy A. Dyer for a Site Specific Development
Plan and Special Review Permit for a single family dwelling unit on a lot
under the minimum lot size in the A (Agricultural) Zone District. Bruce
Barker, Assistant County Attorney, made this matter of record. Lanell
Swanson, Planning Department representative, entered the favorable
Resolution of the Planning Commission and the recommendation of the
Planning staff into the record. She said there are four Conditions of
Approval and fifteen Development Standards recommended. Wendy A. Dyer,
applicant, was present, and she said there was a previous house on this
property which was torn down. Commissioner Harbert said there was only
letter of opposition and asked Ms. Dyer if she knew why Marguerite Bateman
was opposed to this request. Ms. Dyer said Ms. Bateman owns the property
to the north but lives in Fort Lupton, and she does not know why Ms.
Batement is opposed. Ms. Dyer said she has no problem with the Conditions
of Approval and Development Standards. Commissioner Kirby asked when this
property was split. Ms. Swanson said the property was split in the last
five years. There was no public testimony concerning this matter.
Commissioner Harbert moved to approve the request of Wendy A. Dyer for a
Site Specific Development Plan and Special Review Permit for a single
family dwelling unit on a lot under the minimum lot size in the A
(Agricultural) Zone District, based on the recommendation of the Planning
staff and the Planning Commission with the Conditions of Approval and
Development Standards as entered into the record. Commissioner Kirby
seconded the motion, which carried unanimously.

A regular meeting of the Weld County Planning Commission was held May 7, 1991 in
the County Commissioners' Hearing Room (Room #101) , Weld County Centennial

LEGAL DESCRIPTION: Part of the SE4 of Section 5, and part of the NE4 of
Section 8, all in T2N, R68W of the 6th P.M. , Weld
County, Colorado.
LOCATION: South of and adjacent to State Highway 119, approximately 1/2 mile
east of Weld County Road 3 1/2.
Art Urich, Nelson Engineering, representative for the applicant wanted to protest
the proposed screening plan along the west, east and south sides of the property.
He stated these are all adjacent to Agricultural areas and didn' t understand why
screening was necessary. Keith Schuett explained that the screening plan was the
minimum requirement necessary to comply with the Weld County Zoning Ordinance and
the P.U.D. zone district. He also mentioned the higher elevation of the property
compared with Highway 119. Shirley Camenisch asked about the volume of traffic.
Art Urich stated that approximately 290 vehicles a day enter from the east and
also exit to the east and that this project would create approximately only 30
trips per day that enter from the west and exit to the west. The Chairman asked
if there was anyone in the audience who would like to speak for or against the
application. No one wished to speak.
Ann Garrison moved that Case Number S-315 for a Planned Unit Development Plan be
forwarded to the Board of County Commissioners with the Planning Commissions
recommendation for approval. LeAnn Reid seconded the motion.

APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2 . It is the opinion of the Department of Planning Services' staff
that the applicant has shown compliance with Section 24.3 of the
Weld County Zoning Ordinance as follows:
The proposal is located within the urban growth boundary area
of the City of Fort Lupton. The proposal is consistent with
the Weld County Comprehensive Plan's Urban Growth Boundary
goals and policies. The City of Fort Lupton Planning
Commission has no objection to this proposal.
The proposal is consistent with the intent of the Agricultural
zone district and is provided for as a use by special review.
- The uses permitted will be compatible with the existing
surrounding land uses which include oil and gas production,
pasture, and rural residences.
- The uses permitted will be compatible with the future
development of the surrounding area as permitted by the Fort
Lupton Comprehensive Plan and as permitted by the Agricultural
zone district.
- No overlay districts affect the site.
Special Review Permit Development Standards will provide
adequate protection of the health, safety, and welfare of the
neighborhood and County.

This recommendation is based, in part, upon a review of the application
materials submitted by the applicant, other relevant information regarding
the request, and responses from referral entities.
The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1. The attached Development Standards for the Special Review permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder' s office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld
County Clerk and Recorder.
3. Prior to the issuance of building permits, an I.S.D.S . evaluation
shall be performed by the Weld County Health Department on all
existing septic systems.
4. Prior to recording:
the Special Review permit plat shall be amended to show the
mobile home as proposed. The house shown as existing on the
plat shall be deleted.

a single family dwelling unit on a lot under the minimum lot size
in the Agricultural zone district as submitted in the application
materials on file in the Department of Planning Services and
subject to the Development Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant
to Article 68 of Title 24 C.R.S. , as amended.
3. Areas of the site which are not otherwise covered shall be seeded
to adapted grasses.
4. No drainage from the site shall be allowed to enter the Bull Canal.
No trespass, fences, roadways, walkways or any other use shall be
allowed within 20 feet of the centerline of the Bull Canal.
5 . The property shall be maintained in compliance with the
requirements of the Panhandle Eastern Pipe Line Company.
6. The use of the well on this property is limited to ordinary
household purposes inside one single-family dwelling, the watering
of domestic animals, and irrigation of not more than 10,000 square
feet of home gardens and lawns.
7. A mobile home shall not be placed on this property unless a zoning
permit for the mobile home has been reviewed and approved.
8. The animal units on the property shall be maintained in compliance
with the Weld County Zoning Ordinance.
9. Should the barn which is on the southern property line be destroyed
by any means to an extent more than fifty percent (50%) of its
replacement cost at time of destruction, it shall not be restored
except in conformance with the provisions of the Weld County Zoning
Ordinance. Ordinary repairs the value of which do not exceed fifty
percent (50%) of replacement cost of the structure may be
permitted.
10. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.

Please find attached a copy of our as-built map, which hi-lights
Panhandle Eastern's pipelines, 16-10-075-351-16" , 16-10-075-10-8"
and 16-10-075-86-4" , located in or near the property described as
the North Half of the North Half of the Northwest Quarter of
Section 14, Township 1 North, Range 67 West, Weld County.
Panhandle does not foresee any conflicts with this request,
however, before approval is given we request that a
representative of Ms_ Dyer and/or contractors doing the
construction/excavation for this project , contact us prior to any
plans of construction regarding the above mentioned property, and
we can discuss their plans and interpret the following
stipulations_
Panhandle Eastern maintains a 50-foot wide right-of-way on all
pipelines and will not allow any building within that easement
area_Utility lines, streets, sidewalks, and driveways may be
installed at approximate right angles to the pipeline herein
authorized, provided, however, that all utilities cross under our
pipeline with a minimum clearance equal to the diameter of the
larger utility or 18" , whichever is greater_No paved or traveled
portion of any street , sidewalk, driveway, road, alley, or
curbing will be placed substantially parallel to and within
fifteen ( 15' ) feet of the pipeline, provided adequate working
space is available on the other side of the pipeline .
In the event of a proposed crossing with a road or utility,
please contact Utility Notification Center of Colorado (UNCC) at
534-6700 (Local & Metro Denver) , or 1-800-922-1987 (Outside the
Metro area) , with two (2) business days notice, and at no cost to
you, we will locate and mark our lines to eliminate accidents
that can occur from foreign forces.

PROCEDURE FOR REQUESTING PREADVERTISING ON A LAND-USE APPLICATION
1. The applicant shall submit a letter to the Clerk to the Board's
office when requesting preadvertising for a Board of County Commis-
sioner' s hearing for a land-use application. The letter shall set
forth the reasons why the applicant is requesting the preadvertise-
ment.
2. The Clerk to the Board's office shall schedule the request for
preadvertisement on the first available regular Board of County
Commissioner's meeting.
3. The Clerk to the Board's office shall inform and furnish a copy of
the letter requesting the preadvertisement to the Department of
Planning Services.
4. The applicant shall appear at the Board of County Commissioner's

GENERAL
This report presents the results of data obtained during
the subsurface investigation of 3£372 Weld County Road 21 ,
Weld County, Colorado. This investigation was made to
determine the most suitable type of a foundation, allowable
soil bearing pressures, ground water conditions and problems
that may be encountered during construction.
CONCLUSIONS AND FOUNDATION RECOMMENDATIONS:
This residence shall be supported on straight shaft:
piers (caissons) drilled a minimum length of ten feet ( 10 ' )
and a minimum penetration into the sandstone-claystone a
depth of three feet ( 3 ' ) , or to refusal. These drilled piers
may be ten inches ( 10" ) in diameter and should be designed
.for maximum end bearing pressure of 15, 000 pounds per square
foot, and a minimum dead load of 7 , 500 pounds per square
foot based on pier end area. In the event that the house
should be located other than where the soil tests were
conducted, an excavation inspection shall be performed by
this office, or by another qualified engineer to verify the
soil conditions. The drilled pier holes should be thoroughly
cleaned of all loose soil and filled with a low slump
concrete immediately after drilling to prevent infiltration
o£ water or loose soil. The concrete piers shall be
reinforced for their full length with a minimum of two
number four (2-N4 ) steel bars.
SITE CONDITIONS:
At the present time the site has a old home and it is
planned that a new single family home be constructed.

FIELD AND LABORA'T'ORY INVESTIGATION:
Two ( 2 ) test holes were dug on September, 17 , 1990 at
the location shown on the site plan figure H1 . These holes
were dug by a 4" diameter auger to a depth of twelve feet
( 12 ' ) Generally, the soil consists of clay (CL) to a depth of
six feet (6 ' ) more or less, thence weathered siltstone to
twelve .feet ( 12 ' ) . No water was encountered.
DESIGNS AND CONSTRUCTION DETAILS SLAB ON GRADE CONSTRUCTION:
The natural soils are suitable for the support of
exterior concrete slabs, garage slabs, and basement slabs.
Experience with similar conditions has shown that these
details will help prevent swelling of the soils under the
slabs and will minimize damage when wetting of the soils does
occur.
1 . Do not place a gravel layer beneath the concrete slab.
The slab should be placed directly on the undisturbed
natural soils, or well compacted fill soil .
2 . Separate the slab from all load bearing members and
utility lines to allow for independent movement of
the slab. Provide a positive control or slip joint
at: the construction joint between the slab and foundation
walls.
3. Provide frequent scoring of the slabs to provide control
joints for possible cracking of the slab. Control joints
should be placed to provide approximate slab areas of 200
square feet.
4. A minimum void or clear space of three inches ( 3" ) should
be provided at or near the bottom of all non-bearing
partitions and furring strips placed over the concrete
slabs. In finished room areas, all drywall and paneling
should be stopped about- two inches (2" ) above the top
surface of the slab. This will allow some space for
upward movement of the slab before pressures are applied
to the wall and upper levels of the buildings.
5. In the event of a hot; water heat system is used, the
piping should not be placed beneath the concrete floor
slab. In the event a forced air furnace is used, a two
( 2" ) collapsible connection should be provided between
the furnace and the heat ducts.
6. The soils that will support the concrete slabs should be
kept moist during construction by occassional sprinkling
of water and especially a day or so prior to pouring of
the slab.

SUBSURFACE DRAINAGE:
The backfill soil around the buildings should be
moistened and well compacted to prevent future settling .
Controlled puddling of the backfill soils is considered
satisfactory. The future owner should be advised to fill
in any settled area to eliminate pending of water near
the buildings and to provide adequate slope for proper
drainage away from the building and off of the site at
all times. The finished grade or ground surface near the
foundation walls should have adequate slope to provide proper
drainage away from the building and off the site. A minimum
slope of twelve inched ( 12" ) in the first ten feet ( 10 ' ) out
from the building is recommended. Roof downspouts and sill
cocks should discharge onto long concrete splash blocks ( 5
feet long) or into metal gutters extensions to deposit runoff
water farther out from the house and beyond the limits of
backfill soil near the foundation walls.
The future owners should be cautioned and advised
against the installation of a lawn sprinkler system adjacent
to the foundation walls. If a sprinkler system is installed,
the sprinkler heads should be placed so that water spray from
the heads under full pressure does not fall within five feet
( 5 ' ) of the foundation walls. Lawn irrigation should be
controlled to prevent excess wetting of the subsurface soils.
Lawn, flowers, shrubs, and other plantings within five feet
(5' ) of the foundation walls should be hand watered and this
watering should be minimized.
SUBSURFACE DRAINAGE AND BASEMENT CONSTRUCTION:
No free water was encountered during the digging of the
test holes. Ground water should not affect ground
construction or be a deterrent to the construction of the
building. however, a foundation drain (Figure 3 ) is required
to prevent water problems in the basement.
CONSTRUCTION DETAILS:
In any soil investigation it: is necessary to assume that
the subsurface soil conditions do not vary greatly from the
conditions encountered in our field and laboratory testing.
Our experience has been that, at times, soil conditions do
change and variations do occur and may become apparent at the
time of excavation for the foundation system. If soil
conditions are encountered which appear different from the
test borings as presented in this report, it is recommended
that this office or a qualified soils engineer be called to
inspect the open excavation. This inspection is not a part
of this report and is not included as any part thereof.

CAISSON
SPREAD FOOTINGS : are used and are in poor condition in several areas
with settling, crumbling, and cracking.
FOUNDATION WALLS: are in poor condition with some places collapsed and
others broken or missing. Settling is apparent and
a complete collapse of the foundation is possible
in the future.
COMMENT: A basement section has been added and with water infiltration
and poor workmanship has collasped in places .
FLOOR SYSTEMS :
BASEMENT: Concrete nonstandard thickness is not correct and crumbling
has occurred along with heaving.
1ST FLOOR: I found that the joist spacing to be 2"x8"-24" o.c . with
spans of 8 ' to 12 ' . Maximum spans for construction grade
fir is 10 ' 9" .
Also found that some of the floor griders are no longer
setting on supports because they have settled .

DRAINAGE: The groud around the home is not graded properly to have a
positive drainage profile. Observed some indication of
ground water entry into basement but no positive indication.
OUT BUILDINGS: Three were observed and seemed to be in fair to very
good condition . Other buildings were in fair condition
and all were in gerneral of good construction . Pipe
fencing and corrals seem to be in very good to excellent
condition. A mobile home is on the property and in
general is in good condition and can be readily repaired
and put back into service.
SPECIAL NOTES AND COMMENTS :
The house can be repaired and placed back in service. Several
things need immediate attention. The foundation needs to be
repaired in some places and replaced in others to make the house
safe. Exterior grading is not proper and needs attention to
have a positive grade away from foundation. House needs to be
jacked up and leveled and shored up to make stable. Under floor
griders needs to be installed in crawl space to support the
floor in this section. Water piping in the house needs to be
totally replaced.
