RE: APPROVAL OF RECORDED EXEMPTION NO. 1296 - DONALDSON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS , as amended, did
determine at a public meeting held in the Chambers of the Board,
that a certain parcel of land, to be divided into two parcels, as
shown on the plat known as Recorded Exemption No. 1296 , does not
come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , and
WHEREAS, the request for Recorded Exemption No. 1296 was
submitted by Michael J. and Jeff Donaldson for property which is
located in the N} of the NWi of Section 18 , Township 7 North,
Range 65 West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A" , said plat to be recorded, and
WHEREAS , this request is to divide the property into parcels
estimated to be approximately 66 acres and 14 acres .
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land be, and hereby is, exempt from the
definition of the terms , "subdivision" and "subdivided land" .
BE IT FURTHER RESOLVED by the Board that this approval is
conditional upon the following: 1) The applicants shall submit a
mylar plat to the Department of Planning Services to be recorded
in the office of the Weld County Clerk and Recorder. The plat
shall be drawn in accordance with the requirements of Section
9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within 60 days from the date of approval by the
Board o£ County Commissioners. The applicant shall be responsible
for paying the recording fees; 2) A Weld County septic permit is
required for any proposed home and its septic system shall he
installed according to the Weld County Individual Sewage Disposal
System (ISDS) Regulations; 3) An ISDS Evaluation by the Weld
County Health Department on all existing septic systems will be
necessary prior to issuing the required septic permits on the
existing systems; 4) Within 30 days of approval by the Board of
County Commissioners , the mobile home on the proposed smaller lot
shall be removed or shall be brought into compliance with the Weld
County Zoning Ordinance; 5) Within 45 days of approval by the

Board of County Commissioners , North Weld County Water shall be
installed to serve the proposed smaller lot; and 6) a Covenant or
agreement, approved by the Weld County Attorney' s Office, ensuring

provided to the Department of Planning Services prior to recording
the Recorded Exemption plat.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 19th day of
September, A.D. , 1990 .

Subject: Recorded Exemption #1296
Dear Commissioners:
This request for a recorded exemption is submitted by Michael J. and Jeff
Donaldson. The parcel of land is described as the N} of the NW} of Section
18, T7N, R65W of the 6th P.M. , Weld County, Colorado. The property is
located approximately 3 miles northeast of the Town of Eaton, south of Weld
County Road 78, east of Weld County Road 41. This request is to divide an
80 acre parcel into two lots of 66 acres and 14 acres, more or less. This
parcel is not the total contiguous land holdings of the applicant. The
applicant also owns approximately 78 acres immediately south and adjacent to
this property.
The proposed 14 acre parcel is currently served by a domestic well and a
septic system. The applicant has agreed to install North Weld County Water
District service to this proposed lot within 45 days if the application is
approved. The applicant has proposed serving the larger parcel with North
Weld County Water District and a septic system.
It is the opinion of the Department of Planning Services' staff that the
applicant has failed to show in the submitted application materials how this
request is consistent with the Weld County Comprehensive Plan. The intent
of the recorded exemption process is not to reduce a debt load as stated in
the application materials. The guidelines used to allow a division of an
agricultural lot into two separate lots are outlined in Agricultural Policy
7. The intent of this policy is to:
A. Enable the property owner who is retiring an opportunity to
live on or sell the existing farm improvements;

B. Enable the property owner to sell off agricultural land that
is nonproductive for one single family dwelling homesite; and
C. Enable the property owner to provide a residence for direct
members of the farm family and also for workers employed at
the farm.
The level of development and the potential for continued divisions occurring
in this area and on both parcels warrants concern. The 80 acre parcel which
is immediately south of the parcel in question was approved for a recorded
exemption in May, 1990. That recorded exemption created a 78 acre parcel
and a 2 acre parcel, more or less. The 78 acre parcel and this 80 acre
parcel were then sold to the Donaldsons on May 17. Approval of this request
would result in the creation of 4 parcels of land, where one parcel (a
quarter section) existed in May of this year.
The existing improvements on the proposed 14 acre parcel are on the far
eastern portion of the proposed lot. The major portion of the proposed 14
acre lot is productive farmground, and is currently farmed. The proposed
configuration will not promote the efficient use of the farm. The staff has
concerns that the proposed division will be inconsistent with efficient and
orderly development.
The staff request that the Board of County Commissioners consider the
application and determine if the standards of Section 9-2 E. (1) (a) through
(m) of the Weld County Subdivision Regulations have been met.

The applicant shall submit a mylar plat the Department of Planning Services
to be recorded in the office of the Weld County Clerk and Recorder. The

COMMENTS:
Access to the proposed larger lot is from Weld County Road 78, a gravel
road. The smaller lot contains one home, corrals, outbuildings, and a

Zoning Ordinance. The mobile home is permitted by ZPMH-1173 for an
accessory to farm. The smaller lot also contains bean crops. Access to the
smaller lot is from Weld County Road 41, a gravel road.
The proposed larger lot contains agricultural production. There is an

To Whom It May Concern:
Pursuant to the enclosed request for Recorded Exemption on our Weld
County farm, we wish to set forth the following reasons for said
request:
We desire to obtain a Recorded Exemption on this property so that we
will be able to sell Lot A. I so doing we can reduce our debt load on
the remaining property particularly Lot B. The irrigated land on Lot A
has always been this same size field, therefore we will not be creating
an unmanageable or inconsistent size of a lot. This field is isolated
due to the existing yard on the east end of the proposed Lot A and on
the north and south by existing entrance roads. The west boundary is
WCR 41.
We believe that this proposal is consistent with the policies of the
Weld County Comprehensive Plan, and also consistent with the zoning
district in which the property is located.
Lot A of this parcel will be used for a single family residence and Lot
B will continue to be used for irrigated farming, both of which are, in
our opinion, compatible with existing surrounding land uses.
It is our understanding that our intended use will be compatible with
the future development of the surrounding area as permitted by the
existing zone and with future development as projected by the
comprehensive plan of the county.
We do not believe that our-intended use of this property will be
inconsistent with efficient and orderly development.
Water will be delivered to the property by North Weld County Water
District and a septic permit will be applied for. In addition, the
requirements o£ the Weld County Health Department shall be adhered to.
To the best of our knowledge, this property is not located in a flood
plain or geologic hazard. The closest landing strip is approximately
two miles south and one mile east of the property.

We believe that the location of Lot A is in a good location relative to
Lot B. It allows easy access from WCR 41, as an additional approach
will not be required. This location also allows Lot B to be irrigated
in an efficient manner. Lot A will continue to be irrigated in the same
historical manner after the proposed split. There will be an easement
given and an agreement made allowing irrigation water to be run in the
existing irrigation ditch on the west side of the property. This field
irrigates from west to east up next to the existing yard.
As there will be no changes made in land uses, we respectfully request
that you recommend approval of our enclosed application.

Dear Sirs:
Your recorded exemption application is complete and in order and will be
processed on or before September 4, 1990. If it is determined that the
application meets the approval criteria of Section 9-2 E. (1) (a) through
(m) of the Weld County Subdivision Regulations, you will be notified that
the recorded exemption is approved. If the staff determines that the
application does not meet the approval criteria, you will be notified and
asked to appear before the Board of County Commissioners at a public
hearing. You will be informed of the hearing date prior to the hearing.
The Board of County Commissioners will then consider your application and
make a final decision on the recorded exemption.
It is the policy of Weld County to refer an application of this nature to
any town or municipality lying within three miles of the property in
question or if the property under consideration is located within the

DECLARATION OF
COVENANTS, CONDITIONS, AND RESTRICTIONS
THIS DECLARATION OF COVENANTS, AND CONDITIONS AND RESTRICTIONS
("Declaration") is made and entered into this day of
October, 1990, by MICHAEL J. DONALDSON and JEFF M. DONALDSON
("the Declarants") .
WITNESSETH:
WHEREAS, the Declarants are the owners of the following
described real property situated in the county of Weld, State of
Colorado ( "the Property") :
All of the North 1 /2 of the Northwest 1 /4 of Section
28, Township 7 North, Range 65 West of the 6th P.M.
WHEREAS, the Property has been platted as Recorded Exemption
No. 0709-28-2-RE1296, the plat of which has been or will be recorded in
the office of the Clerk and Recorder of Weld County, Colorado ("the
Exemption Plat") , and
WHEREAS, the Property has been divided into two parcels as
designated on the Exemption Plat: Lot A, consisting of approximately
14.49 acres, and Lot B, consisting of approximately 63.42 acres, and
WHEREAS, the Declarants are the owners of one share of the
capital stock of the Larimer and Weld Irrigation Company and one share
of the capital stock of the For-Far Lateral Company ( "the Water
Stock") , and
WHEREAS, the Declarants desire that the Water Stock be
transferred and conveyed with Lot A, and
WHEREAS, the water to which the owner of the Water Stock is
entitled is transported to Lot A from the For-Far lateral , which is
located to the south of Lot A, and
WHEREAS, the Declarants are the owners of the real property lying
between Lot A and the existing For-Far lateral , and
WHEREAS, the Declarants desire to create an easement over and
across the Property located south of Lot A to provide for the
transportation of water from the existing For-Far lateral to Lot A. A
legal description of said easement is attached hereto as Exhibit "A"
and incorporated herein by reference ("the Easement" ) , and

WHEREAS, the Declarants desire that the Easement be
appurtenant to Lot A.
NOW, THEREFORE, the Declarants hereby publish and declare
that Lot A, as designated on the Exemption Plat, shall be held,
sold, conveyed, transferred, leased, subleased, and occupied
subject to the following covenants, conditions, easements, and
restrictions, which shall run with the land and shall be binding
upon and inure to the benefit of all parties having any right,
title, or interest in or to Lot A or any portion thereof, their
heirs, personal represenatives, successors, and assigns.
1 . The Water Stock shall be appurtenant to Lot A and shall
be sold, transferred, and conveyed with Lot A. Ownership of the
Water Stock may not be separated from ownership of Lot A.
2. The Easement shall be appurtenant to Lot A and shall
inure to the benefit of the owners of Lot A. Use of the Easement
shall be limited to the installation, maintenance, and repair of
an irrigation ditch to transport water from the existing For-Far
lateral to Lot A. The owner of Lot A shall have the right to
enter upon the Easement for the purpose of construction, installing,
maintaining, and repairing an irrigation ditch within the Easement
hereby created and for the purpose of transporting water from the
existing For-Far lateral to Lot A.
3. This Declaration is for the benefit of the owner of Lot
A and the County of Weld, State of Colorado ("the County") . In
the event the Declarants or any subsequent owner of Lot A
attempts to convey the Water Stock separate and apart from the
conveyance od Lot A, the County shall have the right to commence
proceedings in the Weld County District Court for the purpose of
specifically enforcing the terms and provisions of this. declaration,
requesting that the court enter an order restraining the
Declarants or any subsequent owner of Lot A from transferring or
conveying the Water Stock separate from Lot A. In any such action ,
the court shall award to the prevailing party all costs and reasonable
attorney' s fees incurred.
4. This Declaration may not be altered, amended, or
revoked, in whole or in part, at any time, except by written
instrument signed by the then-record owners 'of Lot A and by the
County.

LEGAL DESCRIPTION OF THE EASEMENT
A 20.00 foot wide easement for the continued use and maintenance
of an existing irrigation ditch through the West Half of Section
28, Township 7 North, Range 65 West of the 6th P.M. , County of
Weld, State of Colorado; said easement shall lie 10.00 feet on
either side of, as measured at right angles to, and parallel with
the existing centerline of said irrigation ditch; said irrigation
ditch begins at the For-Far lateral and runs Northeasterly to a
point East of the Easterly right-of-way line of Weld County Road
41 ; thence Northerly parallel with said right-of-way line to the
South line of the North Half of the Northwest Quarter of said
Section 28, said point being the point of terminus of said
easement.
